I just got an advanced copy and will be reading it soon. Andrew C. McCarthy has also seen the light on the Deep State. Months and months ago, he was largely taking the line that the Armed Wing of the Democratic Party was just a bunch of great ethical heroes who should be trusted in their judgment. Since then, he has been a steadfast critic of Mueller and the Russia Narrative. He constantly points out that the special counsel law requires the factual statement of an actual crime to be investigated, which Rosenstein and Mueller have completely ignored, instead basing their authority -- lawlessly -- on the premise of a counterintelligence investigation. But the Special Counsel law says that a crime must be named. You can't evade that requirement by just saying "It's a counterintelligence operation." A Special Counsel cannot be appointed to conduct such an investigation. Chuck Grassley has picked up on that, and is now demanding that Wray and Rosenstein explain what part of what law they rely on for the proposition that a Special Counsel can be appointed in absence of a named crime:
The Deep State Is Real, And Much Bigger Than You Know I used to be a doubter who would cringe, just a little, at any mention of "the deep state." I admit it, it all seemed a little far-fetched to me that there was this cabal of careerists conspiring from within the government to harm President Donald Trump when I first heard it. I never doubted there were individuals doing it, but a wide net of conspirators seemed like something out of a bad movie more than anything that could actually happen in the United States. I was wrong, very wrong, the deep state is real. But there is much more than just this small group of powerful people working toward a common goal, there is an entire infrastructure created by the left not only to destroy Trump, but to indoctrinate unsuspecting Americans into their agenda. As the curtain is pulled back on the Obama administration's unprecedented efforts to spy on the Trump campaign, there is a good possibility many of the perpetrators could face criminal charges, or at least should. But it's important to understand that liberals didn’t just create this out of the blue in 2016, it's the culmination of everything they've worked toward for decades. The infrastructure they used to spy on the Trump campaign was something inherently governmental, simply planting a mole in the campaign couldn't tap phones or access emails. But the ability to cover up that fact requires a level of media complicity that takes time to create. Getting the desired message out is only part of the battle, it has to be believed by a significant percentage of the public for it to really matter. Conditioning the public to be receptive to that message, without questioning how it came about or why they should care required subtle indoctrination over a lifetime. As it stands, liberals have that infrastructure in place, they had that support system ready to go. And, not to get all Scooby-Doo on you, they would've gotten away with it were it not for the existence of conservative media. .... None of this is by accident, and it didn’t start on November 8, 2016, it just sprang into action. Nearly every aspect of life, to one degree or another, has been or is ready to be weaponized against anyone who dares to stand up to the liberal agenda. And none have stood up to it in a more threatening way than Donald Trump. But the clock is ticking, the fuse is burning down low.

The Appointment Order proscribes the Special Counsel's jurisdiction by citing specifically "the investigation confirmed by then-FBI Director James B. Comey in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017." In his March 20 testimony, former Director Comey referred to "the investigation" as a counterintelligence investigation -- not a criminal investigation. I have been highly critical of Andrew McCarthy, no, 'tis true!, but he's very slowly starting to realize that just how deep the rot is.
I do believe that he owes his readers an apology for his full throated Mueller et al are wonderfully ethical people of great ethics. That said, I have always felt some sympathy for him. It is very difficult to have to face the fact that not only was your opinion of the righteousness of the group for whom you worked completely wrong but you were also not nearly the judge of character you thought you were.
No one wants to do that. The brain will actively resist attempts to alter your neural pathways to do that.
RE: The Deep State - as I keep saying, I've run out of yarn and am now using twine and a few more wall. I don't think we have any idea of how deep the rot goes or how long these things have been going on.

I like Andrew McCarthy but his credibility when it came to vouching for the integrity of others was shot back when he stood up for Patrick Fitzgerald (who was appointed by Comey, BTW). Fitzgerald made a criminal mockery of both the Valerie Plame bullshit and the auctioning of Barky's old Senate seat. But McCarthy vouched for him all the way through.

you have to factor in personal bias, which is a thing that exists for everybody. He worked in the DOJ. He knows a lot of prosecutors. He had pride in the organization. He *thought* it wasn't corrupt (probably because it wasn't very corrupt when he was in it).

McCarthy lost all credibility when it comes to his opinions of the integrity of government attorneys. He cannot get that back. Credibility is one of those things that, once it's lost, it's lost.

a) I prefer the 'administrative state' to the 'deep state', a little less inflammatory (though it deserves a full necklacing) and there's a fair bit of literature behind the term.
b) Andy McCarthy may be on the right side of the issue now but he has been a reluctant convert to the concept, he spent a long time explaining ironclad methods and procedures that all his former mates supposedly followed which proved to be observed in the breach.

This isn't going to be popular but I'll say it again. The writing has been on the wall since the 2008 bank bailouts that the global economy is going to collapse. There simply is no other way - they guaranteed that 10 years ago by giving the bankers $10 trillion instead of putting them in jail. Everything that has happened since has been to condition us to follow our masters who will still hold any wealth when the inevitable happens.

According to an article I read yesterday, lots of people boycotted the election, calling it a fraud. And apparently most of Maduro's campaign consisted of predictions (i.e., threats) of violence if he lost.
No doubt Maduro will claim that he has a mandate now. One of the drawbacks of democracy is that it gives a veneer of legitimacy to a government, no matter how inept or corrupt it is.

I still remember back during the Obama years and the 2012 Presidential campaign when people were talking about a "deep state" and ace back then was calling those people ridiculous conspiracy theorists. Mainly because people were accusing *ace* of being part of the "deep state".
It wasn't called the "deep state" back then, but commentors were accusing him of being a shill for RINOs.
But, as Derek Hunter states, this "deep state" stuff did not just get built overnight. It has been in motion for decades. And not just on the Left and within the Democrat Party. The Republicans are just as guilty.
Ace is really good at calling out the cruise ship-conservatives now, but back then even he was skeptical. Of course, it's not a good strategy to get someone to see your side by accusing them of being a part of the conspiracy...
But anyway, it takes different things to wake people up to this "deep state" stuff. Not everyone sees it for what it is at the same time. But it is good that more and more are beginning to finally see the light.

The Holman Rule allows members of Congress to propose amendments to appropriations bills that target specific government employees or programs in an effort to cut spending.
Under the rule passed this week in larger rules package, any such amendment that would target an employee or program would have to be passed by a majority of the House and Senate. That makes it unlikely, albeit possible, for lawmakers to reduce a federal worker's pay.Since apparently it is impossible to change the civil service employment protections (which make next to impossible to fire any of these assholes), how about making this rule an executive matter?In other words, allow the President to cut the pay of any individual with a simple executive order.We talk about draining the swamp, but actual proposals for how to do that seem to be few and far between. Of course, eliminating gubmint unions would be better, and making their protections from firing to be on a par with private industry standards even better, but sigh not expected in my lifetime.Perhaps Trump 2.0 could make some of this happen. Trump 1.0 is trying to reduce the # of employees, which is also necessary, so that's a plus.

Mueller was appointed under USC515 with reference to 28CFR600 which is the DOJ regs.
However, later in the code, there is USC 528 that says the Attorney General must make regulations with regards to conflict of interest, arguably making the regs federal law.
