Will New IG Report Make Criminal Referrals?

Paul Sperry seems to say "yes." But note he doesn't say the IG report will make criminal referrals; he says it includes "reasonable grounds" for such referrals.

Is that a distinction worth noting? You'll see why I ask in a moment.

BREAKING: IG Horowitz has found "reasonable grounds" for believing there has been a violation of federal criminal law in the FBI/DOJ's handling of the Clinton investigation/s and has referred his findings of potential criminal misconduct to Huber for possible criminal prosecution

Sara A. Carter's sources, on the other hand, say there might be at least one criminal referral, but the draft being circulated for comment does not actually contain any criminal referrals.

Inspector General Michael Horowitz's report, which is expected to be released within the next three to four weeks to the public, has been turned over to current and former officials for review, as first reported in The Wall Street Journal and Washington Post.
The draft, however, does not include any recommendations for criminal prosecution. If there was any evidence collected by the Inspector General's office of criminality, Horowitz would then refer the matter to the Department of Justice and submit a criminal referral to prosecutors.
"It would be up to the Inspector General to make the recommendations but there is an expectation that there will be at least one referral for prosecution," said a source familiar with the findings, who added that it is not conclusive as the Inspector General’s office never discusses ongoing investigations.

Sperry and Carter might be reporting the same ambiguous information using different words. Maybe Sperry's sources mean to say that while the draft does not itself make any criminal referrals, the information contained within it provide "reasonable grounds" for such a referral, which may come later.

In other words: While the draft does not make the criminal referral, it amasses information to support such a referral. Which could then later result in a referral.

Also, Carter's report does not preclude such a referral; indeed, one source says the general expectation is that "at least one" such referral will issue.

But it's not in the draft.

Note that this report is only about the FBI's/DOJ's handling of the Hillary email "matter." (Always say "matter," never say "criminal investigation" -- as Comey's boss lady ordered, and as he dutifully obeyed.)

The investigation into the FBI's/DOJ's handling of the Trump investigation was only ordered in March and that investigation will take additional months, I figure.

While the terms "reasonable grounds" and "criminal prosecution" gain additional emphasis against the draft submission, months ago it was transparently obvious OIG Michael Horowitz discovered criminal conduct and submitted his request. AG Jeff Sessions informed everyone of U.S. Attorney John Huber in March.

If IG Horowitz did not discover reasonable evidence of criminal conduct there would not be a U.S. Attorney (Huber) paralleling his investigation since late last year. U.S. Attorney John Huber was assigned to assist Horowitz at least eight months ago. It wasn't until March of this year when AG Jeff Sessions, quietly made the acknowledgement.

Just like any situation in law enforcement when a person witnesses something or someone reveals something to him that person immediately becomes at the very least a witness.. That incluses a cop who sees you have a tail light out on your car up to the DOJ and FBI breaking statutes and laws.... The IG has determined laws have been broken and has at least probable cause to refer for prosecution. Granted prosecutors do have a wide berth actually almost Carte Blanche is their decision to prosecute.The President can make recommendations so both the DOJ and FBI are top down in the chain of command.. Given that the report has been distributed to counsel for all corrupt officials involved (according to recent reports), then over the next 2-3 weeks in advance of the OIG report, a series of articles published in the New York Times and Washington Post that will soft-peddle the corruption and white-wash the crimes with sympathetic prose. Then when the OIG report drops, Clinton et. al., will play the 'ol "this is old news" and "right wing conspiracy" cards

I can blame it all on you and you're always going to get punished, no questions asked. You might get to come back for another year, but my mom's going to have you expelled after 5th grade. 433 A criminal "referral" is not necessary. The prosecutor can take up a criminal case without it being 'referred" by an investigating agency. The IG normally only produces a report. He can ask that a criminal case be opened by the prosecutor, but the prosecutor can do so without being asked.
