In the end it's up to the jury. That's why the left tries to get trials of conservatives held in places where the public is mostly liberal...to up their chances that the jury will make a political judgement rather than a legal one. The really bad parts seem to have started in the late 80s, early 90s. I'm not sure if that's because the mob was basically gone by then so they had more time on their hands, or because the Cold War ending reduced their side of things, and they needed to look good to congress or what. Because before that they might have messed up but I'm unaware of anything like the Bulger debacle or the other, similar and lesser known cases like it that started up around that time. It is worth noting that for being a power hungry, corrupt scumbag, Hoover did a pretty good job of keeping the beast under control. Once he was gone, it kind of metastasized. We do need some form of federal law enforcement body, but like the CIA (and the host of other intelligence bodies) they don't need to be as big, expensive, or powerful as they are at present.
