Justice Department "Reviewing" At Least Two of the Memos Comey Leaked to His Pal To Leak to the NYT, For Possible Violations of Classified Material Law

Oh.

One of the memos contained information that wasn’t classified when Comey turned it over to a Columbia law school professor, but was later upgraded to “confidential,” the lowest level of classification, The Wall Street Journal reported.

In the other, Comey redacted parts that he knew were classified to protect that information before he handed the documents over to the law prof, Daniel Richman, who passed them along to The New York Times.

Sean Davis noted this past January that, seven months later (and now nine months later), CNN still hasn't corrected its #FakeNews false reportage that Trump was lying when he said Comey leaked classified memos.

We now know that one was "confidential" and the other contained classified information (which Comey, allegedly, redacted).

CNN just leaves its original story up, uncorrected, no matter how much weight of its falsity piles up against it.

And who wrote it? Jake Tapper, the Super-Factual Only Honest Man in the Room (when James Comey isn't in the room, naturally).

More than half of the memos former FBI Director James Comey wrote as personal recollections of his conversations with President Trump about the Russia investigation have been determined to contain classified information, according to interviews with officials familiar with the documents.

CNN's Jake Tapper, however, took issue with Trump’s statement, and wrote the following lede and supporting paragraphs in a CNN story accusing the president of peddling false information about the nature of the information leaked by James Comey after he was fired by the president:


The Columbia University Law School professor and confidant of former FBI Director James Comey refuted a charge by President Donald Trump and his advocates in the media Monday: that Comey shared classified information with journalists.

Daniel Richman, with whom Comey shared at least one memo -- the contents of which Richman shared with New York Times reporter Michael Schmidt -- said President Trump was simply wrong.

"No memo was given to me that was marked 'classified,'" Daniel Richman told CNN. "No memo was passed on to the Times."

Davis notes that's the same dodge Hillary Clinton used -- asked if she put classified documents on her system, she said they weren't marked classified.

As regards some of Hillary's emails, that's because she ordered her minions to strip the classified markings out. In others, it's because the documents were so fresh they hadn't been formally classified -- yet.

The only person who could mark Comey's classified memos as classified was James Comey, because no one else knew about them -- until he gave them to a pal to read to the New York Times.



Davis continues:


As it turns out, however, the information leaked by Comey was classified, and the records in his possession were clearly government records which Comey was not authorized to possess or distribute. How do we know the information was classified? Because the FBI itself told Congress as much. In fact, the information leaked by Comey was so sensitive that members of Congress were not even allowed to read the memos he wrote outside of a Special Compartmented Information Facility, or SCIF, a highly secure room or area designed to prevent classified information consumed within from being improperly distributed.

Instead of correcting his #FakeNews false story, Jake Clapper chooses to tweet superficial #ResumeEnhancing phony sentiments about veterans to get his #SalonHot25 Spirit Squad to vouch for his good conservative character.

As we're seeing, it's standard practice for DC swamp creatures to cover up the stink of their falsehoods with the cheap dimestore perfume of sanctimony.

I'd like to believe that with a new president and heads of departments at least that we'll see something different from this but... I'm not confident.

I've been saying for a year or more that justice takes time and they have to build an extra careful case but... that doesn't mean the case goes anywhere.

However, there is also the political angle.

The most prominently clean people who could shoot at Trump are now dirty. They would have been great assets on the campaign trail (directly or indirectly) to use to besmirch Trump and the GOP as a whole.

As it stands, they're all dirty.

Trump shows the world how dirty other people are by forcing them into the mud with him.

In terms of grand strategies, it seems to be a pretty good one so far.

A document is either classified or not classified at it's creation (Original Classification). The burden of proof for ensuring a document is properly marked and handled (ie, who has access to it) with the correct classification lies on the creator of that document - in this case James Comey. This is why documents which are even remotely likely to be considered classified get reviewed by a neutral third party to ensure they are appropriately marked.

James Comey did not do this.

To be clear, while there are many markings which can appear on a
document (ie, NOFORN - no release to foreigners, LES - law enforcement
sensitive, FOUO - for official use only) Title 22 CFR 9.4 states what are the classification markings as far as the United States Government is concerned - CONFIDENTIAL, SECRET, and TOP SECRET. Comey's memo contains information that is CONFIDENTIAL and possibly also SECRET and should have been marked and handled accordingly.

Additionally, Comey's memos would be covered by:
22 CFR 9.4 - Original Classification, (c) (1) containing information relating to:
(ii) Foreign government information
(iii) Intelligence activities (including covert action), intelligence sources or methods, or cryptology
(iv) Foreign relations or foreign activities of the United States, including confidential sources
Each
department has a classification review process that ensures anything
released conforms to Federal law. The memos should have been reviewed by
an impartial third party within the FBI (or at the least should have
been reviewed by an FBI in house lawyer) and the classified portions
redacted prior to release.
This did not happen.
Some
commentators are saying that Comey, as the Director of the FBI, would
have been in his right to release the memos on his own authority. The
problem with that argument is that at a minimum the FBI's internal
document classification review board would have had to have a look at
the memos as well as the FBI's own in house lawyers, prior to their release, just to ensure
everything was done by the book.
This. Did. Not. Happen.
Comey
wrote these memo, containing information he knew to be at a minimum CONFIDENTIAL and possibly SECRET, and then released them to a friendly journalist. Upon
review the FBI determined there was classified and/or sensitive
information in the memos and the Director of the FBI leaked this
information, concerning an active law enforcement investigation, to the
media without having even an in house lawyer look at it and say
"Kosher."
However, something much more damaging to Comey's
credibility and will pour gasoline on this dumpster fire deserves to be
shouted from the roof tops:
If FBI Director James Comey had a
penchant for creating memos for his contacts with Donald Trump... where
are his memos for contacts with Andrew McCabe, AG Loretta Lynch, AG Eric
Holder, Sec. Hillary Clinton and President Barack Obama.
I think we all know the answer to that one...

Researcher claimed that wasn't true. He then went on to claim that Pakistan can't vet their citizens either, nor can Saudi Arabia and there are no bans in place there.

Dumbass Gordon didn't point out those are muslim countries. And are much more advanced than say, Sudan, or Somalia.

I had to turn it off.

To me it felt like #1 was a a movie a writer had spent years writing. And #2 a studio wrote because #1 was so well received.

It was such a short chain--unlike the first movie. I've never seen such a sheer dropoff in a series of movies. I think it has to go on record as the most disappointing sequel ever...until The Meh Awakens and Star Wars: Girl Power.

The First National Treasure movie was fun ... but the story int hat was really retarded. Nick Cage found the ship, which was the original clue that his great-great-great-whatever grandfather had given. SO WTF had the family been hunting that whole time? The Charlotte was the only friggin clue and no one knew it was even a ship until Nick Cage found it iced up. 200 years of that family chasing one clue that no one had any idea about.

And then John Voight has the temerity to tell Cage that the code on the back of the Declaration is just one more clue that will lead to another and another ... but neither he, nor his father, nor HIS father ... had ever even found the original clue - Charlotte.

I really don't think it was that.

Trump has made incredibly stupid personnel decisions (how many people has he hired and then fired?) so it doesn't surprise me Comey was one of many.

My only guess is someone purposely kept him in the dark about his role. Or maybe he thought Comey was on his team because of the late reopening of the Hillary case.

But it's definitely not a smart gamble to keep an FBI Director that you think is out to get you.

We're fortunate that Comey was stupid enough to have left the paper trail he did, but Mark Felt (deep throat) is what destroyed Richard Nixon, and he was only an associate director of the FBI.

I'll just never understand though why Republican PResidents don't fire EVERY single person they possibly can on Day 1. These people also undermined Bush at every step as well.

She spent some of her honeymoon watching possessed people at some Voodoo ceremony and the spirit cooking is weird. ANd, like I said, the whole point of the story was that his great^8 grandfather was given the clue "The secret lies with Charlotte" and no one had any idea what that meant until Nick Cage. So what was the family chasing? I'll tell you what - NOTHING!

Look, National Treasure was a very fun movie but the story had so many problems and holes in it that it really doesn't pass the smell test. It is a true "guilty pleasure".

The Columbia Post appears to have been news with a sarcastic take, but has been sold and the new owners are moving the site and so now I don't know what to make of it.

That said, there are links about the Coven story that I'm following. Including an Instagram pic.

For now, it appears she went to speak to them about her book...no surprise there...and they gave her a membership. Not sure that is really joining a coven. I mean, Pantsuit is pretty hollow, but want to be careful on fake news.

If facts appear to be different after more research, I'll post them.

Late to the post, but Richman is being purposefully misleading. The U.S. doesn't mark classified documents "Classified." Those documents are marked either CONFIDENTIAL, SECRET or TOP SECRET in level of potential damage to national interests if obtained illegally. There is much more complexity to the system, but those are the basic markings.

Furthermore, an UNCLASSIFIED document can have distribution restrictions or be marked FOR OFFICIAL USE ONLY.
