McCabe's Lawyer: McCabe Repeatedly Told James Comey That He Was Leaking to the WSJ and Had His Approval, Despite Comey's Denials



One possible explanation that some might suggest that splits it down the middle (and maybe keeps both men from a perjury rap) is that McCabe told Comey that he was going to rebut the WSJ's previous article suggesting that McCabe and the FBI were slow-playing the Hillary investigation, but Comey did not know that McCabe was going to tell them (or rather have his "Special Counsel," almost certainly Lisa Page tell them) about the phone call from the Principle Acting Deputy Attorney General in which the "PADAG" tried to back McCabe off from investigating, but McCabe bravely soldiered forward.

(According to the perfectly truthful McCabe, that is.)

This sort of "one's half right, the other's half right" explanation might be enough to keep them both out of jail.

This attempt at a reconciliation between the two conspirators' stories has been floated before:

Another source familiar with the matter argued that the discrepancy between the two accounts is more about the fact that they are recalling the interaction differently than a dispute about what took place, saying both were acting in "good faith."

"They recall it differently," the source said. "Andy thinks in good faith he told him, and Comey in good faith says he wasn’t told."

The source added that “the notion that the two guys are pitted against each other is crazy."

That's from a John Sexton post, but the language is actually quoted from CNN, which is of course cozy with all the leakers and conspirators and trying to keep its sources playing nice with each other.

And trying to keep them out of jail.

And trying to keep themselves from having to testify in any prosecutions about who leaked what to whom.

And trying to keep the public from learning their own central role in the campaign of illegal leaks against Trump, acting as the AV Squad All-Stars for the Deep State High School.

Buuuuuuut...

For one thing, the OIG report's language is pretty firm on the point that McCabe did not just lie once, but four times, and wasn't just hazy on details of what his Trained Parrot (probably Special Counsel Lisa Page) was leaking to the WSJ on his orders, but claimed that he had no idea who was talking to the WSJ at all.

As detailed below, we found that in late October 2016, McCabe authorized Special Counsel and AD/OPA to discuss with [reporter Devlin] Barrett issues related to the FBI's Clinton Foundation investigation (CF Investigation)…The disclosure to the WSJ effectively confirmed the existence of the CF Investigation, which then-FBI Director Comey had previously refused to do.

We found that, in a conversation with then-Director Comey shortly after the WSJ article was published, McCabe lacked candor when he told Comey, or made statements that led Comey to believe, that McCabe had not authorized the disclosure and did not know who did. This conduct violated FBI Offense Code 2.5 (Lack of Candor -- No Oath).

We also found that on May 9, 2017, when questioned under oath by FBI agents from INSD, McCabe lacked candor when he told the agents that he had not authorized the disclosure to the WSJ and did not know who did. This conduct violated FBI Offense Code 2.6 (Lack of Candor -- Under Oath).

We further found that on July 28, 2017, when questioned under oath by the OIG in a recorded interview, McCabe lacked candor when he stated: (a) that he was not aware of Special Counsel having been authorized to speak to reporters around October 30 and (b) that, because he was not in Washington, D.C., on October 27 and 28, 2016, he was unable to say where Special Counsel was or what she was doing at that time. This conduct violated FBI Offense Code 2.6 (Lack of Candor -- Under Oath).

Note that one of those incidences of "lack of candor" was about lying to Comey, which could be explained away by claiming Comey is either lying or mistaken. But the next two raps for "lack of candor" involve McCabe claiming he didn't know his Special Counsel was talking with the Wall Street Journal -- and Comey isn't anywhere involved there.

Whether or not McCabe had Comey's approval, as McCabe's lawyer alleges, to make these disclosures to the WSJ does not change the fact that when asked if he knew who was leaking he lied to investigators about it.

Even if he's claiming that he was telling the truth (sort of) that he didn't know who made a specific disclosure, he knew damn well he had authorized his Special Counsel to make some disclosures to the WSJ, and was lying when he claimed he didn't know what she was doing on specific days (when he knew full well she was communicating with the WSJ -- on his orders, or at least at his urging, let's say).

Oh and then there's Page herself who is only still employed by the FBI because she is cooperating with the investigation in exchange for leniency. Just like Strzok. Just like Baker. Just like the Ohr's.

Congress investigates. They do not indict or prosecute. Those roles are the responsibility of the DOJ. If in the case of their investigations Congress turns up criminal activity they can make a referral to the DOJ for follow up like this.

The DOJ also investigates and in some cases, like this case, they have been doing a much more thorough investigation than Congress and have known all of this for quite some time and they know a whole lot more.

Criminal referrals from Congress are really not that common so it's kind of a big deal in that respect and of course because of the targets like Hillary, Comey, McCabe, etc.. Anyone who still claims that big fish aren't being targeted is in denial at this point.

But all of these investigations have been going on by the OIG and a team of federal prosecutors led in this instance by John Huber. They know everything that is contained in this referral and much, much more.

No, that was the unredacted FISA memo which was not turned over and was not completely redacted. It was shown to Nunes and Gowdy at the DOJ by Rosenstein although some detail was still redacted and then the demand was dropped with Nunes actually thanking Rosenstein for his cooperation.

A reminder, it is unwise to share documents being used as part of an investigation to people who leak to the public as part of their daily work. It is illegal to share grand jury information.

163 My personal theory is that Comey is basically Col. Jessup from a Few Good Men.

Comey is trying to distance himself from McCabe by saying he ordered the investigation, but it's like Col Jessup ordering noone to touch Private Santiago before privately ordering the code red. McCabe leaking pushes the blame for slow-walking onto DoJ without forcing Comey to publicly admit that anything was slow-walked. If Comey revealed he approved the leak he'd have to answer why he thought a leak was necessary.

DoJ was basically trying to get FBI involved with their obstruction, but Comey didn't want to be involved in case there was a congressional investigation, which there surely would have been if Clinton won as Comey predicted. But like the Marines in a Few Good Men, McCabe got caught and doesn't want to be made the fall guy.

Good thing the OIG made sure to let everyone know they have no reason to disbelieve Director Jessup. Now if only they could find the source of any of the other leaks.

__In Section B, page 12 the report gives Comey's acct related to the OIG investigators (plural): he refutes mccabes claim that he was informed and signed off on the disclosure. Two separate things.

--Comey's testimony is corroborated by AD/OPA Korton and SpecCounsel Page; he says he didn't know, didn't authorize and McCabe vaguely denied authorizing or doing the leak. This was discussed at length.

--Comey's reasons for non approval of the leak were given as 1. didn't want to confirm the case as 3 mos prior he refused to do so to Congress (!) 2. This came 2 DAYS after the weiner laptop forced email to congress about it, 3. harmed DOJ/FBI relationship

I think this is why it's taken so long, although given the scope of this scandal and historical precedence it hasn't been that long, to bring all of this public.

The short answer is yes, and the number 1 person with the integrity and desire to make this happen is the guy who has taken the most shit, Jeff Sessions.

Anyone who knows anything about his background, his career long fight to enforce the rule of law and order without care for the target and a willingness to take unending shit to do it the right way knows full well that he hasn't been sleeping or trying to cover this up. He has been running a counter investigation quietly and behind the scenes right from the beginning.

What makes it really difficult is he has had to find those people within he DOJ he could trust, weed out the bad ones and build cases against the guilty. Like replacing the engine on a plane while flying it in a blizzard of shit.

It's why he has brought in prosecutors from outside DC, guys Trump appointed, and done everything very quietly while enduring unending shit from all sides. He is doing this right way, the way the DOJ was supposed to work, and not like the corrupt clownshow that Obama, Holder and Lynch turned the DOJ into.

I now am starting to believe that McCabe is going to do some jail time. It'll take a couple of years to get to that point, but that's how the legal system works. That report gives some big hints that he's committed crimes much greater than simple "lack of candor".


Talk like this is like going to a stripper bar looking for a girlfriend.

May look good now, but nothing is going to actually happen outside of one's fantasies.

I simply have zero confidence in the DoJ or the FBI to do what is right, either morally or legally.


It has been 3 days now since the CNN lawyer who had no legal standing shouted out to Kimba the Skank Clinton-owned judge to smear Hannity's name in court.

And CNN still has not mentioned what happened.

It's just a sad fact of life - in complicated cases with lots of documents and potential witnesses, it usually takes more than a year to even get the ball rolling, and then a year or two for trial and then years of appeals. I was involved, tangentially, in a simple business lawsuit once which we thought was cut and dried, and which we eventually won. But it ended up taking 8 years of legal bills from start to the eventual finish. That's how it goes, most of the time.

the maroney girl got $1.25 million from the usoc but then broke here non disclosure agreement anyway. some model offered to pay he $100k violation fee for her and then the usoc waived the penalty.

now she is represented by gloria allred and suing for monre money.
