One category of "aggravated felony" is "a crime of violence." The man the government sought to deport was convicted for burglary, twice. Is burglary a "crime of violence"? There is some argument one could make, if one wanted, that burglary is a "crime of violence." Historically, it was defined as breaking into a home at night, and treated more severely than other breaking and entry crimes, such as robbing a business or warehouse. That's because when you're breaking into a home at night, the odds that there will be law-abiding people present is high, and therefore the chance of violent conflict similarly high. But I don't think most burglary statutes now require the dwelling in question to be a "home," and I don't think the "night" part is required often, either. Either way, while someone could make this argument, is this a case where the law, on its face, apprises the reasonably-informed citizen of what the law is and what the punishments for breaking them shall be, as is generally required of laws? (Or, at least: Which, in an earlier, better day, is what the law was supposed to do, before laws became so numerous and so vague that most citizens simply assume that if they're not doing something the state specifically demands, they're probably breaking some law or some claimed interpretation of some law?) Gorsuch voted in favor of the notion that the law should be reasonably clear and specific enough to alert the reasonably-intelligent average citizen what the law is and what the consequences of breaking it are. The average citizen would probably not calculate that "burglary," especially as currently defined, could be claimed by an imaginative prosecutor to arguably be a "crime of violence," or, more accurately, "a crime of an elevated risk of a possibility of violence." Though that applies to citizens, generally such principles apply to non-citizens too. AllahPundit points out that the decision relies heavily on a previous ruling striking down a similarly-vague criminal statute (this one, regarding deportation, is civil in nature), a decision written by Antonin Scalia. I guess people can argue about this either way, but I don't think anyone should take this as a sign that Gorsuch is secretly one of them. Antonin Scalia would often write surprisingly (surprisingly, for the unschooled) decisions favoring criminals, because he was a stickler about laws saying what they mean and meaning what they say, without lots of room for imagineering by ambitious prosecutors. (He was also pretty adamant on the Constitution similarly meaning what it said, you may have heard.) In a famous ruling, he declared that the system of having alleged child sex abuse victims testify outside the courtroom with the testimony conveyed into the courtroom by closed circuit tv -- this done to spare the victim of having to confront his violator in open court -- to be unconstitutional, because the Constitution does explicitly guarantee the accused to have the right to "confront his accusers." I'm sure Scalia wasn't happy that likely/alleged underage sex victims had to bear the angry stare of their rapists, and probably had sympathy for efforts to insulate them from that, but he couldn't just hand-wave away the Constitution's explicit guarantee here. (Scalia tossed out all this strict interpretation of the Constitution, even when it favored criminals, when it came to drugs and drug searches, however.) At any rate, if Congress wants to make burglary and other dangerous-yet-not-violent-per-se crimes deportable, it has the power to do so; but I can't say that Gorsuch cast an "unconservative" vote by, essentially, demanding that the State be specific about what the law is and not rely upon prosecutors' whims to decide what the law will be as regards this or that defendant. They are here provisionally, at best, and can be forced to leave any time we change our minds. For the courts not to recognize this simple fact - that the US is created for and serves only US citizens - is beyond infuriating. In the 2015 decision cited as precedent for this ruling, written by Scalia, Justices Thomas, Kennedy, and Alito all OPPOSED Scalia's reasoning insofar as it concerned vagueness of a statute. Only Robertson supported Scalia then and opposed the decision today. (and he's the one who's supposed to be so political!) Thomas went so far as to call Scalia's previous majority opinion in Johnson "wrongly decided." Now this is not to say Thomas is wrong, he may be correct. Saw some of G's confirmation hearings. He spoke at length about administrative law. Said that the axiom that ignorance of the law is no excuse may well be outdated given the blindingly high number of laws, many agency ukases nobody ever heard of nor expects to be the law of the land (waters of the united states sort of thing) and technicalities of moving your own money that could give a prosecutor something to do if your kid got the lead in the school play and his didn't. He said, in effect, he wasn't going to insist on strict enforcement of any law that wasn't clear or was deficient on what he referred to as "public notice".

The drug law that really torques my pique is the use of drug dogs for auto searches. The SC has ruled that they are a perfectly valid tool, without any training or accuracy requirements. The dog can alert 100 times in a row, and be wrong 99 of those times, and it's all copacetic per the SC. They're not even required to keep records of how often the dog false alerts. One other thing: this is not some huge legal precedent that is going to change the way that law is applied from now on. (like Roe v. Wade, etc) To fix this, all Congress has to do is change about 10 words in an existing statute. Personally, I would make deportation mandatory upon conviction of any felony, and drop the language about "violence" completely.

I agree that we would be better off if no judges were activist, but the left won't play by that rule, so "no activist judges" is not a realistic expectation. At any rate, if Congress wants to make burglary and other dangerous-yet-not-violent-per-se crimes deportable, it has the power to do so; but I can't say that Gorsuch cast an "unconservative" vote by, essentially, demanding that the State be specific about what the law is and not rely upon prosecutors' whims to decide what the law will be as regards this or that defendant.
Congress has to deal with STATE laws, which are different in every state. There has to be, obviously, a good deal of leeway to be able to include all the states' different crimes and definitions to be considered. ANy problems with the various interpretations of different states and their various crimes is handled by the federal courts. That's, after all, their friggin job. There was nothing overly vague about this law, especially considering that it was a law for deportation of NON-CITIZENS, who have no natural right to be here, anyway. Antonin Scalia would often write surprisingly (surprisingly, for the unschooled) decisions favoring criminals, because he was a stickler about laws saying what they mean and meaning what they say, without lots of room for imagineering by ambitious prosecutors. (He was also pretty adamant on the Constitution similarly meaning what it said, you may have heard.)

Wade, etc) To fix this, all Congress has to do is change about 10 words in an existing statute. In the case before the court, a man was arrested for burglary. Burglary is generally defined as the illegal breaking into the dwelling place of another with the intention to commit a felony once inside. Usually, a burglary involves breaking into a dwelling with the intention to steal or commit an assault. As burglary is defined, that is not always the case. Any felony committed after a break in is considered burglary. In this case, the lower court reasoned that breaking into a dwelling had such a high likelihood of confrontation with the owner or resident that it was inherently a violent act. The immigration law stated that any violent act created a reason to deport a non citizen. So the case boiled down this: is burglary an inherently violent act? Gorsuch reasoned that it wasn't and that the statute was too vague. In essence, a non citizen could break into a building with the intention of filing a fraudulent IRS tax return (a felony) and the statute could be interpreted to mean he committed a burglary and thus he was violent and thus subject to deportation. I know someone whose house was burgled while she was away. After she returned and discovered that all of her valuables were gone, her bedroom ransacked, etc., she said that she felt "raped" and was shaking with fear and rage. That was five years ago -- and she STILL hasn't gotten over it. It literally changed her personality, the incident was such a major trauma. Both Gorsuch and Thomas had reasonable arguments. And I don't buy the idea that, at this level, the "let's be like them" applies. If we don't stick to traditional LEGAL thinking, if judges rule always for the desired outcomes, then we've lost the whole thing anyways. Sure, their judges do that. In any case, let's say the law is tightened up and passed. A Hawaiian judge would *still* rule that it doesn't apply, even if the defendant clearly violated it. So by voting in favor Gorsuch would not have lost anything. The reason I argue strenuously in favor of fighting to get a Congress that will take back it's power, rather than on finding judicial workarounds to manufacture a "win", is that I know from looking at the past that systems, once given up, are never regained. Once we finally and completely give up on our Congress (and the left never believed in it anyways, they have always wanted a totalitarian executive) then we will have accepted our long descent into a neo-Imperial system of government. My bookstore was broken into and robbed one Saturday night several years ago. Talking to the police, I got the impression that "burglary" happened when no one is inside the place being burgled. "Robbery" was a crime that occurred when a person or persons was in the building. "Robbery" is a crime against a person, not a place.
I think Gorsuch is correct: the law as written is too vague. The lawyers writing these laws should define their terms more specifically. Ya know, just for a balanced view. My issue is with all those Judges who went with the majority decision, not just Gorush. I don't want a politicized court, although we have one to some extent. One mistake common to our side is to think that man's laws are like physical laws.
Physical laws can't be appealed or argued - they are what they are. Man's laws on the other hand mean what ever you can convince judges they mean. Because of the Yin and Yang nature of reality there is an element of being able to argue about physical laws - does this law apply to this case - etc. And there is an element of man's laws meaning what they say - convince enough Supreme Court justices that they do and voila. Listen to the oral arguments in the Heller case - one of the liberal idiot judges asks: "So you'd allow reasonable infringement of this right?" Word. I was thinking that just the other day. We think government is a machine. We write down laws and there they are, ink on paper, as solid as metal components under the hood of a car. So laws should run like a car. But laws are more like adding wheels to the vehicle, and then filling them with hamsters in the expectation that these will run inside these wheels and get us where we need to go. But the hamsters (politicians, judges) run away. And so we foolishly add more wheels and more hamsters, and we do this because we are stupidly thinking that this is a machine rather than a system where the motor power is corrupt and can just ignore the design. Over not a whole long time, I think that it'll begin to dawn on people that just because a judge is nominated by a Republican president, doesn't mean he or she is at all predictably going to vote gong to vote the same way as other judges on the same court who also were nominated by a Republican president.
Gorsuch is definitely not the same person or judge as Thomas. Thomas, too, has in the past actually voted with D-appointed SCOTUS judges and against R-appointed SCOTUS judges. Not very much, and some of those were on fairly narrow points, but still... Thomas and Alito are the two judges on the current court who have a history of SCOTUS votering the same, but it's not absolute, and you can actually detect principled differences from just the few cases where they've voted differently. The myth of the so-called conservative phalanx on SCOTUS is brought into a great deal more doubt by the voting pattern differences comparing Alito and Thomas to either or both Kennedy and CJ Roberts. Kennedy has a pretty unique view of "liberty" that shows up most graphically in same sex cases, and Roberts has an institution-favoring bias quite a bit beyond any or Alito, Thomas, Kennedy or all 3 combined. There's not even a sound basis for expecting Gorsuch to vote like his self-avowed hero and model, Scalia. Even before Scalia died, there'd already been a number of compelling studies showing that Scalia's dedication to the originalism was actually somewhere between inconsistent to muddy. And if there's one thing Scalia was MOST consistent on, it was being scathing about modern language usage in deriving originalist thinking. Whereas, it's actually already been shown that Gorsuch's opinions in the low courts are most scathing about, and opposed to, OVERBROAD pre-modern language use. Those two things are not the same, suggesting pretty strongly that, inevitably, had Scalia and Gorsuch served on SCOTUS together, they'd have voted differently on at least some cases. As Ace observes, this looks like a case where Gorsuch's approach looks the more sensible, IOW the less doctrinaire. It's also a case with a set of facts that Scalia's long record suggests he would have gone after quite differently from Gorsuch. But all that's too granular. The LARGER picture is that there have been lots and lots of SCOTUS appointments who, within a matter of a few years of starting, turned out to have quite different views from the top than the ones implied by when they were opining bound from above. Gorsuch may actually end up being one of those. He's certainly ALREADY considered "unique" compared to every single other current SCOTUS judge. Posted by: Donald J. If the considered law is vague, the government has an advantage. Classic example is the Mueller investigation, no clear underlying crime and thus a fishing expedition to manufacture the usual tax evasion or perjury trap beefs. Gorsuch is defending clarity in the law.
