reposting something I put in the morning thread about Gorsuch's decision, because I think it's important to understand what he is driving at:
235 The ThinkProgress article on Gorsuch had to have been written by someone with strong ties to the legal community, because they actually "got" what he was doing with that opinion. You have to remember that Supreme Court level opinions are about principles, and the actual case being decided is at best, trivial. Gorsuch's reasoning had nothing to do with immigration at all, that was just the vehicle used to put his ideas into a majority opinion, which can be cited as precedent in the future. One of Gorsuch's career long judicial goals is to limit, and maybe eventually overturn, the case known as Chevron vs NRDC (1984), commonly referred to as Chevron. This is one of the most often-cited cases in the Supreme Court when regulatory power is in question. Chevron held, basically, that when Congress rights a statute that is open to interpretation (ie, is vague) then the appropriate Federal Agency has been delegated the power to interpret that Statute as they see fit, and that their interpretation will be binding in the Courts, just as binding as if Congress had actually written the law that way. The "Chevron" case allowed the Federal Bureaucracy to make a huge power grab over the last 30 years - you could say with justification that the Bureaucracy has gained more power in the last 30 years than it had gained in the previous 200, all thanks to "Chevron." I think you can start to see where Gorsuch was going by saying that a law that was "too vague" needs to be struck down, and not just allow the bureaucrats to interpret it as they see fit. And to add: The biggest blind spot of the 4 traditional "conservatives" on the SCOTUS is that they're just fine with the Feds running everything, as long as it's run the way they like. Now as for Justice Gorsuch--it is an eminently conservative position to refuse to enforce vague laws. Yes he sided with the progressive side of the Court on the result--but his reasoning was impeccable. You can't put lipstick on a pig--and he will not enforce vague laws. There's a reason--all you have to do is look at the unchecked rampage of Mueller & Co wandiering all over the landscape and about three zillion miles away from their initial remit, which was to investiage Russian collusion with the Trump campaign. Having been able to find any such, they are wandering around like a rogue torpedo seeking to destroy anything they touch. When he were in Copenhagen several years ago attending a convention, we visited Sweden twice. Once, took the train to Malmo because.....well, it didn't yet have the dangerous reputation it does now.
It was an interesting afternoon. The local high schools (gymnasiums they call them) had just had their graduations, and a large number of parents were parading through town driving classic American convertibles with their kids riding and drinking beer. Later that week, we took the train to the pretty village where our Swedish student and his family lived. I have a friend here who emigrated from Denmark, and they remember that until the Napoleonic Wars ended it, Denmark and Norway were part of the same kingdom for centuries. Up until that point, they spoke the same language.

As far as I can tell.. The whole Scandinavian peninsula was originally populated from Denmark northward.. Sweden wasn't even Sweden until around 1700. The Danes were the original Norse peoples.
The Swedes (svear) are mentioned in Beowulf and were a major power in the 17th century. Finland was a province of Sweden for centuries, and Norway was basically under Swedish control for quite awhile as well. Historically Sweden and Denmark have been the two big boys in the Baltic. All the Scandinavian countries, except Finland, speak a variant of Old Norse, a Northern Germanic Language. Germans speak High German, an offshoot of the West German language family, which also includes English and Dutch. The East German language family (Gothic, Lombardian, etc.) has died out. DePauw administrators said in a tweet Tuesday night that police and campus safety officials are investigating racist messages written in campus restrooms and in the DePauw Nature Park, where someone formed the "n-word" in rocks in the park. Officers were also investigating "offensive behavior" exhibited by a student.

They got some wicked metal bands though. You're right though, the language sounds pretty strange. There was one band I was hanging with, and their english was pretty good, but as soon as they switched to their native language it sounded like a machine language of single syllable pops and hiccups. lol

That depends on whether the other conservative Justices get on board with the opening Gorsuch has just given them. Laypeople don't realize how critical it is for Supreme Court opinions to be based on prior Majority Opinions in decided cases. Now, thanks to the 4 liberal Justices wanting to make a pro-immigration case, Gorsuch has established a strong double precedent (this one and the Scalia decision he cited in his opinion) that argue strongly that Congress needs to expressly define the scope and terms in its legislation. In the future, the 4 "conservative" Justices now *Could* join with Gorsuch and use his established precedent to start peeling back the regulatory state. But that's going to depend on Roberts and whoever replaces Kennedy when he retires, and there's nothing that can be done about that. Gorsuch, on his own, has at least given them the opportunity. And to add: The biggest blind spot of the 4 traditional "conservatives" on the SCOTUS is that they're just fine with the Feds running everything, as long as it's run the way they like. On the Danish/Swedish thing: There's a series on Netflix called "Norsemen", made in Norway. The premise is a Viking village gets taken over by a clique with modern, PC sensitivities. They decide to turn their village into an arts showcase, by turning their swords into an "installation" -- and once they're a famous center fpr the arts, who would dare attack them, right?

I am really sick and tired of the claim that education is underfunded. Arizona teachers are talking about striking over the 'low pay' and woeful state of education funding. Arizona spends $7.205 billion a year on K-12. Most of that goes to pay and benefits for the teachers. What do we get for that money? Kids who don't want to work (we have massive turnover where I work. Military retirees end up being our backbone of the work force because the kids stop showing up after a few weeks). Do they have any knowledge or thinking skills in their skulls full of mush? No. They do stupid shit out in the field and can't follow directions. Something has to change. The fun part of this is that teachers aren't allowed to strike here in AZ. Not showing up to work is considered a resignation without submitting it to the school board as required. Loss of teaching certs is supposed to be automatic. But will that happen? No. School boards are signing authorizations for walk outs in contravention of law. Fcvk that noise! Argh!! There's really no way for conservatives on the Court to be for smaller government. They'd have to overrules many decades of precedent at this point, which is not going to happen. A political revolution isn't going to led by the Court. The smaller government argument is one that has to be won politically, not legally. And the problem with that is that there's almost no constituency for smaller government. Most folks who talk about smaller government mean something like: cut those programs I don't like, but keep the ones I do (all while being blissfully ignorant as to what programs account what proportion of the budget). I have sympathy for teachers at one level, they do have a valid complaint in some areas (like having to buy classroom supplies from their own money). But my sympathy ends when they go on strike, because its clear they don't give a damn about their students in that case. However valid their complaints may be, though, they're aiming at the wrong people. Instead of demanding more money, they need to demand smarter spending of the oceans of money thrown at them already. My high school had a principal and a vice principal. They handled 1200 students and did fine. The most recently built high school in town has half a dozen principals, and more vice principals, and a huge bloat overall at the top with scores of administrators, counselors, special consultants and crap. All those people are paid pretty damn well and have offices, supplies, staffers, etc. And that's where the money that should be spent on chalk and construction paper is going, teachers. What, you say, isn't legislation written by , um, legislators? . No, it's not. It's proposed by outside groups including trade organizations, non profits, corporations, and other interested groups. The proposed legislation is then taken by said groups lobbyists to different friendly" legislators who then agree to sponsor a bill. Legislation idea and basic framework is then given to professional legislative writers who work with legal professionals to create the actual bill that will be sponsored by said legislator. Depending on the bill, it can take anywhere from six months to a year to get the actual bill written. Every single word of a bill is important, because not just the intention of the legislation is important, but having it stand up to legal scrutiny is important. And then there is that pesky fact that you know there will be a bunch of outside groups and their pet legislators who will be opposed to such legislation or will want something put in or taken out in order to gain their vote. The lobbyists will work to ascertain just what that demand will be and will advise whether to include it, or include something so onerous that the oppositions will faint and then one can offer to remove or reduce offensive item (which can be something like substituting may instead of shall) in order to get legislation passed. Then of course, it goes to the hopper, then goes to committee, where supporters and opponents all try to threaten committee members to see their point of view on legislation. Then, if it gets out of committee, it goes on the calendar for House or Senate discussion and debate. Where the real horse trading starts. If it manages to pass, the opponents to such bills will immediately take said bill and file a lawsuit to have bill overturned, or at least have a regulatory agency interpret to more their liking. This is how legislators try to appease everyone and keep their precious donors and legislative seat. Write a vanilla bill and let the regulatory agencies determine what the bill really means. There's really no way for conservatives on the Court to be for smaller government. They'd have to overrules many decades of precedent at this point, which is not going to happen. A political revolution isn't going to led by the Court. The smaller government argument is one that has to be won politically, not legally. And the problem with that is that there's almost no constituency for smaller government. Most folks who talk about smaller government mean something like: cut those programs I don't like, but keep the ones I do (all while being blissfully ignorant as to what programs account what proportion of the budget). 353 Christopher. No, not a drama queen. A child who is deeply hurting. One that feels that they have zero control of what happens with their life. Also, keep in mind that their are mental issues that these children are born with and not recognized until it is too late. The normal discipline you use with most children doesn't work for them. It makes the condition worse.

It is really becoming increasingly harder (as a conservative) to put any faith or trust in any of our institutions. It used to be, to combat the left, we could elect conservatives and they would fight for us. Then we got politicians like Thom Tillis, Lindsey Graham, John McCain et al. So then we would look to the courts to help curb the craziness. And then we got Anthony Kennedy, John Roberts, and now Gorsuch. No where else to go, now.
