LOL: McCabe's Lawyer Says That It's Not Fair That OIG Investigators Ambushed Him With Questions He Wasn't Expecting

You mean like the FBI did to Michael Flynn?

As Sean Davis says:

There is some extreme irony in a top FBI agent complaining about law enforcement officials ambushing him with questions he didn't feel like answering. Bless your heart, Andy McCabe.


Here's Andy's lawyer's response (in part):


Claim: Mr. McCabe lacked candor when he was interviewed by the OIG in July 28, 2017.


Fact: This is false. In a break from procedure, OIG investigators requested that Mr. McCabe, then the FBI's Acting Director, appear immediately to address matters related to the OIG’s review of the Clinton email investigation. Mr. McCabe knew he was a subject of aspects of that inquiry, and although his then-counsel was unavailable, he responded in an effort to comply with the OIG's request.

The OIG investigators assured him they would not ask questions about matters that could involve him.

Yeah, the FBI told Flynn they were just droppin' by for a friendly chat, too.

Despite that assurance, after sharing with him for the first time the volume and nature of thousands of highly sensitive and inflammatory text messages between two FBI employees they specifically asked him questions about the WSJ article, much to his confusion and contrary to his understanding of the ground rules of the discussion.

He was confuzinated by the fact that they had proof he was lying. Many people become confuzinated when they find out another party has proof of their lies.

He attempted multiple times to end the discussion as quickly as possible...

Yes, liars often do attempt to end the discussion as quickly as possible after being smoked out about their lies. Often they will attempt to end the discussion with yet another repetition of their original lie ("Well all I know is that I didn't sleep with that woman, and I'm done talking about it").

... with statements intended to delay discussion until counsel was present.

Spoiler alert: These statements may have contained lies.

Pro-tip: You don't get to lie to an investigator in order to stall for your lawyer so he can tell you the best lies to tell.

Following the meeting, Mr. McCabe's main focus was on the urgent management and personnel decisions he had to take to deal with the text messages he was shown, and what he was told about those text messages by the OIG.

Let this man get back to the job the American people elected him to do.

After those matters had been addressed, Mr. McCabe thought further about his discussion with the OIG investigators and realized that he needed to correct the record. As a result, two business days after the meeting, he contacted the OIG and corrected his prior statements.

I wonder if the incoming National Security Adviser also had a full plate and became confuzinated by questions he wasn't expecting.

By the way, McCabe's big defense is that these weren't leaks because Comey authorized them.

Comey says they didn't.

But, in fairness: Why should we believe that liar?

There is a reason to suspect McCabe is the one lying about this, though: The leaks in question served to advance McCabe's interests, not Comey's.


Now, would Comey leak to advance his own interests? Would he?!

We know he did. He slipped four memos to a pal, at least one of which must have been confidential (seven memos were prepared; four marked confidential; Comey gave four memos to his friend -- at least one was confidential) in order to leak those to the media.

But does Comey the Redeemer leak to advance other people's interests?

I don't think so. I think that's when Comey the Lawbringer starts talking about sacred duty and higher principles.

To cover his own ass, sure he'll leak. He'll leak like an overhydrated Clydesdale.

But covering someone else's ass? No-- then he's the Martinet Dowager, Mrs. By-the-Book.

Sean Davis also notes the report says that Comey did in fact throw McCabe under the bus, despite McCabe's lawyer apparently believing Comey's account didn't contradict McCabe's:

Why are these guys saying "yeah, but it was an authorized leak" like that means anything. It just means that you AND your boss broke the law, rather than just you on your own. It doesn't help your case one iota. If your boss asks you to leak sensitive information to the press your first response should be "fuck no - do it yourself and leave me out of it."

Then write up a memo to the file to that effect.
