Orange Revolution: Orange County Votes to Ignore State's Law and Instead Cooperate With Federal Government on Illegal Aliens

The Orange County sheriff is forbidden by law from telling federal agents when illegal aliens sought by ICE for deportation are being released.

So, she (yes, she) just made these release dates public and put them on a website, where anyone can see it.

As of Monday, March 26, an existing "Who's in Jail" online database includes the date and time of inmates’ release – a move agency officials say will enhance communication with its law enforcement partners.

The release date information applies to all inmates, not just those who are suspected of being in the country illegally. But the goal is to assist agents with the U.S. Immigration and Customs Enforcement, or ICE.

"This is in response to SB-54 limiting our ability to communicate with federal authorities and our concern that criminals are being released to the street when there’s another avenue to safeguard the community by handing them over (to ICE for potential deportation)," Orange County Undersheriff Don Barnes said.

California's AG says he might throw the sheriff and other noncomplying officials in jail, which raises the question: Okay, so why can't the federal government throw your illegal-alien-lovin' asses in jail?

Meanwhile, California Attorney General Xavier Becerra would not rule out taking action of his own against officials who fight the laws, including the sheriff.

"State law is state law. It’s my job to enforce state law and I will do so. We want to make sure that every jurisdiction, including Orange County, understands what state law requires of the people and the subdivisions of the state of California," Becerra said at a news conference. When asked if that meant an arrest or lawsuit against the sheriff, Becerra responded, "I think I just answered that."

See that video at the FoxNews link. Orange County is also joining the federal lawsuit against California, and may launch its own lawsuit.

Which of course doesn't work, but for people who are certain they are on the right side of every thing, they can't believe it won't.

41 California's sanctuary state policy defrauds all the other states of representation and funding by artificially padding its population with people who have no legal right to representation. This diminishes the representation of all other states and citizens in the electoral and governing process.

That should be standing enough for the 49 states to sue the living shit out of California.

Posted by: Vashta Nerada at March 28, 2018 01:30 PM (7ZVPa)

I have long thought that California, being a bellwether for the rest of the country, has pioneered how to get around those icky elections where sometimes they lose. They have codified Joe Stalin's dictum about "he who counts the votes..."

For example, I would love to see someone (if we had nay actual journalists left) do a forensic analysis of where and how absentee votes are counted? Are they counted by government employees? I certainly know they're not counted by people like me. And if it's government employees doing the counting, and they're overwhelmingly Democrats and the SoS's - they're bosses in this process - are Democrat then I seriously question the integrity of the vote. Even a non -ideological Democrat vote counter has to know that Republican votes - being for smaller government generally - has to be a threat to their job. How easy to just "misplace" some votes. (Probably as easy as "finding" uncounted ballots during election disputes, which is another Democrat speciality).

I'm all the more suspicious because of the heavy push towards absentee voting. Sounds ripe for fraud to me.

Combine this with fanatical resistance to showing an ID during voting; providing driver's licenses to illegals - with driver's licenses being a de facto internal "passport" in this country and all the other myriad ways to commit fraud and I'm actually surprised any non-Democrat gets elected.

And I'm sure that is the goal nationwide.

God how I hate these people.

In Colorado, when they went to mail-in ballot for all, there were news stories about one house having 60+ ballots delivered to it. Also a Lefty political organization was telling their volunteers to get the word out: scoop up every mis-delivered ballot you can find, fill it out, and then mail it in. Given that annually ~20% of the CO population moves, that's potentially 20% of the state's ballots being mailed to the wrong address/available for shenanigans.

Buddy of mine had this happen to him. He was 16, and, as he freely admitted, and laughed about, deserved it.

258 Trump's tweets on this are amusing and useful, but I think the OC sheriff has opened a breach here and it would be extremely wise for the administration to push some armor through it. Aggressively.

Unless they've gamed it out and it has problems, along with Don Q. I have long wondered why the feds don't use the harboring illegals laws to actually criminally charge select CA officials.

As I've long whined (correctly), the administration's approach to this whole thing has been limp, and pathetic. Trying to withhold LE grants was a stupid way of shouting "we're not serious!" (even leaving aside that they may have effed up their homework, and such actions are not legal).

Binding appropriations conditionality has always been the obvious thing to do. But as we've seen, someone at the WH seemed to forget that appropriations are the most important tool of the fed govt (yesterday saw a clip of KellyAnne talking about the CR debacle, and she basically implied the WH had been blindsided, which translated means the WH was completely incompetent - anyone with the slightest clue can't be "blindsided" by appropriations - and the "never again" vow just confirms that this was an epic eff-up).

IG, it's a bit more complicated than the OC sheriff being obligated to "uphold" federal law. The sheriff is not obliged to enforce federal law; the feds cannot compel the sheriff to enforce most federal laws in normal times (that's considered "commandeering" and is a no-no under current precedent).

In the 30 seconds I happened to watch CNN this week (in an I-95 rest stop) CNN had a feature titled "His Silence Is Deafening" that consisted of edited clips of a CNN reporter asking the President about Stormy Daniels and the President not answering the question.

Courage.

Posted by: Muad'dib at March 28, 2018 01:27 PM (sjdRT)

I am unsure how that could even happen. What would Becerra do...send
the CHP to the Sherrif's office? It's filled with deputies, and they
would be vastly outnumbered. The only option would be to get a warrant
for her arrest and then get a judge to enforce it...but how?

It would be a huge mess.

I can't wait!

342 Interesting. Exactly who will enforce Basura's order, if they go against the Sheriff. They can go to State Court, but if the Sheriff defies them, what part of Law Enforcement would enforce it.
CA has no State Police, it was dissolved in 1995 and merged into the Highway Patrol.
So would the CHP threaten to arrest the Sheriff of Orange County, that would be too funny.
Maybe Basura can invite the Mexican Marinas to help.

Oh, yeah.

In Colorado, when they went to mail-in ballot for all, there were
news stories about one house having 60+ ballots delivered to it. Also a
Lefty political organization was telling their volunteers to get the
word out: scoop up every mis-delivered ballot you can find, fill it out,
and then mail it in. Given that annually ~20% of the CO population
moves, that's potentially 20% of the state's ballots being mailed to the
wrong address/available for shenanigans.

Secret ballot? Hahaha!

You bring your ballot, and together, they fill them out in unison. And they provide coffee, cocoa, and cookies if you get to a good one.

413 I blame Michel Foucault, which is easy because he was French and a God-cursed post-modernist. With respect to criminals, the insane, the homeless, etc., he saw them as a revolutionary class of the excluded.

I'm reading Max Hastings' book "All Hell Let Loose" on WWII, having just finished his corresponding book on WWI.

Both are replete with French generals bursting into tears, and/or kissing those coming to their aid.

I think I just figured out why they keep losing.

Imagine a British or American general doing that. He'd be cashiered on the spot as mentally unstable.

438 Why the bill of rights can't be legally repealed.

In my study of the civil rights laws I realized something which nobody else has ever said anything about; there is no legal path to repealing any of the bill of rights.

Here is why: Any attempt to repeal any of the bill of rights is a violation of 18 USC 241.

The operative part of the law reads:

"If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution..."

Your attempt to repeal is an attempt to oppress persons who currently enjoy rights secured by the constitution. So federal felony to do that.

OK. we'll just repeal 18 USC 241 then. No, because your attempt to repeal that law is part of a conspiracy to oppress rights - so federal felony to do that also.

This is what is referred to in chess as a Checkmate.

You realize that's just the ratchet of government. For example, it could be argued that you can't "conspire" to suppress people's right to vote for their Senator. And thus the 17th amendment is cemented into the Constitution forever.

When we turned the social status of marriage into a "right", we saw what cannot be done to manufacture rights.
