Jonathan Turley: If Michael Flynn Was Charged For Perjury, Why Is Andrew McCabe Not Being Charged?

He says McCabe's Clinton-like, Comey-approved defense -- he didn't have the intent to lie because he was "confused and distracted" -- applies equally to Flynn, who was also quite a busy man at the time he made his disputed statement.

Are our straight-arrow non-partisan without-fear-or-favor Defenders of Law showing favoritism for their own and antagonism to outsiders?

Spoiler alert: Yes. Yes they are.

I have been writing (here and here and here) on the contrast between the treatment of McCabe and former national security adviser Michael Flynn. McCabe has been erroneously portrayed as "losing his pension" but has not been charged.

Erroneously, as the link will tell you, because while Andrew McCabe lost his early retirement benefits, he did not lose most of his retirement benefits which had alread vested and cannot be undone by a firing.

Flynn was charged and accepted a plea deal under 18 U.S.C. 1001 for making a false statement to investigators. Now McCabe is raising virtually the same defense that did not work for Flynn: that there was a lot going on and he was "confused and distracted."

Given his willingness to hold forth publicly on his actions, McCabe does not appear to expect to be charged even though the Inspector General could refer a criminal allegation to prosecutors.

He lashes about at President Donald Trump and critics to assert "I did not knowingly mislead or lie to investigators." He then added this familiar defense: "At worst, I was not clear in my responses, and because of what was going on around me may well have been confused and distracted -- and for that I take full responsibility."

That is reportedly the same defense raised by Flynn who admitted to meeting with Russian diplomats during the busy transition period but did not disclose or confirm that they spoke about sanctions. He reportedly also did not make such a disclosure to Vice President Pence. There was nothing unlawful in the meeting with the Russians or even unprecedented for an incoming national security adviser to discuss such points of tension between the countries. Flynn did not seek legal assistance before the interview and was reportedly not told that the investigators were there as part of a possible criminal inquiry.

Turley notes that the worst aspect of the making-a-false-charge law isn't that it's overly broad -- it's that its over-broadness permits the FBI to selectively and arbitrarily apply it, or selectively and arbitrarily decide that its FaceBook Friends List is immune.

23 McCabe has a big exposure, as do the others who framed Flynn. All we've gotten so far are scenes from coming attractions. There's a lot more to come.

The framing of Flynn ties several players together. Strzok was the point. His texts show his links to a corrupted federal judge (Contreras) before he was forced to recuse himself. Strzok changed his official FBI report on orders from McCabe.

And Strzok links to the corrupted acting DOJ Sally Yates who ran the frame of Flynn, and who got unmasked transcripts from someone like Susan Rice.

And Mueller brought the case against Flynn, and got a plea by threatening Flynn's son and by failing to turn over exculpatory material. And he hired Strzok to work on his team to be the go between with other players.

This makes for a criminal conspiracy to deprive rights under color of law for malicious prosecution. Ordinarily hard to prove, but Mueller's failing to turn over exculpatory evidence should negate the grand jury finding probable cause.

You just need Strzok or Priestap to testify to tie it up in a bow.

FWIW, Turley is close to Stormy's lawyer.

I remember way back to the evening of the Friday before last when the overwhelming opinion here was that McCabe was not getting fired. I was not of that opinion. Remind how that worked out.

It's not excessive exuberance, it's following the case closely without relying on the media, not even Sara Carter or Jonathan Turley for all information.

There is a grand jury empaneled and there has been a prosecutor working hand in hand with Horowitz for months, probably back to last summer. There are at least a half dozen FBI or DOJ employees cooperating, people like Strzok, Page, Priestap, Ohr and others.

The net result of what is going on is not just the removal of a few senior level DOJ employees. There will be charges. I've been saying this for months and I've seen nothing to change my mind.

47 McCabe has not been charged 'yet' because AG Sessions has an outside prosecutor convening a Grand Jury(s). The IG report has not come out yet because of new info coming in. Sessions has the DOJ back to regular order, no leaks or speaking of ongoing criminal investigations which could cause harm to the government's case against McCabe, and so many others. He already threw Comey under the bus with his "it was authorized," which gave Comey perjury before Congress exposure.

Sara Carter -- who's been breaking a lot as a stringer for Fox -- says she has several sources for this.

There's another source that says that McCabe rewrote Strzok's 302 himself.

were absolutely convinced that mccabe would not be fired by Sessions and
be allowed to go merrily on his way.

I agree, not saying the charges will result in actual convictions, but Senior FBI people will be charged and go to trial or cop plea deals..

Sessions has the DOJ back to regular order, no leaks or speaking of ongoing criminal investigations which could cause harm to the government's case against McCabe, and so many others. You are correct. Perjury is for lying to the court, not just to officers of the court in their off-time. And to Congress in sworn testimony, of course.

I love men. Love men, way prefer them to women. However, I do find real men's lack of squeemishness around certain bodily functions disconcerting. My middle son, for example, likes to weigh before and after "dumping" and has a "where I took a shit" in the US app. My oldest went through a box of kleenex a day.

It's not so much that we LIKE those bodily functions. It's more that we never got over our childlike sense of humor about them. Maybe more women do get over it than men. Here's where my doubts come in. I think these people hold too much power to be stopped. They have been so brazen about ignoring the election and barreling forward with open disregard for the sanctity of the vote.
