Obama Directed FBI to Purge NICS (Gun Background Check Database) of Names of 500,000 Fugitives

Fugitives can't buy guns, at least as long as they're fugitives.

For some reason, the generally anti-gun Obama chose to define "fugitive" in a narrow way, and thus struck the names of 500,000 fugitives -- now no longer defined as fugitives -- from the NICS database.

he Justice Department under Barack Obama directed the FBI to drop more than 500,000 names of fugitives with outstanding arrest warrants from the National Instant Criminal Background Check System, acting FBI deputy director David Bowdich testified Wednesday.

Fugitives from justice are barred from buying a firearm under federal law. But what is a fugitive from justice? That definition has been under debate by the FBI and the ATF.

According to The Washington Post, the FBI considered any person with an outstanding arrest warrant to be a fugitive. On the other hand, the Bureau of Alcohol Tobacco, Firearms and Explosives defined a fugitive as someone who has an outstanding arrest warrant and has crossed state lines.

That disagreement was settled at the end of Obama's second term, when the Justice Department's Office of Legal Counsel sided with the ATF's interpretation.

I don't see this as nefarious, and it's possible the legislative context here supports the more restrictive definition better than the more expansive one.

However, it does seem that someone with an outstanding arrest warrant shouldn't be able to buy a gun until his status is cleared. He might show up for a hearing and merely get a fine, or plead to a misdemeanor, or have charges dismissed. Or, he could be arraigned and tried on criminal charges.

But that does seem like the sort of thing that should keep you from getting a gun at least until you show up in court to contest the warrant.

Add this to the "Promise" program, where Obama bullied schools into agreeing to not call the cops on dangerous students, to keep them free of the arrest record they probably earned (and, consequently -- free to buy guns), and what you have is a NICS background check system that should work very well in theory, but is kept from working properly by Obama's decisions.

Which is then used as an argument as to why we need to Ban All The Guns.

Well, maybe if you weren't sabotaging the system already in place, we'd keep guns out of the hands of more criminals, Guys.

12 I prefer the more restrictive interpretation myself. It lessens the opportunity for government shenanigans. With the fact that virtually everyone is in violation of a federal statute of one form or another, the issuing of warrants could be used as a way of disarming people who disagree with the government.

27 OT but current:

Based on the way the tower on the campus side is leaning toward the road, It looks to me like the support on the canal side failed toward the water, and pulled everything over with it.

I would place early bets on a connection failure. A highly loaded concrete connection can "creep" to failure--that is, it can support the load the moment that it is applied, but if the stresses are high enough the concrete will creep (fairly rapidly for concrete) to the point of fracture and sudden failure.

28 Obama's thinking -- and this is provided as a SWAG, totally without evidence -- might have been:

1. "Fugitive" = criminal
2. "Criminal" = disproportionately black
3. Denying guns to fugitives = no guns for blacks

This is not meant to be racist but rather a possible view into the Obama admin's thinking.

32 On the other hand, you can be made a fugitive by having someone take the parking ticket off of your car.

Consider if you never saw the ticket, would you pay it?
Now 14 days go by, the fine doubles, but you still don't know about it. 28 days go by, the fine doubles again and a warrant for your arrest is issued because you didn't enter a not guilty plea at the court date you didn't know about.
Now you're a fugitive, by the precise definition of the term.

This is one reason kung fu and shit spread quickly to the West at that time, as its practitioners fled.

A ticket is a promise to appear in court instead of being arrested on the spot, that's why cops have you sign it. If you don't sign a parking ticket how can they issue a warrant?

I am in the camp of hey, let's draft an omnibus bill repassing all of the gun laws already on the books and watch the freak out when people discover what the laws are already.

This will also have the added benefit of making there be a central listing of what all those laws are.

I've noticed the idiotic getting a gun should be as difficult as getting an abortion folderol going around again. This proves that the people pushing that position know nothing of abortion regulations and gun regulations.

And the way they get around the clearly un-Constitutional and illegal scheme of photo ticketing is to make them mere fines, not moving violations (which are against drivers and for which the cops have to stop the vehicle and issue THE DRIVER the ticket).

The fact is, if photo tickets were in any way legal cops would have been issuing them from their cars parked on the side of the road for decades, never bothering to stop any cars, get out or do any of that pain-in-the-ass stuff. ALl they had to do was look at the license plate, write down the alleged violation, and ship a ticket off to the owner. Yes, but then we wouldn't have marches and reasons tighten laws to take guns away from law-abiding citizens. We need the criminals to do the crimes, bcz the law abiding citizens won't.

I'm not a conspiracy theorist, and I don't want to believe people would think in such an evil manner, but people can rationalize any means to reach their end purpose, if they have decided their end purpose is righteous.

I do not believe they would do it directly, like a school shooting. But indirectly? Like purging a database so criminals are out there and they happen to use guns and then that gices us a chance to tighten gun laws on everyone?

Even yesterday I would have said no way. Today, I say maybe. When I look at all the crap we are finding out Obama did...he is capable of pretty much anything to get what he wants. And he desperately wanted gun control and his own civilian army.

So now I wonder if he considered a workaround. An indirect way to get there.

Somebody tell me if I've gone too far in my thinking. I don't want to believe it. But I never would have believed an FBI coup or all the other crap. So now I'm considering things I never considered before.

All you have to do is look to NJ as model.

There was a study of gun related crimes being committed by gang bangers and that ilk, that have harsh penalties, being either dropped or ridiculously bargained down and people like the guy caught with a functioning replica handgun in his glove conpartment, which he told the cop about when he was stopped for a traffic infraction getting the book thrown at him, possibly 25 year sentence, necessitating Governor Christie having to pardon him.

Or the story of the PA security guard forgetting she had her PA legal concealed carry firearm when she went over the border into NJ, stopped for some traffic infraction facing the same fate, and having Christie pardon her.

This is the pattern, excuse hard criminals who are likely to repeat and cause mayhem and going hammer tongs after otherwise law abiding citizens.

This is bullshit that must be exposed and fought.

The ATF does tons of shit that has nothing to do with any interstate anything. They never gave a shit about that.

Clearly, this change was Barky just trying to fvck things up as much as he could before leaving office. A highly loaded concrete connection can "creep" to failure--that is, it can support the load the moment that it is applied, but if the stresses are high enough the concrete will creep (fairly rapidly for concrete) to the point of fracture and sudden failure."

NPR is reporting this was to be a cable-support structure (that usually means a system supporting it above). This wasn't installed yet, so the bridge was self-supporting. There probably wasn't enough steel through the cross-section to allow that to happen.

They probably should have had some temporary columns installed until a true cable-system was installed, but they didn't. So if cracked in the middle and failed under it's own weight.

181 Sure, I had a cop explain to me that there was no way to get across town without violating some law: wheels touch the center line, change lanes without traveling x distance, etc. No way. So they use that to nail people they suspect or know are bad actors, give them an excuse to check the car or run the person through the computer and get them on something else.

I remember reading the average is one infraction per mile.

I knew a cop who would follow until they became aware of him. Then, when they're watching the rear view mirror, he'd start to gently sway in the lane. The other person would start to mimic, because people naturally mimic all the time, especially subconsciously. BAM! Pulled over for failure to maintain their lane.

225 a common trope that the left keeps trying to push is that the Republicans want government to fail.

So when things go wrong, it is always something like Pres. Bush telling the governor not to evacuate, or preventing the state national guard from acting.

So when things go wrong, rather than blame the reality that government is just not going to give a shit about the people unless they have to, they blame the Repububs for sabotaging things.

But more and more it seems to me the opposite. part of the alinskyite method of creating a crisis.

In all seriousness ... you've got to have a plan to turn your investments into cash totes quick - and an idea of how to hit the road.

I do. I can get into cash in seventy-two hours, less the house. Surely I can see what's coming three days out - and move accordingly.

Everybody around here "exhaled" too damn hard when Trump won. I'm sticking by the other prediction I made, that plenty called me crazy for ... Trump doesn't serve out his term. The Establishment GOP is going to side with Democrats to impeach his ass.

And then the Feds are going to get bolder. With more assistance from Local Law Enforcement ... which many here supported militarizing. And still do.

293 I believe the intent of this is not to clog the system with local warrants for unpaid traffic tickets, summonses, failures to appear, etc. If it is not extraditable (i.e a warrant that will be enforced outside of the jurisdiction that issued it) then it shouldn't be in the system. Also those types of warrants have no Federal nexus either. So I'm with the ATF interpretation on this one.

316 Jesus had a different kind of take when it came to blame and falling things. A tower fell on a bunch of people in Judea and killed them. His disciples ran up with the news and asked what sins those people were guilty of, to have died like that.

Jesus said "best worry about your own ass" in modern jargon. Repent now or worse is coming.

Test 1:

Case: Stress test 1
Steps:
1. Walk to bridge handrail
2. Put hands on bridge handrail
3. Shake bridge handrail like it's a screaming baby
Expectation: Bridge shows no sign of collapse, makes no odd noises, doesn't shake

Result: Fail

Notes: Bridge fell over

333 It's pretty obvious by now. I don't know how anybody doesn't see it. They WANT these mass shootings to happen. They create such wonderful dramatic political capital for the gun control cause. The left is slavering at the mouth for the next one to happen. As long as it's not perpetrated by one of mohammed's followers, that is. Then they'll bury the story.

Why do you think that sheriff in FL ignored all the warnings and then made his men stand down outside the school? He wanted maximum body count. He did it for the Cause. He sacrificed those kids lives for political points, and served his fellow travelers well.

Jesus said "best worry about your own ass" in modern jargon. Repent now or worse is coming."

That's a very good point and something even a lot of Christians miss. It was obviously important, since Jesus repeated it a number of times, another time when the disciples are arguing about who would be the greatest, or who would live the longest. (the disciples love to get into stupid arguments that sound just like things we'd do)

Jesus always says words to the effect of - "Quit worrying about the fate of other people, that is not your problem! YOU are what you need to be taking care of!!!"

Look, there are people who have warrants because they failed to appear in court for traffic tickets. Not all of them should be in the FBI's crosshairs (especially now, since the agency has basically gone rogue).

Whether it's crossing state lines, or it's the level of offense (felony warrants might be a good place to start), I'm all for the FBI not even having the damned information in the first place.

Everything but NOT that! Well, it seems implied but was left unsaid.
Guns make white men feel powerful and in control.
Uneducated men. Under or unemployed men (whites only)
Guns make women 5 times more likely to be shot by their husbands.
Blah blah blah. Mix. Shake.
Deplorable!
The usual.

396 316 Jesus had a different kind of take when it came to blame and falling things. A tower fell on a bunch of people in Judea and killed them. His disciples ran up with the news and asked what sins those people were guilty of, to have died like that.

Jesus said "best worry about your own ass" in modern jargon. Repent now or worse is coming.

Despite 2000 years of Christianity, people still misunderstand that. First, death isn't necessarily an objective evil to God, especially for those baptized and secondly, "misfortune" isn't about your sin. The jews of the time, however, thought that misfortune and disease were due to the wages of sin of those affected. My mother still thinks God punishes you in this life. I keep trying to explain that you aren't punished for unrelated sin, but reality will punish you for related sin.

399 Biggest downside of all this bad gun-news lately ?

I was really enjoying some cheaper prices. Made a couple acquisitions. Was looking at a couple more.

But no ... oh no. Now everything's going to go up again ... driving up my costs on the Ruger Police Carbine (great for killing dogs) and the Springfield Saint (it's black and has the dreaded Thing That Goes Up).

400 Jesus always says words to the effect of - "Quit worrying about the fate of other people, that is not your problem! YOU are what you need to be taking care of!!!"
Posted by: Tom Servo at March 15, 2018 04:29 PM (k1TUh)

Uh, okay, but I'm not sure what application you guys are going for with this.

We are also told to pray for our country, because our fate is tied to our country's fate.

We are told to grieve with those who grieve.

I must be reading what you guys wrote wrong...bcz it seemed like it was saying the bible says "don't give a shit" about anyone but yourself. Which is totally not "Love thy neighbor as thyself".

I'm not expert, but it was a really confusing few posts. My limited exposure to biblical teaching was about focusing on your own sin and how you led your life before worrying about everyone else's. But not to the exclusion of everyone else. And also, not to make everything a comparison....who is better than whom (with the disciples fighting).

Sorry, just felt the need to put things in some perspective.

The pictures of what it was supposed to be after being finished show a central column with supports (cables?) going to the bridge section that collapsed and another section that hadn't been put up yet.

406 I can't find much fault with the 30 year sentence for gasser, although if I was on the jury I would have pushed for 15, on the basis of some culpability for McKnight.

But here's why his self defense charges didn't stand up - the shooter was actually chasing McKnight, when there was no reason to; they both were acting out and yelling, so this is equivalent to a bar fight where both participants are at fault; and the man he shot was unarmed, and on the passenger side of the vehicle where he couldn't actually reach the shooter.

It's the same case as when somebody kills somebody else in a stupid bar fight. You didn't have to be there, and you didn't have to kill him. You gonna do hard time.

Yep. I don't believe that mail is considered "official service" in any state. If it were they would just mail papers to people and be done with it for everything, instead of having to pay people to physically serve them.

We should have clarified, Gumdrop - those statements by Jesus come up whenever the disciples start wondering about things that are God's decisions and judgments, not theirs. For example, did the men in the tower die because they were guilty of something? Answer, shut up, fools, you shouldn't even be asking that question. Not your judgement to make. Are those people over there gonna go to heaven? Be quiet, and make sure YOU work on your own salvation.

Help the poor, care for the sick, but making judgments about the state of their souls and their fates are decision way above our pay grade.

412 geoff

yeah, it looks like two bridges, one over the road, and the other over the canal, but then they have that cable stay as extra support?

This is odd. maybe the tower is only needed for full pedestrian load.

I was surprised not to see a large truck underneath. Usually when this kind of thing happens it is because it was hit by a tuck.

No wind, no truck,... maybe construction screw up, or maybe bad design.

Also, I wonder how old the concrete is in the trusses.

If you don't pay traffic tickets eventually you'll get an arrest warrant issued for it. If you don't know about it or ignore it, next time you get pulled over in that city you'll get hooked up. Technically, you are a fugitive until you clear that up.

419 This is all part of the left's stupidity regarding criminals. Have fewer people in jail not by locking up the bad guys, but by looking the other way.

Just like Illinois - they have strict gun laws. but when a felon is caught with a gun, they are often ignored, because, well, we don't want too many minorities going to jail now do we?

421 Well, maybe if you weren't sabotaging the system already in place, we'd keep guns out of the hands of more criminals, Guys.

Judging from their lack of interest in prosecuting armed criminals, Democrats have no problems with criminals getting guns, probably because they'll still vote Democrat. It's armed Republicans they're really trying to disarm, especially the law-abiding ones.
