Sefton: sefton at cutjibnewsletter.com | A Modest Proposal: States Objecting to Illegal Immigration Should Pass Laws Demanding That Any Product Produced in "Sanctuary Jurisdiction" Be Specifically Labeled as Such for Interstate SaleThe Constitution generally forbids any kind of interference with interstate trade -- but there are exceptions. The Supreme Court found, for example, that a federal law demanding that goods made by prisoners in one state must be marked as "Prisoner-Made Goods" when shipped for interstate sale. The companies selling such prisoner-made goods objected, stating that such labeling would of course prejudice the public against buying them in the market. But the Supreme Court found that such labeling requirements were a permissible regulation under the intestate commerce clause. The United States Supreme Court held that transportation of prisoner made goods without proper labeling violated the Ashurst Sumners Act (ASA), 49A transportation company refused to deliver goods which did not have the required labeling. So the company selling prisoner-made goods sued to compel the transport company to deliver them, challenging the federal law requiring labeling as contrary to the general constitutional prohibitions of interference with interstate commerce. They lost: Petitioner sued seeking amandatory injunction to compel transportation. The Court held, pursuant to ASA, that all prisoner made goods are to be transported with plain labels showing names and addresses of shipper and consignee, the nature of contents, and the name and location of the penal or reformatory institution where produced. Accordingly, the Court rejected the petitioner's constitutional challenge to the ASA.So my proposal, then: Congress should pass a law similar to the Ashurst Summers act requiring all products (or agricultural produce) made in a jurisdiction which is a "sanctuary jurisidiction," or which does not conform to a minimum level of enforcement of immigration laws, should be labeled (when sold interstate) as "PRODUCED IN A SANCTUARY JURISDICTION PERMITTING ILLEGAL WORK BY FOREIGN UNDOCUMENTED LABORERS." Now, I don't think the federal government would succeed in passing that, so, as a back-up plan, let the states which are interested in actually enforcing immigration laws pass their own state laws requiring such labeling. If these labels wind up prejudicing the public against buying California grapes or even California microchips... ah well. Who can object to better informing the public about how goods are made? Incidentally, California is a state that is the most c*cksuckerish about such labeling requirements itself. Look for any kind of water-bottle on Amazon, and you'll see a special label, required by California law, stating that the product does or does not contain BHP or whatever type of plastic Californians are all up in arms about this week. Similarly, there are special labels, mandated by California law, about certain substances or ingredients in supplements and foods, and about what types of metal ions are present in batteries. That kind of thing. Products routinely are required to carry the Warning Label that "Ingredient X has been linked to cancer by California Health Authorities," a friend points out. If California feels it is empowered to demand that all other states carry the Warning Labels that Californians demand, then it's high time that all California-made goods carry the Warning Label "THIS PRODUCT PRODUCED IN A SANCTUARY JURISDICTION WHICH PERMITS OR ENCOURAGES LABOR BY UNDOCUMENTED ILLEGAL FOREIGN WORKERS." And if people decide they'd rather buy produce and other goods from a non-sanctuary state, well: If California can require labels about BHP, why can't Oklahoma require labels about goods made in jurisidictions that illegally encourage illegal immigrant labor? A Modest Proposal, Expanded: A friend writes (some words changed in case someone can figure out who he is by text analysis/word usage): It could be useful to use that against tech companies that suck up to China. "This search engine is known to help the communist Chinese government repress its people by censoring search results." Comments(Jump to bottom of comments)1

This is a great Idea. Left will try to turn this around and make use it against the minimum wage, I say let them. Let them require labeling on ag products with the wages of the pickers. (when i left CA, i still knew 1st geners who would not buy grapes in solidarity with the grape pickers.) The minimum wage problem is the flip side of the illegal problem. The left and right both want higher wages, but the left wants them through open borders and then mandating that the 30% of migrants who work, get paid more. The right wants closed border and the free market. Posted by: Gentlemen, this is democracy manifest at March 07, 2018 01:40 PM (LWu6U) 51

Interesting proposal.
We'll see how things go after the politicians are done blathering over this topic, which is a subsidiary of the DACA/dreamer thing that the Democrats totally did nothing with when they had the opportunity. Like with Trump's DACA offer which was too good for the Democrats to accept, I will now doom us all by predicting that there will be a lot of hot talk and denunciations by many individuals here as well as the professional politicians, and after a couple of weeks things will quiet back down. And then several months later we will learn either that the sanctuary city stuff has been withdrawn because the federal government clearly has the sole authority on immigration law, or many months later the court decision will come along knocking down this pretense by California politicians. And even then it will get little notice because the midterms will have passed and already rendered judgment on what are really political stances in legislative/legal garb. What you're talking about, Ace, is the infamous Prop. 65, the "California labeling law."
It not only applies to food and products, it applies to EVERYTHING in the state -- places, buildings, objects, you name. That's why when you go into basically ANY restaurant in California, somewhere inside (the restaurants often try to put the mandated signs in inconspicuous locations, but if you look for them, they're there), you'll see a sign that says, "These premises contain a substance Known to the State of California to Cause Cancer," usually because the restaurant uses, like soap or fried meat or spices or some other jive-ass perfectly normal thing which some leftist "study" once "proved" 25 years ago that might increase your chance of getting cancer if you ingested 450,000 gallons of it per day for a year. Every single business in the state absolutely hates Prop. 65, needless to say. Posted by: zombie at March 07, 2018 01:48 PM (42M22) 101

Back in 2000 they hired a couple viticulturists to travel the state for a couple years, trying to help growers start up the grape business, and winery business. Many started, but the wine grape glut around that time (Two Buck Chuck ... a cheap wine of the time, maybe $3 now) ... and an open market to Chile and other countries put a kibosh on much of that effort. The problem with the BPA hysteria is that it is being used as a lever to slander and ban ALL plastic -- even though only a small percentage of plastics contain it. I see this "incremental reputation contamination" all the time. Some big organization will announce, "BPAs in plastic are known to cause health problems. Therefore, let's BAN ALL PLASTIC!" -- even though most plastic contain no BPA whatsoever.
Also, it's still not clear how or via what mechanism or even if the BPA detected in the environment was leached out of plastic bottles. The leaching-from-the-bottle-into-your-food-or-water theory still hasn't been proven. We known that BPA can be detected in the environment and in a large percentage of human test subjects, but we still don't really know where it's coming from. It could be from a different source than BPA-containing water bottles. Posted by: zombie at March 07, 2018 01:55 PM (42M22) 142

It's not just the chinese though. They do that here and in Europe. They are driving things back to the stone age where the only reliable communication will be face to face. As C. S. Lewis observed in Abolition of Man, technological advances do not represent an increase in power of man over nature. They represent an increase in power of some men over other men. I thought that was a bit of a misrepresentation when I first read it, but no. He was right. Posted by: Steve and Cold Bear at March 07, 2018 02:01 PM (/qEW2) 192

I think the United States shouldn't send California any paper work.
That everything they want from the Federal government has to retrieved in person from a government office. So the federal government isn't paying money to do "California's job". ============ Hopefully because the eternal flames of hell await them. ======== People, sometimes come to their senses and repent. With abortion their are many examples. One of the most famous was Dr. Bernie Nathanson. He was a huge abortion practitioner for many years. Then saw the light and became a dedicated foe of the abortion industry. One of the right to lifers asked him how he could live with himself since he had literally been personally responsible for killing an entire small city population. Since the precedent has been set with the ACA - where SCOTUS ruled that the clear text of the law doesn't matter and regulations just have synergy with the title of the law - I say that Trump just orders his admin to issue regulations to require it. After all, obviously the writers of the "Fair Packaging and Labeling Act" would agree that it's only "fair" that sanctuary states label their products as such. These all look like completely achievable and reasoned responses to the lawlessness of states like CA . . .and will also be helpful in winning the midterms by highlighting the despicable, dangerous, anti-American actions of the leftist, socialist Democrat menace . . . . which is why the GOPe will never allow this to happen.
Wake me when law breakers on the left are swinging from lampposts and you have my attention Until then - Ace? This is simply, a good idea that will never see fruition.
