Trump: I Don't Want to Wait For Any Fancy-Pants Due Process Hearings Before Taking Guns Away from the Mentally Ill
Or Did He Say That?

Note to Trump: Courts are pretty fast about processing temporary restraining orders and if there's genuine evidence that someone is mentally ill or a threat to himself or others, that evidence will be readily presentable to the court.

There is, therefore, no need to take someone's guns away -- to take someone's constitutional rights as a citizen away -- without even a court hearing (which tends to be biased in favor of granting restraining orders in the first place).

If there's no readily-presentable evidence that someone is making threats or mentally insane, maybe that's precisely the situation in which you'd want to be slow and deliberate about branding someone a sub-citizen.

The most embarrassing part is that he said this nonsense to Pence, who tried to steer him back into a defensible place, but Trump kind of just ignored his Vice President and went back to his grab-the-guns talking point anyway.

Alternative Take! Someone I trust saw this exchange in a different way. She sees Trump's reference to "due process in the courts" as a reference to a full hearing (up to an including a criminal trial), and that what Trump was trying to say -- inelegantly and maladroitly -- is that we need Gun Violence Restraining Orders as a speedier stop-gap.

Taken this way, Trump was agreeing with the idea of GVRO, and his reference to not needing "due process" was intended to mean that sometimes we need intervention before a full criminal trial. But at a speedier restraining order hearing which would involve "due process," but wouldn't be as lengthy and as long-awaited as a criminal trial.

He just put it, well, poorly. But in this interpretation, he wasn't saying we don't need "due process" at a TRO hearing; he meant we needed TROs until the full due process hearing of a criminal trial.

This explanation would explain why Pence did not appear flummoxed by Trump's comment -- he just took Trump's comment as agreeing with his own, if in a somewhat Trumpian locution.

That being said, we do have to have a way to keep guns out of the hands of people whose state of mind is dangerous.

I just wish I trusted the system better. This is kind of where faith and credibility in institutions and the rule of law is important. And we just don't have a lot of that right now.

Trump has spent a week listening to parents, students, LEO's and governors talk about how if they have a family member with a severe mental or behavioral issue , they can't get mental health professionals, schools, or the local police to do anything LEGALLY to either incarcerate the person, or stop them from obtaining weapons. All of these school shooting stories have the same root problem, kids with severe issues who the system keeps passing on for reasons of either apathy or worse, monetary gain such as Trayvon or the Parkland shooter. Because their are rules, programs, and sometimes laws in the way prohibiting them from getting anywhere.

Instead of people here looking at this as a way to positively approach this problem, immediately everyone jumps to some bizarre conclusion that nosy neighbors will call the cops and have your guns confiscated as you are coming home from the range. Even though you have done nothing violent, threatening , or have any history of mental illness.

There is about of mile of distance between a 18 year old who is online threatening to shoot his classmates and has a blog describing how IED's are made, and has had the cops called by his family members 40 times in the past 9 years and Mr. blog commenter with his 12 gauge under the bed that few know about.

I called the rep and submitted withness silps on the bills but a lot of gun owners in the state are asleep or too frickin complacent. We can and have won these in the past but the response has been too little and too late this time.

Trump has had a conceal carry permit, from NYC of all places, for years. He is a life member of the NRA. Don Jr. and Eric are both avid gun collectors besides active hunters.

Trump told us at the NRA convention in 2016 when he was campaigning that he wouldn't hesitate to shoot anyone "coming at him". He then said that the SS had told him he could not carry anymore for obvious reasons, LOL.

Schumer, who couldn't hardly be bothered to stop at Graham's coffin today as he was grinning and almost back slapping Franklin Graham today after which he rushed by the coffin., already is pulling all the gun bills out of the same drawer they pulled Obamacare out of.

The same worn out crap.

The only thing today did was wake up the base that they might want to pay attention to their local elections this summer and fall, and start supporting conservative candidates for this fall. If the Senate or House goes to the Dems, you can look for an avalanche of these types of bills.

I actually bought a bottle of the gel solution for a Guardia Civil M1916 Mauser in 7.62. It has some pits and areas of corrosion on the barrel and I thought I'd try the stuff out (haven't gotten around to it yet, though). I picked it because it supposedly has a phospating effect on rusted areas, meaning it actually imparts some corrosion protection unlike most other cold bluing solutions. I've also heard that you can pretreat rusted areas with phosphoric acid for added protection. As far as finishes go: It's like any other finish - surface prep is all important.

I will be if there's anything actually in writing saying take guns but never due process. Or due process months from now. But what Trump said is more or less how it works now.

Here's the deal (and as always this is very general and depends on jurisdiction): Right now, when a DV TRO (domestic violence temporary restraining order) is issued ex parte (issued by a judge without there being a hearing at which the defendant is present ie ex = without parte = party), when that order is issued the order will contain within it a direction to the police to take all the defendant's guns.

So when the defendant gets served, the cops take the guns.

Then, depending on jurisdiction, anywhere from 5-10 days later, there is a hearing at which the defendant is present to determine if the TRO will stay in place.

So, yeah, due process has already been somewhat trampled upon when the TRO is initially issued. I believe the proposed GVRO follows pretty much those steps.

So this isn't anything new. Whether it's wise is a separate question, but it's not new.

Here's the deal (and as always this is very general and depends on jurisdiction): Right now, when a DV TRO (domestic violence temporary restraining order) is issued ex parte (issued by a judge without there being a hearing at which the defendant is present ie ex = without parte = party), when that order is issued the order will contain within it a direction to the police to take all the defendant's guns.

So when the defendant gets served, the cops take the guns.

Then, depending on jurisdiction, anywhere from 5-10 days later, there is a hearing at which the defendant is present to determine if the TRO will stay in place.

So, yeah, due process has already been somewhat trampled upon when the TRO is initially issued. I believe the proposed GVRO follows pretty much those steps.

So this isn't anything new. Whether it's wise is a separate question, but it's not new.

Trump is cornered right now. We are barely 14 days beyond 17 dead kids and unfortunately much of America wants to "do something" about this. If the Left makes him the face of the anti gun safety movement then every shooting after this one (and there will be more - local school districts and sheriff depts seem to be guaranteeing it) becomes his, and his presidency gets that much harder.

He didn't get where he has gotten now - successfully governing as roughly the most conservative anti-liberal president of our lives by not knowing what he's doing, so for the moment I will continue trusting him to keep fighting for us. You may not have noticed he is practically the only one.

The problem is that there are no consequences for when people file false claims.

You can, in theory (and depending on jurisdiction), file a civil action for abuse of process but there really do need to be charges brought for perjury for when women, and it's nearly 100% women, file false affidavits in support of the TROs.

The problem is that there are no consequences for when people file false claims.

You can, in theory (and depending on jurisdiction), file a civil action for abuse of process but there really do need to be charges brought for perjury for when women, and it's nearly 100% women, file false affidavits in support of the TROs.
