McCain Associate Subpoenaed About "Steele Dossier"

Byron York reporting.

McCain associate David Kramer went to London to pick up the "Steele Dossier" (if Steele really is the author) and get briefed on it. He took it to McCain, who took it to the FBI, which already had most of it, as Steele was giving it to them "in installments."

In his last round of questioning by the House Intelligence Committee, Kramer said he knew who the Soviet, I mean Russian, sources for the dossier's outrageous claims were, but "declined" to say who they were. (Instapundit notes he hears that Kramer took the Fifth on this question.)

Now Kramer's being subpoenaed specifically to answer those questions, and I imagine the Committee will be prepared for him to take the Fifth or otherwise refuse to answer.

Here's why this is important, per Byron York:

[T]here is another reason to know Steele's sources, and that is to learn not just the origin of the dossier but its place in the larger Trump-Russia affair. There is a growing belief among some congressional investigators that the Russians who provided information to Steele were using Steele to disrupt the American election as much as the Russians who distributed hacked Democratic Party emails. In some investigators' views, they are the two sides of the Trump-Russia project, both aimed at sowing chaos and discord in the American political system.

Investigators who favor this theory ask a sensible question: Is it likely that all the Russians involved in the attempt to influence the 2016 election were lying, scheming, Kremlin-linked, Putin-backed enemies of America -- except the Russians who talked to Christopher Steele?

It is a sensible question-- all Russians are scheming liars, except the ones peddling evidence-free claims about Trump?! -- which is why the Democrats and the media and the Never Trumpers (but I repeat myself thricely) never ask it.

That's been my guess, too. I don't know who the dramatis personae were on this end, but I'd bet a lot that the dossier began here and got bounced off various foreigners to hide the trail and make it look authentic.

Also, the foreigners would be cut outs; they can't be sub poenaed, prosecuted, etc. here, so they constitute a firewall for the Dems.

In a just world, there would be outrage and decades of jail time for dozens if not hundreds of people inside and outside of government.

I think this, combined with the NSA disclosures, and the IRS scandal are really, really dangerous and less than optimal events in the arch of the history of the US.

If people can't even pretend that the law applies equally or that we're all 'part' of the government and our voice matters, etc., well then... er, that's not usually a good sign for the longevity of governments.

He's already been deposed in the case of the Russian suing Buzzfeed over publishing the dossier, so that's possible.

I don't remember. Though it strikes me as interesting that each sport/event seems to have their own different uniforms-- I kind of had assumed that a country's uniforms would be more more, um, uniform. But I guess it's really a bunch of separate groups under one banner.

It reminds me of a skirt-type dress from a little bit ago that was (IIRC) white but with some abstract red splotches or something in that same region, and the backlash to that.

Kim Dotcom does have reason to hate Hillary (and Obama). They did raid his house in New Zealand James Bond style to enforce US intellectual property laws because he ran a website that allegedly allowed people to share copyrighted materials (like movies) without paying the IP holders.

ANYWAYS, so yeah -- I guess I can see why he might lie here, but not really. He's a pretty known figure in the internet world, and I've known of him for 10 + years and was a Mega Upload user for a long time.

Eh, the guy's career is based on his Russia expertise, and he was at the State Dept. for 8 years responsible for European and Eurasian Affairs. They didn't want to turn over their server (prime evidence) because of what was on it (evidence of their crimes). So they hired the in-house security firm, Crowdstrike, to lend legitimacy to their claim it was hacked, then ditched the server.

I don't see that the words have to conflict. Especially since they're both phrased as logical complements--and complements have wide coverage.

I think she would be one of those people who would complicate the idea that you're either "stupid" or "bright".

Not a lawyer. But my take is that the 5th is to protect against self-incrimination, not to cover for other people--except where a person refuses to testify against their spouse, typically observed under the 5th amendment.

Unless you're talking about a conspiracy/accessory situation, in which case there would be significant overlap. Now, piping up and saying you know the sources might arguably be a waiver of his 5th Amendment rights as to that information, but that will likely be a difficult argument to win.

Wellll....

The 5th amendment protects you against self incrimination. That has been pretty wildly interpreted -- so if, for example, you only helped hide the body after the guy was dead, you can still invoke the 5th about the details of the murder you didn't know about before hand.

But you cannot use it to refuse to testify about someone elses criminal doings that would not implicate you in a crime. There are some privileges (spousal, lawyer, etc) about third party crimes, but for the most part -- unless youre implicating yourself or your spouse, you can be compelled to testify by a judge.

Conjecture. Supposedly, to invoke the 5th, you cannot say I know who the murderer is, but it is not me, and then invoke the 5th. You've just used it as sword and a shield. It is a shield only.

You have to remain completely silent on an issue, or you can be compelled to give up what you know. No half measures and too clever by half are allowed. I think this was covered back in the hillary email testimony.

I don't know ... but I would bet that someone has been given immunity and still refused to testify and went to jail for contempt at one point or another. Of course, once given immunity the 5th isn't operative, at all, so this technically doesn't really fit ...
