Byron York: Comey Told Congress That FBI Determined that Michael Flynn Did Not Lie In Interviews, But DOJ Senior Officials Had a Particular Desire to Find Him Guilty of Something

You don't say.

According to two sources familiar with the meetings, Comey told lawmakers that the FBI agents who interviewed Flynn did not believe that Flynn had lied to them, or that any inaccuracies in his answers were intentional. As a result, some of those in attendance came away with the impression that Flynn would not be charged with a crime pertaining to the Jan. 24 interview.

Nine months later, with Comey gone and special counsel Robert Mueller in charge of the Trump-Russia investigation, Flynn pleaded guilty to one count of making false statements to the FBI in that Jan. 24 questioning.

[I]t appears the FBI did not think Flynn had done anything wrong in the [calls to Russian FM Kislyak]. On Jan. 23, the Washington Post reported that the FBI had reviewed the Flynn-Kislyak calls and "has not found any evidence of wrongdoing or illicit ties to the Russian government." (The calls had been intercepted by U.S. intelligence because the U.S. monitored the Russian ambassador's communications — something which Flynn, a former chief of the Defense Intelligence Agency, surely knew.)

Still, Flynn's conversation had the attention of the Obama Justice Department, and in particular of deputy attorney general Sally Yates, who reportedly believed Flynn might have violated the Logan Act, a 218 year-old law under which no one had ever been successfully prosecuted. (Two people were charged in the 19th century, but the cases were dropped.)

Byron York notes what immediately occurred to me-- around this time, reporters friendly to Obama began talking up the LOGAN ACT and how it's Totally a Serious Law You Guys.

Just a coincidence, I'm sure.

It was Yates who sent the FBI agents to interview Flynn, on the bizarre theory that he might have violated the LOGAN ACT (which is not enforced because you cannot make it illegal to talk to foreigners, and which only even gets discussed as a law when used against Republicans -- Democrats can chat up foreign potentates and enemy leaders all the doo-dah day) and on the bizarre theory that he might be blackmailable.

On those thin reeds, Yates built her case against Flynn.

Oh, and Yates was at that January 5 meeting. Coincidentally enough.

Could it be that that January 5 meeting was to coordinate what the Obama loyalists who would continue in their jobs after the inauguration should be doing to further the coup?

49 Just to set the record straight on the Logan Act: EVERYONE with any professional legal experience knows that the Logan Act is an unconstitutional joke. It was passed by the Adams administration to try and "get" Jefferson's allies, but even then it was clear that it contradicted the 1st amendment. However, this being before Marbury vs. Madison, it never made it to the Supreme Court on that basis.

2 prosecutions were attempted, both failed. Congress never repealed it because every Congress has thought it would look bad for them to do something that would be portrayed as them justifying espionage, but it has never been declared unconstitutional because for 200 years now, not a single prosecutor in the country has been willing to toss his career onto a bonfire by trying to bring a prosecution based on it.

So just so you know, anytime you hear anyone on the left OR the right claiming that someone has committed a "Logan Act" violation, that person is a charlatan, a fraud, and an idiot. And if they work for a law enforcement agency, they are a particularly dangerous idiot.

As a legal tactic, it seems to be sheer folly to me, which is why I am asking for some smarter "commenter" to help me out.
As a political act it seems a smart(ish) move to create paper that could be pointed to later, insincerely, but politically effective.
But the negative legal consequences seem to out weigh the possible benefits politically.
That's why it seems so strange. It appears to be a HUGE misstep on her part.

Start with this assumption:

EVERYTHING Susan Rice wrote about in that email was in reality the OPPOSITE of what she stated. That's why she wanted so badly to get it on the record. She wanted to have her dated denial of all of the charges that she knew should that she and her bosses could all rightly be charged with.

Go back, read her email, and read it understanding that what actually happened was the inverse of everything there. The depth of the plot, and the reason for her nervousness, will jump out at you.

I'm really not sure myself but it seems likely that she thought this email would only come to light if there was an investigation into what her and maybe Obama's actions were during the spying.

By memorializing them in this bizarre and likely false way, yea she might have been trying to have on the record that she and Obama had nothing to do with the whole thing.

And let me add, this is a classic trait of a nervous defendant. They are worried they will be found out, and they start to construct elaborate lies, and their lies become so detailed and so elaborate (because they think they are being so smart) that they in fact cue the prosecution in to things that, before the long, extremely detailed lie, they had no idea what was going on.

Think of a 6 year old; Mom asks "did you take the soda out of the fridge?" and the child replies "No, I didin't! And I didn't break the vase in the living room either!!!"

Instead their agents put their best recollection of any interview into a memo... a memo that can be deliberately or accidentally wrong. Thing is, if they say you are lying and you say you are not, it is your word against theirs and the courts (and juries) believe the LEO in 99.9999% of cases.

I have flown on Aeroflot on a flight from Odessa to Moscow in the Soviet era, and it was an experience. The pilot thought he was flying a Stuka when he made his landing approach, causing a bunch of honeydew melons to break free (everybody was bringing food back with them) and roll toward the cockpit, with people sticking their feet to try to stop them.

Still, CAAC (the ChiCom airline) was even worse. Only time in my life I've actually been frightened on a plane.

I've sent a lot of CYA emails to past bosses, mostly in the the form of, "Just to confirm our conversation, you want me to concentrate on XYZ." That practice saved my job once about 25 years ago when I was farmed out to work for a different executive VP and ended up having to defend my performance of to my boss.

I've also sent myself emails to help my memory about important meetings and events. I usually blind-copied a home email address because, if you're getting frog-marched out the door, they don't let you take notebooks or copy notes to thumb drives.

Having said that, Susan Rice is lying. That's an email meant to mislead, not to CYA.
