Byron York: Comey Told Congress That FBI Determined that Michael Flynn Did Not Lie In Interviews, But DOJ Senior Officials Had a Particular Desire to Find Him Guilty of Something

You don't say.

According to two sources familiar with the meetings, Comey told lawmakers that the FBI agents who interviewed Flynn did not believe that Flynn had lied to them, or that any inaccuracies in his answers were intentional. As a result, some of those in attendance came away with the impression that Flynn would not be charged with a crime pertaining to the Jan. 24 interview.

Nine months later, with Comey gone and special counsel Robert Mueller in charge of the Trump-Russia investigation, Flynn pleaded guilty to one count of making false statements to the FBI in that Jan. 24 questioning.

...

[I]t appears the FBI did not think Flynn had done anything wrong in the [calls to Russian FM Kislyak]. On Jan. 23, the Washington Post reported that the FBI had reviewed the Flynn-Kislyak calls and "has not found any evidence of wrongdoing or illicit ties to the Russian government." (The calls had been intercepted by U.S. intelligence because the U.S. monitored the Russian ambassador's communications something which Flynn, a former chief of the Defense Intelligence Agency, surely knew.)

Still, Flynn's conversation had the attention of the Obama Justice Department, and in particular of deputy attorney general Sally Yates, who reportedly believed Flynn might have violated the Logan Act, a 218 year-old law under which no one had ever been successfully prosecuted. (Two people were charged in the 19th century, but the cases were dropped.)

Byron York notes what immediately occurred to me-- around this time, reporters friendly to Obama began talking up the LOGAN ACT and how it's Totally a Serious Law You Guys.

Just a coincidence, I'm sure.

It was Yates who sent the FBI agents to interview Flynn, on the bizarre theory that he might have violated the LOGAN ACT (which is not enforced because you cannot make it illegal to talk to foreigners, and which only even gets discussed as a law when used against Republicans -- Democrats can chat up foreign potentates and enemy leaders all the doo-dah day) and on the bizarre theory that he might be blackmailable.

On those thin reeds, Yates built her case against Flynn.

Oh, and Yates was at that January 5 meeting. Coincidentally enough.

Could it be that that January 5 meeting was to coordinate what the Obama loyalists who would continue in their jobs after the inauguration should be doing to further the coup?

39 Prosecuting Obama and Hillary would be highly contentious, no question.

Maybe Trump should issue them pre-emptive pardons, which would put them in a bad spot (claim they don't need them? or what?) and prosecute the shit out of all of their flunkies, and put all the evidence against them out there.

That would dirty up Obama and Hillary nicely, yet not be as divisive as actually prosecuting them, and would have a chilling effect on future malefactors.

49 Just to set the record straight on the Logan Act: EVERYONE with any professional legal experience knows that the Logan Act is an unconstitutional joke. It was passed by the Adams administration to try and "get" Jefferson's allies, but even then it was clear that it contradicted the 1st amendment. However, this being before Marbury vs. Madison, it never made it to the Supreme Court on that basis.

2 prosecutions were attempted, both failed. Congress never repealed it because every Congress has thought it would look bad for them to do something that would be portrayed as them justifying espionage, but it has never been declared unconstitutional because for 200 years now, not a single prosecutor in the country has been willing to toss his career onto a bonfire by trying to bring a prosecution based on it.

So just so you know, anytime you hear anyone on the left OR the right claiming that someone has committed a "Logan Act" violation, that person is a charlatan, a fraud, and an idiot. And if they work for a law enforcement agency, they are a particularly dangerous idiot.

As a political act it seems a smart(ish) move to create paper that could be pointed to later, insincerely, but politically effective.
But the negative legal consequences seem to out weigh the possible benefits politically.

And let me add, this is a classic trait of a nervous defendant. They are worried they will be found out, and they start to construct elaborate lies, and their lies become so detailed and so elaborate (because they think they are being so smart) that they in fact cue the prosecution in to things that, before the long, extremely detailed lie, they had no idea what was going on.

108 Rice has flipped. Her email that was recently "discovered" by Grassley and co was her get of jail free card. Her recollection of the content of the meeting notwithstanding, Comey and Obama are both on the record that no such meeting like this ever happened.

She is now officially invited (per the questions sent to her) to join the congressional testimony party, which is the only reason to write such a patently ridiculous email to oneself. She can now assert some control over her future, instead of simply waiting around for the hammer to drop.

I wonder if any other conversations were documented by Ms. Rice on her last day, and when they also might be "discovered" by various congressional oversight committees. I can guess that I am not the only one wondering this right now.

here's the deal though. what was the capacity in which flynn talked to the fbi?

Basically, officials in their official capacity have to talk to the fbi from time to time. Simple expediency means you can't have lawyers all the time. And consider what about when fbi agents talk to each other, are they "lying to the fbi"

"hey fred, what'd you do this weekend"

"well, bill, I cooked some ribs"

"wrong fred, those were pork shoulders"

So, what was flynn doing talking the fbi? He thought it was part of his regular job obviously. Or was it?

138 Sessions is hard at work, things are happening. The OIG has been at work since Obama put them on "stand down" (his favorite tactic) back in 2015 (or whenever).

BUT despite Sessions being a good guy, I can't see his recusal and the whole Rosenstein/Mueller year long inquisition as anything but a big fat horsefly in the ointment. It was a weakness, and no, there is no pure act that can be done for optics that will make the commie enemy want to do anything but destroy "US".

Comey committed a felony by leaking to the NYSlimes, and he got Mueller in for leverage over Trump at least, or for impeachment at worst. Maybe I just don't see the whole "sting" and how Mueller's actions are just part of the trap.

It seems all the crimes we are uncovering happened before Mueller was installed (given unlimited authority with NO oversight, and backed by all the Deep State operatives posing as FBI/CIA whatever.)

Maybe we win despite all that. Next question, why is congress passing legislation as if Hillary won? I guess we have to wait and hope for the best.

Posted by: illiniwek at February 13, 2018 02:07 PM (bT8Z4)

139 The funny thing about Manafort's crimes (and maybe why he's not being talked about much anymore) is that all of his real crimes appear to have been carried out in partnership with John Podesta, Hillary's campaign manager, with an assist from his brother, Tony Podesta.

and for that reason I do think Trump was very foolish to have ever hired him.

I keep asking this question (and variants of it) because a lot of people who are demanding that people go to prison do not seem to want to do the necessary prep work.

This isn't just a political story (which is how the MSM is spinning it)-- it's going to be a CRIMINAL investigation, with enormous national security implications as well. The IG report alone is said to be 1.2 MILLION PAGES.

The MSM will have to cover it. Even they cannot ignore indictments, trials and convictions. If it all comes out, at the very least the Clintons and Obama will have to spend years in court.

237 Baltimore Trial Of Police Officers Uncovers Stunning Levels Of Corruption

Well, I'll be go to hell.

A federal jury convicted two Baltimore police detectives Monday for their roles in one of the biggest police corruption scandals in city history.

Detectives Daniel T. Hersl, 48, and Marcus R. Taylor, 31, were found guilty of racketeering, racketeering conspiracy and robbery. Prosecutors said they and their comrades on the Gun Trace Task Force had acted as “both cops and robbers,” using the power of their badges to steal large sums of money from residents under the guise of police work.

“Their business model was that the people that they were robbing had no recourse,” acting U.S. Attorney Stephen Schenning said after the verdict. “Who were they going to go to?”

252 no kidding...

One of the most popular measures of volatility is being manipulated, charges one individual who submitted a letter anonymously to the Securities and Exchange Commission and the Commodity Futures Trading Commission.

The letter makes the claim to regulators that fake quotes for the S&P 500 index SPX, +0.14% are skewing levels of the Cboe Volatility Index VIX, -1.80% which reflects bearish and bullish options bets 30-days in the future on the S&P 500 to gauge implied stock-market volatility (see excerpt from the letter below).

The flaw allows trading firms with sophisticated algorithms to move the VIX up or down by simply posting quotes on S&P options and without needing to physically engage in any trading or deploying any capital. This market manipulation has led to multiple billions in profits effectively taken away from institutional and retail investors and cashed in by unethical electronic option market makers.

The whistleblower's claims are consistent with those documented by John Griffin, professor of finance at the University of Texas and Ph.D. candidate Amin Shams in May 2017

280 So: Hillary is "innocent" because Comey determined that No Prosecutor would prosecute, because she lacked criminal intent.

In regard to Flynn, Comey was under the impression that Flynn had not lied--at least intentionally. And he probably reflected that nobody had been successfully prosecuted for a violation of the Logan act. (Thus the value of prosecution is questionable at least, and there may be an argument that prosecutors would be reluctant to prosecute it.)

However, Flynn is "guilty", despite Comey's determination. Hillary is "vindicated" because of a similar determination.

How To Speak Bizarro.

Yes, that is the correct question. I just thought it was funny that she sounds like she was trying to impress herself. Wouldn't have been quite as funny if the language she used didn't demonstrate that she is not as intelligent as she was trying to sound.

Utah mom upset after school tells 6th graders they can`t say no when asked to dance

WEST HAVEN, Utah -- When Natalie Richard’s sixth-grade daughter told her she couldn’t say “no” if a boy asked her to dance at Kanesville Elementary’s Valentine’s Day dance, she didn’t believe it at first.

“Oh no, no honey," Richard said of her reply. "You guys are misunderstanding again. That’s not how it is."

However, after speaking to her daughter’s teacher, she realized the statement was accurate.

“The teacher said she can’t. She has to say yes. She has to accept and I said, 'Excuse me,” Richard tells Fox 13.

Theh don't mention LGBTQEIEIO but I assume it applies to them as well since to exclude them would be racist. Or something. Anyway, definitely non-woke.

Rice may have sent her email to others using bcc. I wonder if Grassley
has only a hard copy of the email, or the full electronic version that
lists any bcc addresees.

I was thinking that, but why BCC everyone if you are laying the groundwork that it was all on the up and up.UNLESS there was a bcc that should not have been on there or would be quite surprising, who may have already been interviewed?

352 The correct question is who sends emails to themselves- just for themselves. I have copied myself several times in order to remind myself I sent something out, but I do not take notes to myself via email. I take notes and keep them with me.
Posted by: Aetius451AD at February 13, 2018 02:42 PM (ycWCI)

I've sent a lot of CYA emails to past bosses, mostly in the the form of, "Just to confirm our conversation, you want me to concentrate on XYZ." That practice saved my job once about 25 years ago when I was farmed out to work for a different executive VP and ended up having to defend my performance of to my boss.

I've also sent myself emails to help my memory about important meetings and events. I usually blind-copied a home email address because, if you're getting frog-marched out the door, they don't let you take notebooks or copy notes to thumb drives.

Having said that, Susan Rice is lying. That's an email meant to mislead, not to CYA.
