Hugh Hewitt: The Failure to Confess That the Steele Rumor-Sheet Was Paid for By Hillary and the DNC is a "Damning Omission"

Hewitt was a former prosecutor who reviewed many similar applications.

Yes, a footnote said, vaguely, that the Steele Smear Document was commissioned by a "political" source. That's not quite the same as saying "Donald Trump's opponent in this election commissioned this word salad of unverified rumors and smears, and his opponent now seeks to initiate criminal process against him to even out the email investigation against her."

Here's a bit of what Hewitt wrote:

Upon publication of the Nunes memo, a retired federal judge emailed me: "There is not an officer of the court in the land who in the context of this particular application to the FISA court should not have identified the source of the information as having been the [Democratic National Committee] and the Clinton Campaign. If I had granted the application and then subsequently learned that the information was sourced to the DNC and the Campaign, I would have rescinded the authorization and issued a show-cause order to the Government to explain who and why this sourcing was not made known to the court. The fact (if it be that) that the Government told the court that it was a political source, but did not identify who, in this particular instance, is highly probative that the Government purposely misled the court."

But the only thing I've found online with the actual verbiage really didn't change a dang thing.

Like... if someone searches all the data they have collected, and finds something, they have 24 hours to get a warrant... AFTER THEY FIND IT.... the only penalty they have for NOT getting a warrant is they can't use it in court.

So they can search the shit out of you... with no warrant, then either get an Ex Post Facto Warrant, OR, they can use it anywhere BUT a Court...

In fairness, in a properly functioning system, no application would be made unless there were compelling circumstances to do so, in which case granting the request would be appropriate.

Which is not to say the present system is necessarily functioning properly. But if the vast majority of such requests were valid, I can see where a judge might whiff on the odd duff one.

I got into it with my boss about reviewing something last week and he threw at me "What I can't trust what you did?" and I shot back "Hey, it's not my name on the door and my license on the line." Because that's true. If I screw up, he's the one who bears the consequences, not me. Now, I take that very seriously indeed which is part of the reason why I've always fought with my various bosses that, no, it's not a compliment that you can trust my work. I don't want you to trust my work because I don't want to get you in trouble please, for the love of God, check this.

Hewitt knows this. He knows full well that the attorney who signs off on it is completely and utterly and totally responsible for what he is signing. So if that attorney wants to accept the help of his staff to take some of the burden off of him, then that attorney also has to accept the risk that if and when the staff screws up, he's the one responsible.

I'm so sick of all these attempts to give people power without also demanding they take responsibility.

These types of courts and the attorneys practicing in them are pretty cliquish. If you are in the club, you don't get questioned. It's bad form to inquire of a member his or her veracity or credibility. You can bet that they talk off the record, go to each other's parties and attend the same conferences. In the rarefied air of intelligence and FISA courts the players don't rock the boat much. I guess I am trying to say it is cronyism of the first order.

So, yeah, he knows what his signature on a pleading means.

But even if he didn't, as you say, it doesn't matter. It's a bit of a legal fiction, I suppose, but affixing your signature to any document you file with the court is saying, "I attest that this is true and that all facts and arguments are presented in best faith etc. etc"

The old "ah, shit, some nameless person lied and I didn't catch it" move would not work with mere mortals. Fortunately for Comey, he's an insider in the deep state, so no big deal.

I'll give Jack Straw a break and I'll mention that the FISA court has been pissed about the DOJ and FBI about lack of candor to the tribunal since at least 2014.

Note, however, that it doesn't appear that being peeved has extended to such things as not rubber stamping the warrant applications.

reason why I've always fought with my various bosses that, no, it's not a
compliment that you can trust my work. I don't want you to trust my
work because I don't want to get you in trouble please, for the love of
God, check this.



Hewitt knows this. He knows full well that the attorney who signs
off on it is completely and utterly and totally responsible for what he
is signing. So if that attorney wants to accept the help of his staff
to take some of the burden off of him, then that attorney also has to
accept the risk that if and when the staff screws up, he's the one
responsible.



I'm so sick of all these attempts to give people power without also demanding they take responsibility.

This. My last lawyer got slapped by the judge with a $10,000 fine (and not coincidentally fired by me) for misrepresentation in court filings. Judges take that VERY seriously.

That is my take too. Both the surveillance of Page and the surveillance of Papadopoulas was aimed at getting access to Trump (circuitously because there was no way in hell they were going to get a warrant to spy on him directly). With all of the wiretapping they got nothing on Page and they only got a dubious "lying to the FBI" charge against Papadopoulas.



I say dubious because the FBI refuse to tape their interviews so we have only the FBI agents' written account of what is said. In a he said/she said between the FBI and a private citizen, the private citizen is not going to be believed even when the FBI apparently lies all the time.

371 The fact that the FBI concealed that the target of the FISA warrant (Carter Page) was really an undercover employee is 10,000 times a bigger deal than the fact that the dossier was paid for by Clinton.

They are both extremely bad, but with this information, there's no way to legally Justify the FISA warrant AT ALL.

The entire basis for everything is based on Carter Page being a potential Russian spy coordinating between Trump and Russian agents.

The fact that he was an FBI mole completely destroys that justification and instead shows an effort by the FBI to not only spy on Trump, but to actively entrap him, like they tried to do with the DTJR / Natalia Veselnitskaya meeting... Remember that she was personally admitted into the US by Loretta Lynch.

This entire thing was a coordinated black-op from the beginning and both Page and Popadopalous are moles/plants that provided the connection the FBI needed to justify everything that has followed since, including the Mueller investigation...
