Seriously - what is this thing about Trump and his cabinet members wanting to actually enforce the law as written? I was advised by many people that it would all be a farce and that globalized betrayal would be the rule.
Second seriously - leaking that out may prevent it from actually happening. I think sanctuary from immigration law will eventually not be tolerated. Drug law is a different story all together there I think the feds will change eventually.

A sheriff sued, saying he works for the state and is not a federal employee and has no obligation to do background checks for them. And the supreme court agreed. I like all the recent blather about how the Dems are going to "stand up and prevent the PDT administration from attacking free pot states' rights"
Like, you mean they are going to pass a law to legalize it? Isn't that their job? And isn't enforcement of the laws as written the administration's job? You know they would rather keep the law as is and pass laws to punish the administration from enforcing the laws, than to change the laws. They prefer rule of man over rule of law. Big, dangerous step, but so is insurrection against the central government, as these criminals have done.
It's much more dangerous not to do it. Too many years these criminals have been allowed to openly flout the law and, not just law, but flout the Constitution and the very notion of the nation-state. All of these fvckers should have been jailed years ago. It's about time to do something to stop these traitors - and, yes, giving aid and comfort to an invasion is treason. Meanwhile, a trial in California of an illegal alien cop killer was put on hold because the illegal admitted in court to killing the cops and said that he would do it again. For some unknown reason the judge sent the jury out and then told them that they weren't allowed to base their verdict on the clear admission by the defendant or the fact that he was happy about killing the cops and said that he would do it again. WTFFF? Also, the illegal said that there was no reason for the trial and that he wanted to plead to the charge .. but the lowlife judge wouldn't allow that, either. If there is any reason or logic in the judge's insane actions I can't see it. This is why people hate lawyers and judges. They can't have it both ways, they can't accept federal funds to perform their local law enforcement duties and then threaten to sue when the feds say they will withhold funds if the states won't cooperate with federal law. Posted by: JackStraw at January 17, 2018 03:00 PM (/tuJf) I'm just saying that the court has repeatedly and recently ruled on this very issue, not that I necessarily agree with it. There is also a long line of case law saying that federal funds can't be withheld to compel states to do things unless that funding can be closely tied to what they're trying to compel (Im blanking on the name of the case, but when Reagan tied highway funding to raising the drinking age to 21, the court said 'ehh, ok on this one, but we're going to rule on this verrrry narrowly') Posted by: Harry Paratestes at January 17, 2018 03:03 PM (F5+ro) 198

Maritime, there are indeed ways to directly target businesses using illegal labor.
The broader war to restore rule of law in immigration demands this. This is part of my *other* tick list of actions the administration should have launched immediately (they require no new legislation). Targeted crackdown on large, known users of illegal labor. Sit-down with DHS; they get the ultimatum to go illegal-free by a date certain, help in getting there (we want minimal economic disruption on our path to restored rule of law), and the hammer held over them if they don't play along. The (long overdue) DOJ request for immediate SCOTUS action to vacate a lower court's interference with DACA matters is interesting. Not sure it's encouraging. The legal guild/glorified clerks that make up most of the profession dealing with the judiciary are utterly incapable of imagining there being checks and balances in that realm. The judiciary has expanded its power, shredded the constitution, even its own rules and ethics, and the whole society has submitted to their increasingly obnoxious and perverse tyranny. Long past time to start popping this authoritarian bubble. DOJ should have included very clear threatening language in their request for expedited treatment: unless we get quick and total reversal of the lower court's lawless sabotage, we will not feel bound to obey the judiciary's capricious orders. I'm pretty sure non-legal types generally have no idea how outrageous and unconstitutional the current situation is. Even though they abhor the outcomes. Courts have brazenly usurped executive and legislative power, and beclowned themselves with nonsensical Fuhrerbefehl-like directives based on nothing whatsoever. Every bit of progress Trump makes against the national degradation can/will be vaporized in the blink of an eye if the constitution is not restored, and the judiciary reduced to its minor and subordinate role. Posted by: buzzion at January 17, 2018 03:10 PM (lKs2v) No, its whether or not local law enforcement has a legal duty to affirmative reach out to ICE and/or hold someone for ICE. in Printz, just running a background check on someone trying to purchase a firearm was considered commandeering local resources. I guarantee that the court will find that so is holding someone in a state jail for 48 hours while they wait for ICE and/or setting up a system whereby they notify ICE of illegals in their jail will also be considered commandeering. Running a background check takes a lot less time, money and and effort than feeding and housing someone, and requires about the same amount of effort as notifying ICE they have someone in their jail. Again, I'm not saying I agree with this, just that this is what the law is and has been for a long time and that theres not a whole lot the federal govt can do to compel these cities to help them short of getting creative with withholding federal funding, which is its own legal minefield. The argument that the killer's lawyer made in court -- that the gun went off by accident, and just happened to hit her dead-center in the back -- completely contradicted the killers earlier lie, that he was merely "shooting at sea lions." And yet the jury ate it up and let the guy go with zero punishment, even though they knew it was all a lie.

As we just discussed below, one size does not fit all. Posted by: JackStraw at January 17, 2018 03:13 PM (/tuJf) I just picked Printz since it was a recent decision, there are dozens of other decisions on the same topic going back centuries. Steven's dissent in that case is basically the argument people are making right now -- that the federal government can force cooperation from local law enforcement if they need help in implementing federal law. That's a dissent though, and is not law. And thank god its not, because do we really want our local police to be agents of the federal government? it's something the left has been pushing for forever, and if they're smart, they will be silently rooting for Trump to win on this one. I just know that with the brain fog that the left likes to spread and their specious agnosticism is going to play like Trump is arresting political dissenters. I don't know that we'll succeed in that or it will start to look more like draconian measures...and you know who else took draconian measures? With the American public's distributed capacity to keep things straight as low as it is, I don't have a whole lot of faith that this would turn out in the positive. Conditions on appropriations, in the appropriations legislation itself, subject to certifications by various executive branch agencies, is not a legal minefield at all. Executive discretionary acts (such as the attempt to withhold law enforcement grants) is entirely different.
This is why Trump should have included this in current appopriations - threatened a veto if it's not in there. Oh, but you say, this will trigger a fight in Congress. Exactly the point. Politics is desperately needed in politics, again. Sanctuary lawlessness is very unpopular, everywhere. Make the vile retards in Congress run on this, fight for this, label themselves with this. That's how you win a fight (not always immediately, but over election cycles). Deep blue/deep stupid cities like SF won't like it, but they're a tiny minority in terms of public opinion on "sanctuary" lawlessness. Posted by: rhomboid at January 17, 2018 03:25 PM (QDnY+) 368

Eh, maybe. But the government in the Arizona case stood on Article VI, and could very well make the same argument here. They are seeking to actively thwart enforcement of laws promulgated under Article I Section 8. And making no secret of it. Under that, the President could conceivably declare them in insurrection against the government, and no Hawaiian judge could say sh*t. Posted by: AZ Hi Desert at January 17, 2018 03:27 PM (O9qtX) 388

If the federal law on harboring illegals is as I think it is, the federal/state difference isn't pertinent, nor is the fact that someone is a governor, mayor, or police officer. They would be tried for violating federal law, not for failing to enforce it.
Harry's topic is entirely separate, I think. IF the federal statute on harboring is as I think it is. And if it isn't, it wouldn't really mean anything, and be fairly bizarre statute. The issue in Printz was about whether or not the federal government can "commandeer" state resources.
Same issue here -- can the feds require the states to hold someone on a federal warrant? The answer has to be no. Otherwise we do not live in a federal system with dual (state and federal) sovereignty. Posted by: Harry Paratestes at January 17, 2018 02:53 PM (F5+ro) ======== Question - this issue of sanctuary cities seems to involve a slightly different context than what you are talking about. You seem to be referencing cases involving domestic crime and law enforcement. What if a state knowingly used its powers to, say, let in foreign spies or saboteurs and release them without notifying the Federal government? It seems they have a positive duty in that case to proactively notify the government. It doesn't seem in such a case "state sovereignty" comes into play. Someone here illegally is violating our national boundary, and all others, whether they be ordinary citizens, state political officials or state law enforcement officials have a duty to make such a violator known. You seem to think this duty somehow is cancelled by overlapping domains between state and federal. But here there are no overlapping domains. Just like a state cannot declare war on another country (that is purely in the Federal domain), it does not have the right to knowingly aid and abet people who are here illegally, even in a passive way by simply releasing them and not notifying the Feds. The answer has to be no. Otherwise we do not live in a federal system with dual (state and federal) sovereignty.
I think you are being deliberately obtuse. That is not the issue. The issue is can California etc. declare themselves to be sanctuary states in defiance of Federal Law. And that is an open/shut, slam dunk, NO they can't. Doing what they are doing is a violation of Federal Law. Arrest the perps, give them a first class fair trial, and send them to prison because they are guilty. Do this, or you have a state of Anarchy because criminal violating the law are just criminals - governments ignoring and violating the law is the definition of Anarchy.
