Sara Carter: Multiple Sources Confirm the FBI Used the Dodgy Dossier to Secure a FISA Warrant to Spy on Trump

So, why did the FBI and DOJ refuse to answer this basic question for a year?

Because everything you suspected is true.

The unverified dossier alleging connections between President Trump's campaign and the Russians was used as evidence by the FBI to gain approval from a secret court to monitor members of Trump's team, this reporter has learned.

...

Multiple sources told this reporter that the dossier was used along with other evidence to obtain the warrant from the Foreign Intelligence Surveillance Court, known as FISC. The sources also stressed that there will be more information in the coming week regarding systemic "FISA abuse."

Sean Hannity also has sources confirming the same thing.

I asked it the way I did because when you get down to it, it doesn't matter how they obtained the warrant. Whether they had obtained a warrant entirely properly, the fact remains is they spied on the GOP candidate for political purposes. The warrant stuff really just goes to the depth of the spying. But I wonder if too much emphasis is being placed on the dossier and not enough on the spying?

73 Recall that (if this long reported and AFAIK undisputed info is correct), there were two applications for FISA warrants, one in the summer of '16, one in the fall. First one was rejected, second one was granted.


Nunes now has all of these documents (or access to see them). Which would have happened eventually, which makes DOJ's stonewalling difficult to explain (any crimes committed in the process would be amply, objectively documented by the nature of the process, so a "leak" from Congress about any of it changes nothing).


Note that ConservativeTreehouse guy now seems to believe that some of the surveillance may *not* have been based on a FISA warrant - but merely selective querying of the universal "take" of communications by NSA. Basically searches of all the comms in the universe, swept up by NSA, targeting Trump's team. It gets complicated in terms of the different legal authorities involved. Could well be both flavors of surveillance happened.

From what I understand, the basis for a warrant is much more lenient than for, say, an indictment much less a conviction. It seems to be mostly just "does this give any reasonable cause for further investigation" such as "a pizzaria with really disturbing art on the walls and a lot of little kids wandering around in it that are not apparently family or customers which is inexplicably popular with the rich and powerful left in DC."

a. Don't know the difference between the Guantanamo Bay Naval Base and the detention center within the base. In fact, they think the whole thing is just one big detention center/illegal prison.
b. Think that when Obama announced he was "closing" Guantanamo, that he actually followed through with his promise. They had no clue that Obama never actually did close Guantanamo.
c. They think than when Obama "closed Guantanamo," the whole base shut down and was evacuated and returned to the Cubans or something. They had no idea that even IF Obama had "closed Guantanamo," he would only have closed the detention center, which is just 1% of the overall base, which would have continued operating as normal.

When I tried to inform them of the real facts, they thought I was joking and pooh-poohed my "ridiculous" statements and then changed the subject.

In general, the warrant application process is a fucking joke. I am not entirely certain what difference there is, if any, for getting FISA warrants. However, to me this is like presenting a Harlequin Romance book to a judge as a basis for getting a warrant to monitor Fabio's phone and email communications.

But judicial supremacy as a concept is the problem. Such a solution only works if the judiciary adheres to law and the constitution - that is, understands their extremely modest and limited role in the process. Eventually the authoritarian instincts win, and here we are.

Watch this video. No, you don't have to watch the whole nearly 2 hours (but I have). Skip ahead to 1:43:50 and listen closely to the testimony of Admiral Mike Rogers and what he has to say about discovering abuse of he FISA 702 17, the "about" section of the FISA process.

This has to do with uncovering the communications of Americans caught up in spying on foreigners using the FISA process.

Judges ask questions, and sometimes get lied to, or manipulated into agreeing to a bad warrant. Happens all the time. However, lies to a judge and ususally your ass is in a sling.

The coming Hillary election may well have emboldened various parties to think they could bend the rules with impunity.

I'm guessing it was an outgrowth of the Church Commission which was part of the Watergate/Nixon thing where the CIA was prohibited from spying on US Citizens inside the US, and prohibited from directly spying on US Citizens outside the US.

I don't know how people forget that the reason our Founders put all of those rights in there is that they had LIVED under a government that didn't respect any of these rules. A few years ago, I was reading an opinion on an illegal search and seizure and there was a throw away paragraph in the middle of it discussing the use by the police of infrared detectors to determine the locations of people in rooms inside a house prior to entry with the comment that the issue of body heat being detectable with equipment was not before the court at that time but the court assumed it would be shortly.

And I just slammed my head against my desk repeatedly because I could already envision the arguments that, hey, since your body heat radiates outside the walls of your home, that means you have no expectation of privacy regarding that and thus it is perfectly fine for the police to use such devices without a warrant because, after all, knowing where people are in the building makes it safer for the police to enter.

Ingraham had him on her radio show a couple weeks ago. He was a lot more seriously hurt by his crazypants leftist neighbor than even what little bit was reported. He had a great deal of recovery to go through, had experienced extreme trouble breathing and I think he had a brush with pneumonia as a result of the ribs injuries he sustained. Really bad stuff.
