Judge Dismisses Charges Against Clive Bundy and His Sons With Prejudice, Citing "Outrageous" Prosecutorial Conduct

A sharp rebuke to how government agents were operating under Obama, and still are.

Nevada rancher Cliven Bundy, his two sons and a militia member will not face a retrial on charges that they led an armed rebellion against federal agents in 2014.

A federal judge Monday said the federal prosecutors' conduct was "outrageous" and "violated due process rights" of the defendants.

U.S. District Judge Gloria Navarro said a new trial would not be sufficient to address the problems in the case and would provide the prosecution with an unfair advantage going forward. She dismissed the charges against the four men "with prejudice," meaning they cannot face trial again.

As the courtroom doors opened after Navarro's ruling, a huge cheer went up from the crowd of spectators gathered outside.

Gabe was writing about this on Twitter. If I followed his claims correctly, Bundy and his sons had offered a defense that they had only armed up because they feared the government was surveilling them and had snipers posted around them. The evidence the prosecutors deliberately withheld from them was that, indeed, the government had been surveilling them and had snipers posted around them.

Kept dismissing the Bundy's defenses left and right... to the point where they probably had grounds for appeal anyway...

Yeah there was a video of it. The two women in side the truck were trying to find cover as the feds peppered the truck with rounds over the period of a few minutes it seemed.

25 The government won a half a loaf in these various cases, since the court finding the Bundy's still owe their lease payments (something around $1 million bucks I believe I heard). Lord only knows how much the Bundy's had to spend on their defense, and the time they unjustly spent in jail in connection with this now dismissed case.

In your defense, not matter what's going on, you do not arm up and threaten LE or other agents. We admonish, and rightly so, the Gentle Giants et al for not saying "yes, officer" and shutting up instead of punching their lights out and going for their weapon.
Same applies in this instance.

Now, that said, the depredations and the persecutions of the Federal government are a legitimate issue.

Part of the charges were that the Bundys engaged in fraud by calling for support for claims that the Feds were surveiling them and had snipers around them. I don't remember if this is an exact quote but the prosecutors called that impossible and a fantasy. Oh and the one BLM internal review document the defense requested was referred to by prosecutors as a shiny object that doesn't exist.

As I keep screeching, there's no possible way this is the only time these prosecutors and agents have done this. None.

I remember at least five cases in the last 10 years where the federal prosecutors withheld evidence in trials from the defense and the case got thrown out as a result. I wrote about several on my blog in the past.

Its not the only time. In fact, given how often this comes up, I suspect its standard procedure.

There's a principle in common law called adverse possession where if you take "open and notorious" uncontested occupation of land for seven years it becomes yours (paraphrasing from memory of Real Property class). I suspect it's been modified by statute though.

Thy didn't try any legal methods, they just came in and fenced it off and told the ranchers they would have to pay an outrageous fee for grazing on "their" recently stolen land. Most of the ranchers kowtowed and paid, Bundy and a couple of others refused.

295 I've got a miniature version of the Bundy Standoff looming in my own personal future.

My mother still lives in what might be described a s a ramshackle cottage she's owned for decades. The "lot" on which it stands is unusual, in that it used to be part of a much larger lot that long ago was subdivided and had four separate cottages built on it. (This was back int he 1890s, I believe.) Then, sometime I think in the '30s the large lot was subdivided into two lots: one with the cottage later to become my mother's, and the other side with three cottages on it. The crazy part is that they all share the same single driveway and "backyard" and what is essentially a mini-parking area behind the houses.

But when my mother bought this cottage back in the '70s, she got the county to re-survey the lots to determine exactly where the dividing line was between her lot and the neighboring lot which now had three structures on it. The survey revealed, shockingly, that 90% of the driveway and 100% of the back yard and 80% of the parking lot were all on my mother's land, whereas the lot with the three cottages had basically just the land the buildings were standing on. Up until that point, the owners had assumed that the driveway, yard and parking were all equally divided between the lots.

Anyway, all this extra land makes my mother's property much more valuable than it otherwise would have been.

Anyway, fats forward several decades and a new owner bought the three-cottages lot, and then, causally one day, asked my mother permission to use the driveway and use two of her parking spaces and part of the yard. In return, he said, he would "keep an eye on things" for her and mow the lawn.

Well, she agreed to this, foolishly, and then the years passed, and by now this neighbor guy acts likes he freakin' owns the whole common area/driveway/yard.

For example, when a friend of my mother once went to plant something in the back yard, the neighbor shooed her away, saying the land was "his." And now my mother have in-home helpers, and won't let them use ANY of the parking spaces, even though they are ALL on my mom's land, except for part of one.

My mother is now too old and decrepit to argue with him.

So, a while ago, I approached him to renegotiate access to the parking spaces, since now we needed them, and he began acting like an asshole, and then I traced on the ground the exact boundary line (which I knew by heart), re-pointing-out that all this land is actually my mother's. His reply?

"Not any more it isn't. I have easement rights, and there's nothing you can do about it. Legally, once an easement precedent has been set and establish ed for this long, it becomes permanent. I have the right to sue this land, and you don't."

Well then.

I know from the very beginning that his "casual" request to use the driveway had long-term sinister and very consciously devised goals -- that is, to establish easement rights -- and way back then I warned my mother about this very thing. But she brushed me aside and verbally agreed with the guy anyway.

Now, eventually, we're going to have a big clash about this: When my mother eventually passes away and the family tries to sell the property, its value will be severely diminished if there is a "easement rider" to the deed stating that the neighbor has permanent rights to use all the land.

And I suspect that I'd actually lose in court, because I researched it and the neighbor is correct: once an "easement" has been in sue for a number of years without dispute, it becomes a permanent feature of the land.

Sigh.

I told him that when the neighbor bought my house back, he could renegotiate his agreement. No way was I letting that SOB claim eminent domain on my land.

.It doesn't even have to be a fence. At our old VFW in CT we used the empty field behind our building that was part of the Wonder Bread Thrift store property as an overflow parking lot for 25+ years. They had zero issues with it as we mowed it and kept it clean.

Never had an issue until Wonder Bread went tits up in bankruptcy and they wanted to sell the place and everyone assumed the extra parking lot was part of our property but the survey said differently. Hilarity and lawyers ensued.

The problem is, the houses are in very close quarters, and I do not want to get into a dispute with this guy while my mother is still alive. He has, like, 17 family members living among the three buildings he owns, and he's the only one who speaks English, and there is a general sense of hostility. My mother has to live cheek-by-jowl with these people, and I don't want to cause her grief, as she's really old now.

I'll probably just leave the issue unresolved until my mother is no longer living there.

A solution that may happen is this: The guy DESPERATELY wants to buy my mother's cottage and re-unify the entire original lot, and created his own family mini-empire with all the land and all the buildings. I have no problem selling it to him AT FULL MARKET VALUE, that is. He thinks he's going to bully her to sell it to him under market value, but he's in for a sad surprise.

I will list it -- or threaten to list it -- at full price...and if he caves and pays what it's worth, fine, the land is his. But if not - which would mean me selling the land for a somewhat diminished price due to the easement issue - -then he'll have to continue his battle with the new owner.

The thing is, he blundered by revealing to me how desperately he wants my mom's property. I will take advantage of that and get him to pay for his dream to come tru.

This seems like a good thread to include my rant about the RealID Act of 2005.

Before 2020 you will need proof of citizenship. You get this proof of citizenship from your local Country Clerk's office in the form of a new Birth Certificate that complies with the requirements set out in the RealID Act of 2005, assuming your county clerk can issue one, assuming your county still has the record of your birth, assuming those county records won't lost in a fire sometime before the Digital Era began, and assuming your County Clerk's Office transitioned to the Digital Era in a timely fashion.

Before 2020 you should visit your local post office and apply for a US Passport, and while you are doing that, also apply for the de facto National ID card known as a 'passport card'.

After 2020, when the RealID Act of 2005 takes full effect, you are going to need proof of citizenship to enter any federal building, including Veteran's Administration office buildings, apply for a state driver's license, or fly on a commercial airliner.

My US Citizenship has been called into question by my local state office that issues driver's licenses, and I'm not yet certain how I am going to be able to prove my citizenship to the satisfaction of state bureaucrats in that office.

It is a worry, a major worry, and I do not know how it is going to work out.

GET YOUR NATIONAL ID CARD AS SOON AS POSSIBLE. You are going to need it.

.While that may be the law it's not going to happen. There must be 25 separate buildings on the grounds of the small VA where we live, there is no way they can control those access points with manned stations, that simply is not going to happen.

Can't imagine what would happen at the VA in Dallas, that place is a maze of small and large buildings with dozens and dozens of access points with literally thousands of people coming and going 24/7.

It would take another TSA size effort just to support this law and as I said, not happening.

409 I've read the Bundy stuff on and off. Think they're goofs. Tactics are stupid. That said . . .

1. Appears that Cliven represented himself in the original BLM/lease case. Its no wonder he lost, he argued immaterial stuff that no fed judge would ever accept. Think the guys that argue that the income tax amendment wasn't "properly" adopted kinda stuff. Equivalent of flying saucer arguments.

2. My recollection is that to enforce the judgment from the lease case, the feds brought in armed officers to take possession of Bundy's cattle, which they ultimately killed. There is an insider/whistle blower report out there on the web of how law enforcement behaved.

3. The Malheur occupation arose from another BLM case: the Hammonds. The government charged them with arson of a field and filed under a terrorism statute with mandatory minimums. The facts are hazy on how the fire started, some weird facts. The judge gave them the equivalent of time served. I think the middle aged son went to prison for a couple of years and then got out. Meanwhile the feds had appealed the sentence arguing that the judge couldn't reduce the minimum terrorism sentence. 9th Circuit sent the guy back. I think the elderly dad too.

4. Something left out of the recent coverage is the fact the feds are prosecuting a FBI agent who was on the hostage team in the Finnicum case. Every member of the FBI hostage/sniper said they had not fired at Finnicum. Well they all covered up that one had shot at Finnicum twice [one hitting the pickup] as he was exiting the vehicle before he made his "furtive move" and before the Oregon State Police finished him off. Conspiracy buffs latch onto the fact that the audio part of the video recording was never released. [Also knowing "feds" I do not know why they would let the mere OSP take the "kill" positions.] Some recent Oregonian articles state that the trial judge is trying to get the 6 firearm discharge reconstruction experts to agree to the "hot tub" method, whatever the hell that is.

5. I read a recent article from a weekly Malheur County newspaper. Apparently there is uranium on BLM property in that county. Guess what outfit had an interest in it [although the article says it was transferred to an LLC] Uranium One. Nothing I've read alleges the Hammond property having any proximity to uranium deposits. So ultimately it probably signifies nothing.

6. The Hammonds got royally screwed. No Bundy antics.
