Judge Denies Fusion GPS' Motion to Block Congress From Seeing Its Financial Records; Fusion GPS Files Emergency Motion to Appeals Court, Hoping for Reversal

Boy, the Democrats' favorite smear-shop really doesn't want Congress to know who's paying it or who they're paying.

A federal judge has ruled against Fusion GPS in the Trump dossier firm's quest to block the release of its bank records to the House Intelligence Committee.

Judge Richard Leon shot down all four of Fusion's arguments against the release of 70 records of transactions involving some of its clients as well as journalists and researchers it has paid since Sept. 2015.

Fusion sued its bank, TD Bank, in October, to prevent it from complying with a subpoena issued by the House Intelligence Committee, which has been looking into Fusion’s role in putting together the dossier.

Mollie Hemingway goes through the judge's ruling, which she says "obliterates" Fusion GPS' arguments.

Before getting to that, she quotes Charles Grassley's response to the Fusion GPS op-ed, in which the company's founders claimed they wanted to be transparent, but Republicans in Congress just wouldn't let them be transparent:

A spokesman for Sen. Chuck Grassley of the Senate Judiciary Committee reminded Fusion GPS that the firm and its principals routinely fought the committee. Spokesman Taylor Foy said, "Senator Grassley provided Fusion GPS an opportunity for transparency six months ago when he invited the firm to publicly testify at an open committee hearing. Mr. Simpson declined. When faced with a subpoena from the Chairman and Ranking Member, Mr. Simpson refused to provide public testimony, using his Fifth Amendment right against self-incrimination to negotiate for a closed-door interview. Despite his public statements, Mr. Simpson and his attorney demanded during the interview that the transcript be kept confidential. Mr. Simpson has refused to answer dozens of questions voluntarily, and has failed to provide the Committee with documents and responses to follow-up questions after the interview."

38 Most people without much legal experience don't really understand the appeals process, thinking it is just a chance for a different Judge to have a do-over. It can happen, but that would be a "de-novo" review and those are rare.

Generally, for an appeal to succeed like this the Appeals Court has to find that the original Judge made an Error of Law in his ruling, and that can be difficult. (not difficult for any cases the Hawaiian Judge makes, since he doesn't even attempt to follow the law) In this case, having looked through the original opinion and Molly Hemingway's piece about it, the Judge's order seems very well grounded in law, and I don't think they have much of a shot at overturning it.

Apparently they didn't expect to lose at that level though - interesting. They're not as smart as they thought they were, and some stuff is about to come out that they really, really, really want to keep hidden.

OT but there's a weather theory that if it's cold in Minnesota it's warmer in Alaska and almost every time I look it seems to hold true. We had over 10 days of below zero highs and it looks like it's been pretty warm there (considering) Not sure where in AK you are though. Good on info I think. I've been there 5 times now, love it. Hoping to sneak up to Denali to do some hiking, I'll do my best to avoid the hipsters. Always could use another drinking buddy! Looks like we're booked for the 2nd week in August. My brothers sis in law lives in Soldotna and puts up with us pretty well, let's us use her boat etc. Then we're spending 3 or 4 days in Seward on some charters. I love that trip. We used to go to Canada every summer as it was a fairly short drive for us and pretty cheap. But they started being absolute dicks at the border and kept cutting their take home limits on fish so we finally said, screw it. For the cost we can got to Alaska every 2nd or third year and that's what we do now. I love it more every time.

If you're GPS, you deal in dirt. To have a case where you have to say not only who paid you but who you paid, it will be very difficult for this company to get business in the future because nobody will want to be tied to them.

Generally, for an appeal to succeed like this the Appeals Court has to find that the original Judge made an Error of Law in his ruling, and that can be difficult. Apparently they didn't expect to lose at that level though - interesting. They're not as smart as they thought they were, and some stuff is about to come out that they really, really, really want to keep hidden.

My sister lives north of Nikiski--we'll be there in a couple of weeks for a hockey tournament for the boy.

Best fishing charter out of Seward goes from Lowell Point. DH and the boy went out last summer for his office party and came back with 12 fish including silvers and a couple of lovely rockfish. Not terribly overpriced, and you can camp there, too. Nice hiking along the shore south to the old army camp. We had a blast.

Homer. Best Halibut fishing is in Katchemak Bay. You can catch halibut in Resurrection Bay, but they are generally smaller and harder to surface.

But, you only need one, and you have never bonked a fish until you bonk a halibut.

Best fishing charter out of Seward goes from Lowell Point. DH and the boy went out last summer for his office party and came back with 12 fish including silvers and a couple of lovely rockfish. Not terribly overpriced, and you can camp there, too. Nice hiking along the shore south to the old army camp. We had a blast.

Cool. Do you know the name of the charter? My brother has lined us up with some pretty good dudes through his sis in law and each time we've slayed them. Last trip, 3 days out we hit our limits on ling cod, sea bass, halibut and silvers (all except one day on the silvers) My brother even played around with a salmon shark for about 20 minutes before it snapped his gear. We always do well fishing on the Kenai with silvers, humpy's etc. King's I am guessing will be closed by then. Which is fine I'd rather eat silvers.

Used to go to the Army fish camp in Seward every summer while I was stationed at Ft Rich in the 80s. Loads of fun going out into Resurrection Bay in 18 ft Boston Whalers, piloted by Army troops on TDY with about 6 hours of training.....all while massively hung over from the night's festivities around the campfire.

Consider that at one end, the panhandle goes halfway to Seattle, and at the far end, Attu and Kiska and Shemya are across the international date line.

Also, find one of those old postcards that shows Alaska overlaid on the Lower 48. Driving from Milwaukee to New Orleans is somewhat like driving from Prudhoe to Anchorage. But the roads are much worse up here.

I really think that after Hillary lost they panicked. The Russia collusion thing was their way of distracting from the real corruption and had the added benefit of possibly getting rid of Trump (although since they knew the Russia thing was BS, they weren't really counting on that.) As long as they could keep their own people (like Mueller) in place for a while, they hoped they could ride out some statutes of limitation and get rid of evidence on some.
