Another Lawless Judge: Federal Government Cannot Withhold Federal Grants from Cities Just Because They Defy Federal Law on "Sanctuary Cities"

You don't have a country when half of the country believes it can live in open defiance of the law.

In a 128-page injunction, Senior United States District Judge Michael Baylson said Department of Justice (DOJ) law enforcement grants can't be withheld from Philadelphia because it refuses full cooperation with federal authorities on immigration, the news outlet reported.

...

In his ruling, Baylson said Philadelphia proved that withholding the grant money would cause irreparable damage, as part of it is used by first responders who provide life-saving naloxone to victims of opioid overdose, according to Inquirer reporter Jeremy Roebuck.

Still, the amount of money in question was just $1.4 million out of a $4.4 billion city budget, according to the Inquirer.

When at least half, probably two thirds, of the current government is part of #TheResistance against the actual legally-empowered government, it's time to confess we no longer have a shared civic culture and we are no longer one people under the law or in sentiment and take a mature attitude towards a peaceable division.

55 Brexit, now with 100% more America!

I agree that the USA needs to drop the 'United' nonsense and start working on an amicable split. However, that brings up a lot of questions.

(1. We are divided not just by region, but by street. Lincoln in NE is decidedly blue; how do we separate Lancaster County from the rest of Nebraska? Where will the blue half of Fremont go?

(2. What system can we come up with handle the reallocation / repatriation of assets and debt from various public and private entities?

(3. How do we deal with the *likelihood* of a wave of Lefties coming into the new Red country to 'transform' the new country? Remember, you will be made to care. There is no escape.

(4. What are the ramifications of a divided United States on the world theatre? Petrodollar goes to the wayside, though it might be already... China might jump the gun trying to claim reserve currency status and end up detonating their nitro-laced propped-up shambles of an economy... Middle East will, of course, blow up.

Much as I'd like to divide the country up and escape the Lefties, I just don't think it could ever work... until it quite literally has to, of course.

Sigh...

I think that was established a good while ago. We've had a two-tiered justice system, and that may not even include the extensive abuse of selective prosecution. And let's not even address the carve-outs Congress has for itself to circumvent commoners law.

94 A mature attitude toward peaceable division would be -- not fanaticizing that peaceable division is doable.

The country would look like a hunk of swiss cheese under a semirealistic best case scenario.

Also, there is a uniparty calling the shots. If they wanted to be "for reelz" about being in opposite camps we wouldn't have gotten into this mess to begin with. The money is to be made by skimming the cream off of the top of the biggest can, not two smaller cans. If there are two smaller cans, the overhead is higher since you have to pay off two sets of government toadies. The uniparty won't have it. The uniparty exists to serve its clients, which are not us.

At the present time you can't get "there" from here without a lot of pain.

Every bill should have a preamble that details why the States cannot or should not address the principle elements of the bill, and a second part to it explaining what the Feds bring to it that the States cannot or should not.

117 In his ruling, Baylson said Philadelphia proved that withholding the grant money would cause irreparable damage, as part of it is used by first responders who provide life-saving naloxone to victims of opioid overdose, according to Inquirer reporter Jeremy Roebuck.

To the extent that is accurate, that's the choice of the city in question, not the federal government. They aren't compelled to cut off funding to anything, they just choose to. The federal money isn't earmarked to anything specific, and even if it was, the cities can choose to cut other areas to pay for the ones lacking.

Furthermore, this judge is in essence saying that the constitution requires the federal government to give states and cities money without ever cutting it off, which is baldly idiotic and false.

If congress will not deal with these rogue judges and their sloppy, even unconstitutional and illegal rulings, then someone else has to. Is that what they want?

In his ruling, the judge considered **the Spending Clause in Article I, Section 8, Clause 1 of the United States Constitution, and also to the Tenth Amendment, which reserves to the states (and by definition, local governments) those powers not designated for the federal government. In analyzing other actions issued by the Department of Justice, which claims that their non-observance by the City warrants rejection of the FY 2017 Byrne JAG grant to Philadelphia, the Court concludes the City is likely to succeed in its claims that the Department of Justice conditions are improper under settled principles of the Spending Clause, the Tenth Amendment, and principles of federalism.**

127 It's on a par with a person saying: "I have the right to steal from you, otherwise my kids will suffer".

It doesn't even make pragmatic sense. If Philadelphia agrees to help the Feds, the amount they will save on entitlements will allow them to redirect these resources towards naloxone.

The other response to this judge would be to say, "Ok, we'll deny federal funds to Philadelphia, but we will give you naloxone if you face a shortage."

And I don't get why the judge can't say, "Well, Philly, they've got you dead to rights. The ball is in your court".

129 See, if a judge says you cannot cut off funding to a city for x reason because it will harm people by ending critical funds, then that is a blanket statement that the federal government cannot cut any funding to any city for any reason because it might harm payments to the citizens there.

Further, you could argue that failing to pay cities is causing harm, so the feds should pay to ones they are not. And more than they are already. Its harming citizens by cutting off potential funding.

This is an absolutely idiotic, asinine ruling that is obviously false and ridiculous. It is utterly without merit or substance and even attempting to state it should cost him his job.

My conclusion was that they are skating right up to the line (tickets are the $ maker after all), and whatever profiling they do is strictly by the numbers.

"The operatic hero Orfeo was allowed to escape Hades with his deceased and beloved Eurydice, conditioned on his not looking at her, but when he does, she dies; Mephistopheles grants Faust eternal knowledge and pleasure on the condition that Faust surrender his soul; and Salome, the title character demands the head of St. John the Baptist as a condition to dance for King Herod."

177 In his ruling, Baylson said Philadelphia proved that withholding the grant money would cause irreparable damage, as part of it is used by first responders who provide life-saving naloxone to victims of opioid overdose, according to Inquirer reporter Jeremy Roebuck.

Still, the amount of money in question was just $1.4 million out of a $4.4 billion city budget, according to the Inquirer.

Are you kidding me?

And as for those ODing on opioids, that tends to be a self-correcting problem.

Transfer the money from welfare benefits.

I've long maintained that the way to break the Left's teeth on spending is simple: don't fund individual programs, but rather give the Left a lump sum for THEM to distribute. Let the various units of the FSA slug it out for the bucks.

Sure, they'll bitch that the lump sum should be larger, but each units of the FSA will quickly forget that and go on the offensive to get their snouts in the trough.

And then hilarity will ensue as they go for each others' throats.

I'm against the federal government telling states what to do within their own borders. I'm also against the federal government flooding money into states like they are.

Cutting off funding because the feds don't like what a state is doing is ideal for both positions. Not only does it stop the funds pouring in, but it is a non-invasive response to a state's actions. The government expresses its dislike, the state can choose what to do about it. Win-win.

215 Judicial coup status:

(anyone want to fill in the answer?)

Again, the "courts" acting as blue-ribbon panels with legislative power.

The impact of policy is not their bailiwick, their competence, or within their authority to judge. Their job is to ensure the guvamint acts on the basis of law.

If the law creating the grant program gives the feds discretion such as that being used by DOJ here, then that's it, game over. If it doesn't, then game over the other way. The "impact" is not the court's concern.

And as I whined for months not that long ago, this pin-prick and possibly illegal approach by DOJ was an advertisement of weakness and poor resolve.

Binding, simple appropriations language is the the answer - obviously - and always was. Reinforced by reciprocity by federal law enforcement, i.e., declining to assist on matters of local priority as a tit-for-tat to get the attention of the noble police and DA. Further reinforced by prosecutions of local officials whose actions directly lead to denial of civil rights via crimes committed by illegals with ICE detainers who are released.

Disastrously, the Trump administration is showing itself to be unserious on its most important policy, and the topic that more than any other accounts for the outsider grabbing the White House.

263 But rickb223, the only question (the *only* question) before the court is whether the law governing the grants in question contains such "strings", or more accurately gives discretion to the feds to withhold or otherwise condition disbursement.

If yes, then game over, feds get to withhold $. If not, then not. It's that simple.

"Impact" does not enter into it - obviously.

But this is exactly the lawlessness we saw in the "travel order" cases. Absurd "standing" given to people to stop implementation of a policy that is completely within the executive's authority, as delegated by Congress.

There's a reason I use the term "judicial coup". It's a precise, and apt, term. They've been usurping executive and legislative power for decades, but recently it's reached critical proportions. Congress has the power to fix all of it, but the topic has literally never been seriously discussed. The executive has the power to repudiate, but nobody near the levers of power has the smarts or character to try anything close to that responsible or useful.

Imagine Northern Ireland during the "troubles" only 1000X more violent and we'll have some idea of what a civil war in America would look like. And every foreign enemy we have would be lining up to assist the "resistance."

Legislative language is easy, don't even need leg counsel's help, wrote such language many times, it's easy. ("No funds appropriated by this act under the XXXXX program shall be disbursed until the DHS and DOJ certify that the recipient jurisdiction is fully cooperating with all federal agencies in enforcement of immigration statutes and policies")

Reciprocity? Couple of staff meetings at DHS and DOJ, conference call with USATs.

Prosecutions against local officials? All the work is done by US attorneys' shops.

I'd wouldn't want to argue your basic premise, but from my POV the Congress has been more than happy to offload their responsibilities to Executive . They've also been happy to have the Judiciary legislate (make rulings they agree with and deem it the law of the land) things too politically hot to handle.
Judges now are starting to feel their oats, wondering where the limit is.

statutes and policies") Reciprocity? Couple of staff meetings at DHS and DOJ, conference call with USATs. Prosecutions against local officials? All the work is done by US attorneys' shops. I
happen to know not a single one of these things has been seriously
considered. This lawless idiocy from the judge is the rebuke the

322 In case anyone missed this on the earlier thread....

For those that don't know, rickl is beginning treatment tomorrow for cancer. Several of us have been working on finding a service that will deliver meals to him. We've found a service that is specifically geared toward cancer patients, Savorhealth.com. In addition to having nutritionist on call for the patient, they have gift certificates that can be purchased that he can then use to order meals.

To that end, we have set up a bank acct. that will take the donations for those wanting to contribute. The information to send a donation is as follows:

Meals for Rick L
First State Community Bank
201 E. Columbia St.
Farmington, MO 63640

As money accumulates, I will use it to purchase certificates from SavorHealth.

The other option is for you to go online and purchase a gift certificate yourself. They will keep a tally of incoming amounts and issue rick a certificate once a certain amount is hit. If you choose to donate via this option, please note in the field provided online the recipient is "Rick L".

SavorHealth prefers that people don't send them checks as there will be a wait time for them to clear.

If you have any questions, you can ask here or e-mail me at moronettetami at gmail.

Thank you all!

325 If addicts get free Narcan....why don't cancer patients get free chemo

---

The short answer is that Narcan is an emergency stabilizing treatment, and chemo is not. The long answer involves the weird game we play over whether Narcan is "really" free because JimBob is going to get a bill for it (which will never be paid but whatevs) and a walk through subsidized cancer treatments as they exist.

Now whether sanctuary cities should have to quit their bullshit or go without federally-funded Narcan is a whole different argument.

This isn't very difficult to understand, Rob. That quote is from the conclusion section, where you expect a relatively succinct description of the legal basis for the decision. You do not find that, florid prose aside. If your point is that the judge is correct, please go make that point. If you think he's wrong, make that point.

I was explicit in my first comment that I don't know if the legal analysis by the judge is good or not. It may be extremely thoughtful and thorough. I was clear in my first comment that the problem is that is not easy to tell without reading the entire opinion. This is based on my reading other sections I think should be more definitive than they are too. It's not that I had to go to page 127 to find an opaque passage. I could post innumerable sections that are intelligible in their own right and yet not at all clarifying as to the disposition of the case.

no kidding

Electric cars are not environmentally sound,
they never were.
The building of parts, building the car, the battery, and the worst part, disposing of the battery is worse than petrol cars.

But it can be cheaper to own by some people. The cost of the cars have gone way down, many petrol cars are much more expensive, and it puts a damper on the Middle East stranglehold.

If you live in an area of hydro-electric power, it can be much cheaper than gas. Cost to own.

The greenies won't admit the "damage" it does to the environment. Just like the whacko's on Tucker, who think killing coal saves the world, where as Tucker pointed out, just kills millions more people dependent on it in 3rd world countries.

This battery crap has a long looong way to go. They are marketing lithium batteries for Harleys, and the things don't even have the power to run the starter. I ripped out a few for people who bought into the bullshit, and put normal batteries in the bikes and they were fine after. Probably why you need a shitload of them to run an electric car motor.

When I was on tesla's site a little while ago they were talking about an upgraded battery. It was 10K if you didn't get the car yet, but if you already had the car it was 20K for the upgrade because of "disposal costs" of the old battery.

10K to get rid of a battery. They can eat a bag of dicks.

What amazes me are the errors in the paragraph you cite:

"and Salome, the title character demands the head of St. John the Baptist as a condition to dance for King Herod."

Salome never demanded John's head as a condition of the dance. She danced, he was pleased, and afterwards demanded his head, after Herod gave her carte blanche.

I somehow doubt this is analogous in any way to the situation between Philadelphia and the Federal government. But I suppose the Bible, like the Constitution is a "living document", meaning that the words and meaning are a malleable, squishy mess, much like an overripe banana.

Apparently you have never heard of the People's Republic of Travis County. And take a good, hard look at Houston, Dallas, and as much as I am ashamed to say it, San Antonio. San Antonio has a police chief who believes he and he alone picks and chooses what laws to enforce, and if he doesn't like the law (such as immigration law or narcotics violations), he simply doesn't have to enforce it. As far as I am concerned, the SAPD is one step away from openly taking bribes from citizens due to crap like that. The mayor is basically a Socialist who believes all economic activity in the city is more properly his.

Yes, TX is a conservative state, but you HAVE to know where to look. Urbanism breeds Leftism.

And to the other guy who says Texas has no mountains - head west. No, they are nothing like CO or AK (other places where I have lived) - hell, they aren't even 10,000 footers. But the idea that TX is a flat state is a myth. Once you break out of the Panhandle and the coastal areas you start to see some land that varies in elevation.
