More on the legal beat: the Supreme Court has issued cert to six cases about the First Amendment. Reported by Bloomberg:Several will be among the term’s most closely watched. They include a high-profile fight over a Colorado baker who refuses to make cakes for same-sex weddings and a challenge to the requirement in some states that public-sector workers pay for the cost of union representation. Both of those cases offer the prospect of ideological divides that could put the court's five Republican appointees in the majority, backing free speech rights.Another case involves the requirement that abortioneers must provide information about pre-natal care and such are-you-sure-about-this things, and some cases about partisan gerrymandering, which Anthony Kennedy (a judicial activist) has suggested could be challenged, somehow, on the First Amendment grounds of "free association." We need a national conversation on the judicial branch, its limits, and the penalties for overstepping those. I don't want to hear any craptastic lawyer's clever argument about how technically based on some obscure precedent some way its okay for a judge to overrule the president's power strictly laid out in the US constitution and supported by congressional law. That has to be dealt with, and soon.
These guys are in their seat until they keel over dead in most cases, they cannot be allowed to simply do whatever the hell they want with the law. There was a time when censure and condemnation by a higher court would restrain their more extravagant tendencies, but its clear that simply is not the case any longer. Congress has not only the power but the duty to stomp on any judge that abuses their position for political reasons. They must, must do so. Another case involves the requirement that abortioneers must provide information about pre-natal care and such are-you-sure-about-this things, and some cases about partisan gerrymandering, which Anthony Kennedy (a judicial activist) has suggested could be challenged, somehow, on the First Amendment grounds of "free association."
This one is pretty key. Basically, california law requires any birth or natal care provider to give abortion information to mothers. Pro-life organizations and groups refused to and the courts took up the case. Predictably, the 9th said they have to obey and promote what they consider horrific and evil. Why *shouldn't* Hawaii judge keep issuing the same decree?
