Texas Church Murderer Should Have Been Blocked From Buying Guns, But Bureaucratic Error Kept His Domestic Violence Charge Off His Record

FACT: We have so many laws and regulations regulating gun ownership that our bureaucrats routinely fail to keep up with the restricted list

CONCLUSION: Dangit, we need more gun laws!

So: buying the guns already was illegal, and it was just our well-oiled machine government's typical competence that permitted him to buy them due to his record not being entered into the federal background-check database.

An official at the Pentagon tells NPR's Tom Bowman that a mistake resulted in neither the arrest nor the conviction being listed in the National Instant Criminal Background Check System, the database that would have flagged him as ineligible to purchase a firearm.

So we have two choices as to what we can do:

1. We can ride herd on these bureaucrats we're paying to do their jobs and, see if you can follow me here, actually make them do their jobs,, or be put out the door to look for a new one.

2. We can strip law-abiding citizens of more rights, so that the bureaucrats' jobs will be easier.

Well, given that the Constitution says nothing at all about guns but it does say it is a sacred right of government employees to do #LikeWhateverMan at their jobs, obviously we have to go with Option 2.

This is always the go-to play, these days. And the turds in Washington and the state capitals have been pretty successful in pushing most of these illegal shit-laws through.

You want to get your money out of the bank ... that makes you a suspect of some sort. First, you must ask permission from various governmental boards and desk-sitters if you can have your own money.

But don't try and take your own money with you anywhere. If you are stopped and found to have too much of your own money on you then the money is arrested and you'll likely not see it for years, if ever again.

All this because our cops can't make cases against known drug dealers and racketeers ... and because when they do our courts let them walk, anyway. So, everyone loses their right to their own cash.

That problem is easily taken care of by forced sunset laws. Each level of law has a certain sunset period associated with it. The Constitution is the highest, with no sunsets, but under that all laws must be readministered and repassed within their stated legal limits and their duration cannot be longer than the sunset level for that sort of law and that particular legislature.

FWIW, I have it on good authority that a dishonorable discharge is just about the worst thing that can happen to a traitor because it can be mildly embarrassing if he applies for a job and has to remind the interviewer that they're not allowed to ask what type of discharge he received.

I don't like this thing about "domestic" violence, as if it's something extra-bad, in and of itself. The reports I saw said that he had been convicted of breaking the kid's skull (well, that he had been convicted and that the kid's skull had been fractured). If this is true then it doesn't matter if it is "domestic" or not. Breaking any kid's skull is violent assault (or battery or attempted murder or whatever it is) of the worst type and should be a simple felony conviction, long jail time and loss of any right to own a gun. The "domestic" part has nothing to do with anything.

BCD - Ineligible for some benefits. For others, the agency administering the benefits looks at the reason (i.e. offenses and circumstances) and makes the call as to if "dishonorable" for the purposes of the benefit. This can vary according to the level of court martial (General vs Special). Example: automobile for disabled veteran. If BCD from a General Court Martial, ineligible. If BCD from a Special Court Martial, agency decides.

BCD is complicated and involves appeals for benefits, etc.

Besides the long history of bureaucratic incompetence in situations like this, there's also the deliberate reluctance to enforce the gun laws that the leftists agitated to enact in the first place.

Chicago has been particularly bad about this. Basically, if you're a gang-banger, they don't bother prosecuting you for violating gun laws. They usually just plead you down to jaywalking or some shit and then let you go. It's been going on for years, and the gun blogs have screamed about it the whole time.

Dishonorable is the worst. Can only come from a general court martial. BCD can come from special or general court martial. Difference in court martials is convening authority. Special court materials are convened at a lower level of command (typically brigade), general at division and above. So DD is usually for the really serious crimes.

Yes, I am well aware that "domestic violence" is part of the application questioning ... and I think it's total bullshit. If someone is convicted of beating the shit out of someone else without cause then that is the crime - not whether it's domestic or not.

The domestic thing is included so that they can cast as wide a net as possible. I believe they also fail people on the background check for not being up-to-date in child support payments and the like. That's total crap and has nothing to do anything. But the politicians just love that sort of bullshit.

I shoot and own guns but have never had a concealed carry permit. I do have 6 months of food in the basement though. Maybe I'm focusing on the wrong threat. Or I fear starving more than getting shot. I mostly protect myself by never venturing from home.

Repeating what I said on last thread - yes the "background check" system failed, but even if it had worked, that's no assurance at all that this nutcase wouldn't be able to lay his hands on hardware.


I'd guess 90% of gun owners are OK with the basic background check. I understand why they are. But in reality, it's almost certainly a useless feel-good gesture, not an effective screening mechanism. It's all one big tautology festival - only law-breakers commit crimes, most of them break gun laws if guns are part of their schtick, background checks only apply to normal people, who commit a vanishingly tiny % of crimes involving firearms.


One stat that isn't kept (well, it wasn't until very recently, if it is now) is what % of violent crime cases involve legally-owned guns (used by the perp). I think some gun stat guys like Lott have tried to do some sampling and estimating based on a few departments that had such numbers, and of course the overlap was close to nil. Make this stat part of required crime reporting statistics, and wait 5 years, and I'll bet you'd see that background checks have no measurable impact on anything.

In the old days, Congress used to be really stingy about admirals. They didn't want too many admirals running around.

We had captains doing the job of admirals, and they'd get pissed because the Royal Navy and others wouldn't give the proper respect and honors and all that because they were only captains. They'd bitch about it.

455 NaClyDog I think the RN is indeed in deep trouble. No $$$. And, of course, a general lack of support or even interest from the public. Reading about WWII Brit commando and other special ops right now - my gawd, just two different countries. None of the WWII stuff is even imaginable now - from every perspective. And to make it worse, some of the distinctive Brit style and efficacy still exists in the personnel (I've seen it first-hand) - it just has no country or cause to serve any longer.


Just further down the same road we were on, and may well get back on .....

I remember the RefTra. It wasn't going as quickly or smoothly as the skipper demanded, and he threatened NO fun in Subic until standards were met. Suddenly, dogs were hatched (or whatever the hell it's called) and watertight integrity was met swiftly.

My wife was Korean and it is a fact that they have different accents from different regions. (This in a country the size of Indiana) Not sure about the fish smell. I only really noticed that in the open markets. Basically, the whole country smells like garlic. And Americans smell like cheeseburgers to them.

When I left for the last time in 99, most of the country had converted from ondol to kerosene for heat. Coal fire is not nearly as prevalent as it used to be. Now if we could just do something about the garlic and bok choy farts!!

It's much worse. 260 RN Captains for 19 warships. Add up everything that could conceivably be a CAPT Command gets you to 32 or so ships, and those are being decommissioned.

The UK is done. As a country; as a major power projection force; as an idea. In addition, the citizens are defenseless after the gun confiscation and in the remaining non-Sharia courts. Plus the politicians kneecap the police. It's essentially a Sharia country now.
