Even the National Laughingstock's Joke Reporter Chris Cilizza Wonders: Why Are the Obamas and the Clintons Staying Silent About Harvey Weinstein?

Well, part of the reason might be that the media isn't ambushing them with questions demanding that they either condemn or endorse the way every Republican is tied tight to every scandal -- so maybe try that, huh?

While we're on that -- Matt Damon has a new movie coming out and he's doing publicity for it. Any chance someone in the media will ask him a question about why he allegedly called the New York Times to pressure them to drop a 2004 story about Harvey Weinstein's abuse of women?

An update: Three women allege rape, but more allege unwanted touching -- which might be sexual assault. A lot of uncomfortable stuff being reported.

The most upsetting part of the New Yorker's expose, apart from the actual alleged rapes, is the help he had in perpetrating these assaults. Help from female assistants. Women were nervous about meeting alone with him, so he'd have a female assistant or two also join a meeting -- initially. To make his target feel safe.

But then the other assistants would leave the room -- it seems implied that this was coordinated, but I'm not sure. Thus leaving the target alone with Harvey Weinstein.

Here's how deadline puts it:

The article also outlines the culture that was in place that enabled these encounters to happen. Farrow writes that he got 16 former and current executives and assistants at Weinstein companies who witnessed unwanted sexual advances and touching. One executive described a ritual in which Weinstein assistants would act as a "honeypot," initially joining a meeting but quickly exiting and leaving the women alone with Weinstein.

Update: Hillary Clinton has finally released a statement containing, as Jim Geraghty points out, a full 38 words. Given how long it took to get her to say anything, and the few words she writes (or has issued in her name, more likely) -- you can really tell she's totally serious about this.

Now where's Obama's statement?

The New York Times Reports: He Had Help. Not just in the cover-up part or the donating-to-DA's part. But in the set-up.

Even in an industry in which sexual harassment has long persisted, Mr. Weinstein stands out, according to the actresses and current and former employees of the film companies he ran, Miramax and the Weinstein Company. He had an elaborate system reliant on the cooperation of others: Assistants often booked the meetings, arranged the hotel rooms and sometimes even delivered the talent, then disappeared, the actresses and employees recounted.

That disturbs me. A lone pervert is just a pervert, but a guy with Sexual Harassment Valkyries aiding him...?

It also seems to me that this sort of thing opens up his companies to lawsuits -- maybe even Miramax's owner, Disney.

Not everyone signed one of those NDA's.

Meanwhile, those who are far, far, more Leftist are using old Harve here to get at the Clintons and the media itself is split between those who support the Old Guard (Clinton/Obama) and those who support the insurgent far Left. Hence some are not asking any questions and others are running the exposes.

TV Journalist Says Harvey Weinstein Masturbated In Front Of Her
The new revelation, which allegedly took place a decade ago, comes after an explosive New York Times report said Weinstein had previously settled eight sexual harassment claims.

Once some women finally come out, they all will come out.

What is the deal with masturbating and showering in front of women?

Harvey Weinstein once trapped a woman in the hallway of a restaurant that was closed to the public and masturbated in front of her until he ejaculated, she says. The accusation comes a day after Weinstein was the subject of a bombshell New York Times report that revealed that he has settled at least eight sexual harassment claims.

The incident took place a decade ago, according to Lauren Sivan, who at the time was a news anchor on a local cable channel in New York, Long Island 12. She says the experience left her shocked, and that while she told friends privately what happened, she remained quiet because she was in a long-term relationship and fearful of the power that Weinstein wielded in the media.

193 Media Matters chief David Brock has personally watched over and benefited from a scheme to hide donor identities that allowed progressives to funnel untraceable millions to initiatives against conservative and GOP causes around the nation, a complaint filed Tuesday with the Federal Election Commission charges.

The complaint centers on a cost-sharing arrangement between American Bridge 21st Century Foundation, a 501(c)(4) nonprofit, and a super PAC sharing its name, American Bridge 21st Century.

Kerr claims that the nonprofit has overpaid the super PAC for work done on behalf of the foundation -- an action that the complaint alleges would violate FEC regulations and federal laws governing fraud and contribution reporting requirements. In other words, the complainant is alleging the foundation is transferring donations to the political action committee in the form of compensation for work done through shared employees.

240 Will one of the legal beagles here comment on how NDAs work in these circumstances?

I'm assuming one cannot enforce an NDA to compel a direct witness to a crime to stay silent. So in the case of these assistants, the NDA keeps them from admitting Weinstein arranged for them to be at the meeting, then to disappear a few minutes in. Correct? They never actually saw the crime so the NDA stands.

So here's the main question. Can one really enforce an NDA to keep one from testifying of circumstantial evidence that helps prove a crime?

249 The NY Times may have detonated an a-bomb in their own face and they're too arrogant and stupid to realize it. Over at American Thinker, they have an article positing why Weinstein was thrown overboard now. It doesn't make any sense to make an example of him now, when this has been going on since before he was a just some promoter in New York. So why now?

The article thinks, and links to some others who think it too, that his defense of a strong Israel was just too much for the Times so they finally released this. Unfortunately, the Times also did the following:

1. Opened the floodgates to a scandal that involves virtually everyone at every level in both Hollywood and the media.

2. Once said floodgates were opened, it would only be a matter of time (and I give it to Thanksgiving) before someone will "finally feel empowered by all these women uniting" to reveal the same sordid details about another studio head. Doesn't matter which since they all do this. But that's coming next.

3. Once that domino falls, questions will start circling about who can sue whom. Watch what Disney does at that point, because they're neck deep in this too, but can't officially be because "Family Friendly For Realz".

4. The current culture of women feeling empowered and refusing to be silent against actual assault is going to help this boulder roll even faster down the hill. Hollywood has been like this SINCE IT WAS FOUNDED so women being used/abused/tossed over board is nothing new. That doesn't excuse it in the slightest, but the LAPD is notorious for covering everything they can for celebrities/powerful/connected people.

5. Trump knows where the bodies are buried too, and it wouldn't surprise me if he nudges this story along in a few weeks with a cryptic tweet hinting at Mogul X having been a fan of underage girls. Or something along those lines.

6. Ace et al are always talking about wanting to cripple Hollywood. Well congratulations everyone, this may actually be what starts it. The process hasn't even really picked up steam yet, but once a second media head is accused, all hell is going to break loose and it will be glorious to behold.

All of this is only my opinion and I could be wrong. But I doubt it.

279 Hillary's statement say she is shocked at the revelations ... shocked that it is "revealed" to the public I guess. The statement does not directly condemn Weinstein. It carefully rejects "the behavior being described" while artfully dodging direct criticism of the man.

Women must stand together with courage and support "against this kind of behavior". But not directly against this guy that did this for decades ... but from now on, especially if they are not leftists, woman should stand together.

They must still fear him, and clearly still love what he did for the leftist cause. They should be calling for him to go to prison. At least call him "deplorable" Hillary. Oh, right, such bigotry is reserved for patriots.

An NDA is a legal contract. If you get a large sum of money for signing it, and you break that, then you have to pay it back. And if you try to say well there was a crime they go but you signed this affidavit saying nothing happened. Were you lying then, or lying now?

Further, the only recourse to someone violating an NDA about perverted and twisted behavior is a civil suit ... and I doubt there's a jury in the country that would find anything in favor of Weinstein, whether he deserved it or not.

Agreed that someone wants him to go down - but also, I think Lisa Bloom may have realized that she was trying to stop Niagra with a tea spoon. When a dam with this much heavy water behind it breaks, it breaks wide open and it all comes out - no stopping it.

The real question is - will Harvey crack and try to drag down as many with him as he can? You know he could. Or will he just accept that ht's now a whipped dog and slink off into the shadows of some central american beach house?

Posted by: bonhomme at October 10, 2017 02:47 PM (jhqr1)

No, an NDA doesn't stop you from doing anything. It just means that if you sign an NDA about something, then violate it, you're open to whatever damages (usually paying back the hush money.)

I don't know all the caselaw on this stuff and the ins and outs on if a compelled testimony is an affirmative defense for violating an NDA, or what.

I can tell you if someone signed an NDA to not disclose evidence of a crime to authorities or the court, it is most likely not going to be an enforceable NDA.

And the actual mechanics of this would be someone violates the NDA, testifies in court against Harvey, then he brings a breach of contract suit against her later for violating the NDA.

Well, if he was found guilty of a felony (like rape), based in part on her testimony, I can't see a court finding in favor of Harvey on the breach of contract suit.

392 Damnatio Memoriae - the systematic erasure of a hated man's name. Often a criminal, but often enough an Emperor, or a Pharoah, he happened to be a great enemy of the previous Emperor, or Pharaoh.

I had thought out culture was beyond such stunts - and yet here we are, right back where we've always been, erasing all of Harvey Weinsteins movie credits on every film he ever helped make.

At least now I understand why the old Romans and Egyptians did it so much - I never did before. It's not about actually erasing the memory of the man; it's about erasing the evidence of everyone who was complicit in the crimes of that man.

I shouldn't be surprised anymore that nothing every changes. Thousands of years go by, and it's still just the same old people doing the same old shit. We've got cooler toys, I guess, but that probably won't last either.

As I was saying on the way to the barrel, the NDAs were paired with affidavits from the victims stating that the events that were being compensated for did not happen.

So if you try to get out from under the NDA by saying that you can't be bound because you are revealing information about a criminal action, you will then be presented with your affidavit, which you signed right here - that is your signature, correct? - that says that the criminal thing never happened. So were you lying then, or are you lying now?

421 My guess is that Clinton and Obama especially are not saying much or anything in order to give the impression that it has nothing to do with them.

That Obama's daughter interned with Weinstein does not matter if no one reports on that. That Clinton and Obama actually helped him cover this crap up does not matter if no one ever reports or asks them about it.

You are never going to see the headline "Deafening silence from Obama over the Weinstein allegations!"

Morality is sometimes personal, but sometimes also cultural. Their culture does not require morality from it's leaders- something we have talked about countless times before.

436 As I was saying on the way to the barrel, the NDAs were paired with affidavits from the victims stating that the events that were being compensated for did not happen.

So if you try to get out from under the NDA by saying that you can't be bound because you are revealing information about a criminal action, you will then be presented with your affidavit, which you signed right here - that is your signature, correct? - that says that the criminal thing never happened. So were you lying then, or are you lying now?
Posted by: blaster at October 10, 2017 02:53 PM (1GJ2R)

Right, and that complicates matters a lot. Also impugns the witness' character if it does end up going to court.

I mean, it sounds like Harvey has some good lawyers and set up himself up pretty well here. Because if any of this ever does see a criminal court, his defense attorney turns to the jury and says, "the accuser signed an affidavit that none of what she just testified to happened. How can you convict a man beyond a reasonable doubt of a crime when we have only one witness -- the same person saying two polar opposite things under oath?"

In other words, by signing that affidavit, they lied. And so they're admitted liars if they come back and say they lied on the affidavit, which, frankly, is kind of a big deal. Not a lot of sympathy for them, frankly.

What I am saying is that he was a man for the ages when it came to moral rectitude. Comparing him to the moral midgets we have now is kind of laughable.

Posted by: Harry Paratestes at October 10, 2017 02:58 PM (wmaTe)

Exactly. And then he also uses oppo research and other methods to muddy the water. Asia admits she can't push a rape case because she didn't complain about it then, and then went and slept with him consensually and got a movie produced by him.

On a criminal sexual assault or rape case he is going to say "yeah well she didn't mind starring in my movie" or whatever and why didn't she say anything then? Prove it! And oh, here's a bunch of naked pictures of her that have been all over the internet. So who is she to talk? I mean Mira Sorvino, like she is some great actress or great beauty that she would be a huge star?

Pervy Weinstein didn't pull his pud without a plan. I suspect that he will never be prosecuted. Sounds like the HR department probably already deleted any information presuming they ever kept any.

Does sound like members of the board knew. They will be civilly liable. There will be lawsuits. And settlements.

In something that Rose McGowan wrote about her own rape by an unidentified Hollywood bigwig (now suspected to be Weinstein), she said that she was told by her lawyer that her accusations wouldn't stick because she'd just appeared in a movie where she was having sex. There was a bit more to it than that, including a partner providing the movie to the rapist's company. But the key bit is that she didn't go forward with charges or a lawsuit because she believed that her claims would be ignored. Giventhat or a cash payout, the NDA means that the rapist bastard at least suffers sometbing for what he's done.

640 In something that Rose McGowan wrote about her own rape by an unidentified Hollywood bigwig (now suspected to be Weinstein), she said that she was told by her lawyer that her accusations wouldn't stick because she'd just appeared in a movie where she was having sex.

Posted by: junior at October 10, 2017 03:18 PM (M3s+4)

That's not an insignificant fact. People who have sex and run around naked in public for a living are treated differently with respect to sexual actions ... because they deserve to be.

Sure ... if the check bounces it's rape, but for someone who prances around public naked and rolls around in bed with men for a living it's a hard sell to claim that she was injured in the same way that normal people with a normal sense of morality would be.

This same line is true for so many in Hollywood. Of course, it was always odd that people would take moral advice from people whose jobs required them to have no morals and live in pretend worlds ...

What was weird about Weinstein (beyond the fact that he was just totally uncivilized) was that he had to impose himself on so many. I'm sure that most producers have beautiful young things throwing themselves at them for parts - no effort required from the producers.

_________________

At least one of them did. A model whose breasts he grabbed went to the NY cops, and they put a wire on her. You can hear it at Daily Mail. Weinstein is at a hotel, and is begging her to come into his room. She is refusing. She says she is uncomfortable with him, and asks why he touched her breasts the day before. He says that's what he's used to. He keeps ordering, then pleading with her, to come into his room, and not embarrass him in the hotel (they know him there, he says). She continually refuses, telling him she's uncomfortable, and he tells her that if she doesn't do what he says, he'll never have anything to do with her again.

The cops said there was not enough on the tape to show criminal intent, and the prosecutor declined to go forward.

The actress Rose McGowan filed a civil suit against Weinstein. We don't know exactly what happened, but apparently he raped her. Her lawyer convinced her to settle, telling her that no one would believe her. Weinstein paid her $100k, and made her sign a non-disclosure agreement.

So it's not as if none of these women ever tried to hold him accountable.

Weinstein could have hired prostitutes. It's not about sex...it's about power and humiliation. Same thing about rape.

They need that to get off. That demeaning of someone else..of having power over them.

648 Well Hillary finally woke up and smelled the coffee and pointed her disapproving finger at Harvey--who until three weeks ago was one of her besties forever.

But when you are wandering through the woods in a Value Rite Vodka induced haze, and have also sucked up a shitload of chardonnay, it is hard to wake up and smell the coffee. So I'll give her that.

649 What about the lawyers who aided him in covering this up?

What about the New York City attorney who dropped charges in what one police officer felt was an easy case.

651 What was weird about Weinstein (beyond the fact that he was just totally uncivilized) was that he had to impose himself on so many.
_____________

Have you seen him?

And yeah, there were probably many wannabes who were willing to do whatever it took, no matter how nasty he was. But Weinstein got off on the power.

652 I have a question - from reading the accounts that Harv's propensity for groping women to raping women was well known throughout entertainment business - why did any of these women go to a meeting with Harvey without a partner/friend/chaperone?

Posted by: Locke Common at October 10, 2017 03:47 PM (pYsP+)

653 I'm thinking the reason Weinstein fessed up to "misconduct" so quickly was to attempt to staunch any further investigation which might lead to much worse revelations.

I will not be surprised in the least when it comes out that he touched multiple teenagers inappropriately.

654 >>>>>the accuser signed an affidavit that none of what she just testified to

655 It's mentioned at the top - Harvey himself provided a "chaperone" for the meetings. But his chaperones would then excuse themselves before the meeting ended.

Did I miss something and she's still Secretary of State?

Why in the hell do they refer to her as such? She is a private citizen.

I'll be interested to see what happens to the DA who didn't prosecute Weinstein but did accept a $10,000 donation from him.

Hell, I thought the DA needed real money.

Posted by: Avon Tinsdale at October 10, 2017 02:56 PM (suO/a)

Y'know, I'm not particularly offended that a DA took bribes.

I'm offended that the DA was so incompetent that he (she?) couldn't negotiate for more than $10k. I mean, if you're going to totally prostitute yourself, wouldn't you have more self-esteem than to cave for barely enough to buy a decent used car?

This reads as though the 'women coming forward' is the behavior that cannot be tolerated.

663 "While we're on that -- Matt Damon has a new movie coming out and he's doing publicity for it. Any chance someone in the media will ask him a question about why he allegedly called the New York Times to pressure them to drop a 2004 story about Harvey Weinstein's abuse of women?"

I would LOVE to see that happen. Not holding my breath, but a reporter should dig into why Damon was so willing to aid and abet Weinstein. Possibly because one of the other huge "open secrets" in Hollywood is that those mouth breathers Damon and Affleck had about as much to do with the Goodwill Hunting script (which won them an Oscar and launched their careers into the stratosphere overnight) as you and I did. Don't believe me, ask William Goldman.

Posted by: Sickofthiscrap at October 10, 2017 05:09 PM (uIsMz)

664 The movie Damon is promoting is "Suburbicon". A George Clooney production. It is an anti-white screed basically. White Americans are bigots, etc. I hope it fails bigly. Absolutely tanks.

671 Are we not concerned that the Leftist media and SJWs turn the flagrant abuse of women in Hollywood into a national event or trend? That is the play right?
