Even the National Laughingstock's Joke Reporter Chris Cilizza Wonders: Why Are the Obamas and the Clintons Staying Silent About Harvey Weinstein?

Well, part of the reason might be that the media isn't ambushing them with questions demanding that they either condemn or endorse the way every Republican is tied tight to every scandal -- so maybe try that, huh?

While we're on that -- Matt Damon has a new movie coming out and he's doing publicity for it. Any chance someone in the media will ask him a question about why he allegedly called the New York Times to pressure them to drop a 2004 story about Harvey Weinstein's abuse of women?

An update: Three women allege rape, but more allege unwanted touching -- which might be sexual assault. A lot of uncomfortable stuff being reported.

The most upsetting part of the New Yorker's expose, apart from the actual alleged rapes, is the help he had in perpetrating these assaults. Help from female assistants. Women were nervous about meeting alone with him, so he'd have a female assistant or two also join a meeting -- initially. To make his target feel safe.

But then the other assistants would leave the room -- it seems implied that this was coordinated, but I'm not sure. Thus leaving the target alone with Harvey Weinstein.

Here's how deadline puts it:

The article also outlines the culture that was in place that enabled these encounters to happen. Farrow writes that he got 16 former and current executives and assistants at Weinstein companies who witnessed unwanted sexual advances and touching. One executive described a ritual in which Weinstein assistants would act as a "honeypot," initially joining a meeting but quickly exiting and leaving the women alone with Weinstein.

Update: Hillary Clinton has finally released a statement containing, as Jim Geraghty points out, a full 38 words. Given how long it took to get her to say anything, and the few words she writes (or has issued in her name, more likely) -- you can really tell she's totally serious about this.


Now where's Obama's statement?

The New York Times Reports: He Had Help. Not just in the cover-up part or the donating-to-DA's part. But in the set-up.

Even in an industry in which sexual harassment has long persisted, Mr. Weinstein stands out, according to the actresses and current and former employees of the film companies he ran, Miramax and the Weinstein Company. He had an elaborate system reliant on the cooperation of others: Assistants often booked the meetings, arranged the hotel rooms and sometimes even delivered the talent, then disappeared, the actresses and employees recounted.

That disturbs me. A lone pervert is just a pervert, but a guy with Sexual Harassment Valkyries aiding him...?

It also seems to me that this sort of thing opens up his companies to lawsuits -- maybe even Miramax's owner, Disney.

Not everyone signed one of those NDA's.

Over at American Thinker, they have an article positing why Weinstein was thrown overboard now. It doesn't make any sense to make an example of him now, when this has been going on since before he was a just some promoter in New York. So why now?

The article thinks, and links to some others who think it too, that his defense of a strong Israel was just too much for the Times so they finally released this. Unfortunately, the Times also did the following:

1. Opened the floodgates to a scandal that involves virtually everyone at every level in both Hollywood and the media.

2. Once said floodgates were opened, it would only be a matter of time (and I give it to Thanksgiving) before someone will "finally feel empowered by all these women uniting" to reveal the same sordid details about another studio head. Doesn't matter which since they all do this. But that's coming next.

3. Once that domino falls, questions will start circling about who can sue whom. Watch what Disney does at that point, because they're neck deep in this too, but can't officially be because "Family Friendly For Realz".

4. The current culture of women feeling empowered and refusing to be silent against actual assault is going to help this boulder roll even faster down the hill. Hollywood has been like this SINCE IT WAS FOUNDED so women being used/abused/tossed over board is nothing new. That doesn't excuse it in the slightest, but the LAPD is notorious for covering everything they can for celebrities/powerful/connected people.

5. Trump knows where the bodies are buried too, and it wouldn't surprise me if he nudges this story along in a few weeks with a cryptic tweet hinting at Mogul X having been a fan of underage girls. Or something along those lines.

6. Ace et al are always talking about wanting to cripple Hollywood. Well congratulations everyone, this may actually be what starts it. The process hasn't even really picked up steam yet, but once a second media head is accused, all hell is going to break loose and it will be glorious to behold.

All of this is only my opinion and I could be wrong. But I doubt it.

Did you read the Ronan Farrow article? The guy had abusive, predatory approach and the stories of some sound a lot like women who are being abused my their BF/husband - or as AtC noted, like girls who were victimized by those UK grooming gangs. Some of the stories are from women who refused, or the ones who worked for him, and he definitely had a way of pressuring and intimidating people, even those who did not submit 100%.

I don't think it's so easy to blame the victims.

No, an NDA doesn't stop you from doing anything. It just means that if you sign an NDA about something, then violate it, you're open to whatever damages (usually paying back the hush money.)

I don't know all the caselaw on this stuff and the ins and outs on if a compelled testimony is an affirmative defense for violating an NDA, or what.

I can tell you if someone signed an NDA to not disclose evidence of a crime to authorities or the court, it is most likely not going to be an enforceable NDA.

And the actual mechanics of this would be someone violates the NDA, testifies in court against Harvey, then he brings a breach of contract suit against her later for violating the NDA.

Well, if he was found guilty of a felony (like rape), based in part on her testimony, I can't see a court finding in favor of Harvey on the breach of contract suit.

As I was saying on the way to the barrel, the NDAs were paired with affidavits from the victims stating that the events that were being compensated for did not happen.

So if you try to get out from under the NDA by saying that you can't be bound because you are revealing information about a criminal action, you will then be presented with your affidavit, which you signed right here - that is your signature, correct? - that says that the criminal thing never happened. So were you lying then, or are you lying now?

...maybe closer to a legal fiction than a lie, but Harvey's lawyers seemingly set it up so that those alleged victims don't really have any legal recourse against Harvey (in exchange for the hush money) and if they try to violate the NDA, they've already sworn under oath that nothing untoward happened.

In other words, by signing that affidavit, they lied. And so they're admitted liars if they come back and say they lied on the affidavit, which, frankly, is kind of a big deal. Not a lot of sympathy for them, frankly.

I know this wasn't aimed at me, but courts HATE to void contracts -- duress doesn't mean "they intimidated me by their lawerly words," it means "I legitimately had no choice but to sign that, and would not have signed it if that duress didn't exist." I would suggest reading the Ronan Farrow article. Gives some insight on how Weinstein manipulated and intimidated them, even the ones who rebuffed his advances. I would think that being in an industry where there are lots of these pervs also makes one weary of rocking the boat anymore than is needed to keep yourself safe from it. For example, the Miramax HR dept. was useless, enabled him. Would bet others in the industry, such as agents, directors, did too in order to not alienate Weinstein.

That's not an insignificant fact. People who have sex and run around naked in public for a living are treated differently with respect to sexual actions ... because they deserve to be.

Sure ... if the check bounces it's rape, but for someone who prances around public naked and rolls around in bed with men for a living it's a hard sell to claim that she was injured in the same way that normal people with a normal sense of morality would be.

This same line is true for so many in Hollywood. Of course, it was always odd that people would take moral advice from people whose jobs required them to have no morals and live in pretend worlds ...

What was weird about Weinstein (beyond the fact that he was just totally uncivilized) was that he had to impose himself on so many. I'm sure that most producers have beautiful young things throwing themselves at them for parts - no effort required from the producers.

At least one of them did. A model whose breasts he grabbed went to the NY cops, and they put a wire on her. You can hear it at Daily Mail. Weinstein is at a hotel, and is begging her to come into his room. She is refusing. She says she is uncomfortable with him, and asks why he touched her breasts the day before. He says that's what he's used to. He keeps ordering, then pleading with her, to come into his room, and not embarrass him in the hotel (they know him there, he says). She continually refuses, telling him she's uncomfortable, and he tells her that if she doesn't do what he says, he'll never have anything to do with her again.

The cops said there was not enough on the tape to show criminal intent, and the prosecutor declined to go forward.

The actress Rose McGowan filed a civil suit against Weinstein. We don't know exactly what happened, but apparently he raped her. Her lawyer convinced her to settle, telling her that no one would believe her. Weinstein paid her $100k, and made her sign a non-disclosure agreement.

So it's not as if none of these women ever tried to hold him accountable.

I would LOVE to see that happen. Not holding my breath, but a reporter should dig into why Damon was so willing to aid and abet Weinstein. Possibly because one of the other huge "open secrets" in Hollywood is that those mouth breathers Damon and Affleck had about as much to do with the Goodwill Hunting script (which won them an Oscar and launched their careers into the stratosphere overnight) as you and I did.
