Justice Department Files Friend-of-the-Court Brief Siding with Baker in Gay Wedding Cake Dispute


Meanwhile, Molly DeVos is being smeared by leftwing nihilists because she's vowed that the era of the kollege kangaroo kourt is over, and due process and evidentiary standards are back.

"The era of 'rule by letter' is over,” Education Secretary Molly DeVos said Thursday afternoon, in reference to an Obama-era practice of issuing guidance documents that acted as laws. DeVos' speech signals yet again her agency's willingness to end the injustices that spread under the Obama administration, which made women into unquestioned victims and treated men as perpetrators without giving them a chance to defend themselves.

"Through intimidation and coercion, the failed system has clearly pushed schools to overreach," DeVos told an audience at George Mason University’s Arlington campus. She also accused the former administration of "weaponized" federal guidance documents that "work against schools and against students."


This was the first time a federal official spoke publicly about the need for due process and the presumption of innocence while highlighting instances where students had been falsely accused. It was also a welcome change from the guidance the Obama administration issued in 2011. At the time, the "Dear Colleague" letter issued by the Education Department's Office for Civil Rights (OCR) greatly changed how schools would be required to adjudicate accusations of sexual assault to retain access to federal funds and prevent federal investigations.

That letter did not have the force of law, but when you're threatening to pull a school's government subsidies for noncompliance, it sure seems like a law.

Ashe Schow reports more on DeVos' speech, including DeVos' proposal to have more rigid definitions of sexual harassment, and to stop telling people who didn't even think they were assaulted that they were raped.

"If everything is harassment, then nothing is," DeVos said.

The left greeted this speech with their typical reasonableness and coolness of head:


She didn't say anything at all about "brushing off" or "blaming." She said she'd like actual due process to protect the provably innocent, and some standards of definition of what "crimes" are being prosecuted, and some standards of due process in hearings.

You know -- like the musty, ancient "but the Constitution is like old, man" belief that an accused must be afforded a chance to view and respond to the evidence against him, with the assistance of an advocate.

Molly DeVos didn't just speak in generalities -- she cited specific instances of institutional failures in these makeshift Rape Courts. Including situations where the school's utter inability to handle such an investigation properly resulted in actual rapists going free.

None of the harpies attacking DeVos want to talk much about the false accusations, but Robby Soave notes each of the examples DeVos gave, and offers some background.

I've really had it up to my neck with Trump, if I'm being honest, and have proclaimed "Done with this" privately a bunch of times.

But then something like this comes along, and it reminds me: Oh yeah, we're in a civil war and the other side is now waging politics by other means: specifically, violence, coercion, intimidation, and the weaponization of government against the citizenry.

BUT, in 2011, the O administration threatened to withhold federal funding from schools that didnt, basically, aggressively go after "rapists" (since 1 in 4 women are raped on college campuses, apparently). So the schools set up these absurd kangaroo courts to keep federal funding.

Of course, at this point, there's no way they'll get rid of them, because then they'll be called pro-rape.

Serious question: how do they even get away with it? How do the assert jurisdiction?

There must be some sort of agreements with local municipalities since they have actual campus police, but how in the world does that translate to trials and punishment?

The first thing that springs to my mind is "their claims must be evaluated". How can people be so stupid so that they can read that and this misgiving is not the first thing that pops into their minds? It is obvious crap, on the surface. Nope. It's not a criminal trial.

It's a student court hearing to decide if the accused should be kicked out of school or not.

The school decides on the burden of proof, rules of evidence, etc. etc.

But again, for an accusation like rape, no male is going to testify or get involved because ANYTHING HE SAYS can and will be used against him in real court if it ever gets to real court.

So basically, you get tried in absentia, kicked out of school, and 99% of the time, the cops never get involved and the victim never files a police report.

Like it or not, even if it was bluster, Trump moved the football in the right direction. I have decided to let it play out and see where this all goes.

Lets face it what if Kasich, or Rubio, or Bush had won the presidency? We would already have had amnesty and massive immigration increases. There would have been tens of thousands of the American troops in Iraq, Ukraine, Afghanistan doing nation building. We would have signed on to another climate deal, and lots of awful unbalanced trade deals.

As for Cruz, I am not so confident in his views anymore. He was always for more trade deals, and it is doubtful that "cheap labor" message would have sold in Pennsylvania, Michigan, or even Ohio. Also is anyone so confident about his views on immigration and borders? I am not.

If you are of my opinion, and that the country is in the early stages of a civil war, Trump was and still is the right choice until someone else comes along who can prove they can do it better. For starters can they tell the difference between a leftist mob beating people up in America, or a jihadist group in Syria, and who are the "freedom fighters".

Right now even Cruz has failed that test several times. Lets see if he can learn.

I know some rape victims and can sympathize with the trauma aspect. No amount of support could convince one I knew to go to the cops. The process is nearly as difficult on them as the crime itself on the victim.

Still that is not justification for empowering private support groups/ colleges/ other students/ etc. with the authority to ruin people's lives.

I've also seen the other side where private and public "support systems" become swords instead of shields.

We either have a system of laws or we don't. I have little faith in our legal system but the alternatives are far worse.

But he has been a major disappointment and has, basically, reneged on every single major campaign promise he made. The only thing he's come through on is the SCOTUS and some judicial appointments. Yay .... But for the rest of the stuff he's pretty much blowing it. Sure, he's blowing it less badly than pretty anyone else would have blown it, but ... it's sad that that's the best we can even hope for, anymore.

He likes the little illegals. He likes leaving BarkyCare in place. He likes China eating our lunch. He likes it all. Sure, he likes it all a bit less than the others ...

I am relieved beyond words that PDT is the president and not you-know-who.

He has done some very good things despite zero help from the GOP which he gave a landslide to in both houses.

I so want him to focus on deep, ideological and transformative issues and not deal-making. But I guess it is not in his nature. And with the outsiders purged and the Deep Staters in, we just have to hope his instincts can carry the day.

I don't think Trump is responsible for the GOP holding a big lead in the House and a narrow one in the Senate. I think there were two different dynamics at work last election, one for president and one for local races.

And it really isn't the GOP against Trump. The House has passed more bills than it did when either Obama, Bush or Clinton was in office. The problem is the bottleneck in the Senate. And we are still only one John McCain vote away from having killed Obamacare.

This while Trump against the GOP makes for a lot of good articles but it really is much less a big deal than it has been made out to be. The real enemy remains the same, the left and their coordinated attack to slow if not stop everything.

Reince Priebus was there to represent the GOPe types (like Ryan). Bannon was a Cruz guy in the primaries. He only joined Trump after Cruz was out. He was there to represent Cruz and similar.

The outreach was a failure. The GOP refused to play nice with Trump even as he sought to make deals with them. The failure to pass the Obamacare repeal says it all.

I expect Trump will adopt a more take no prisoners tactic in the future. He won't hesitate to play the Dems against the GOP in order to force concessions.

Am I happy it turned out this way? Of course not. We all would have been better off if the GOP was willing to stand with Trump.

They decided not to do a PICC on me and by days three and four they were having trouble finding good IV sites for the antibiotics. Apparently, antibiotics are very hard on the veins at the IV site, so a site can only be used for a short period.

It's impossible to even measure the amount of contempt I have for Congress. But that doesn't free Trump from his major campaign promises - and trying to put all the blame on the lowlife douchebags in Congress doesn't cut it.

Trump is far better than anyone else has been in a long time or would have been. But he still falls far short of his campaign. I was a very early supporter of his (probably the earliest, here - and not a supporter as an anti vote against the others but actually a pro-vote for him) and I am very disappointed in how he thinks that he's not responsible to even try - really try - to fulfill his campaign obligations. He's still the best around ... but that just says what a shit state this nation is in.

I'm happy that Trump is not Hillary, everything else is an unexpected bonus.

Well, if both sides were open about wanting the same thing, then all would be lost. But one of the sides pretends to want something else. And then obscures that fact by always finding a way to do nothing. But, if Trump occasionally plays footsie with the Dems, it forces the GOP to take a stand.

Trump is going to want to force funding for his wall in December. He wanted to do it now, but with the hurricane relief issue happening at the same time, he figured it would be a loser to try to have the fight now. So, he punted the fight to December. That's why the GOP wanted to push the issue 18 months out: to screw him on the wall. Let's see what the GOP does in December when trump is willing to shutdown the government to get his wall. What will they do, try to override by dealing with the Dems? After they just claimed he wasn't TruCon for just doing a punt with the Dems help?

There is probably some level of Game Theory going on here; I just don't understand the complexities enough to see it correctly.

Or maybe it's just like dealing with children.

Child A is sulking, hates Daddy and is defiant

Child B is a bit hostile, but mostly neutral and opportunistic.

Daddy gives positive attention and rewards to Child B, but nothing to Child A.

Child A might not like that.

We have never had a minority Party in Congress, cheered on by the media, go the extremes the Democrats have, particularly in the Senate, to thwart a president of the other party. They are using every parliamentary trick in the book to slow things down and thwart virtually every single piece of legislation.

If Republicans had done this to Obama the media would have been screaming racism every single day all day long. But when liberals do this to Trump the media applauds and blames the Republicans.

Look at the facts. The House has passed more bills in the first 6 months than the House did under the previous 3 presidents. Did you hear the left whine that the liberals in Congress were against Obama? If McCain had voted yes instead of being quintessentially McCain, Obamacare would be dead and we wouldn't be having this conversation.

The media will do anything to hurt Trump and the right. I'm sure Trump is frustrated. He is a businessman and is used to having his orders carried out immediately. Well this isn't that. This is government and politics and he is still learning how the game is played.

After Reagan's first year when the economy didn't take off people said he was done too. That's why presidents get 4 years. We are still in the first innings, if Trump and Congress are still in this position in a year then I will be worried.

You can't be incarcerated through a civil or administrative proceeding. The only exception I'm aware of is a criminal contempt proceeding which is part of a judge's inherent authority.
