Justice Department Files Friend-of-the-Court Brief Siding with Baker in Gay Wedding Cake Dispute

Meanwhile, Betsy DeVos is being smeared by leftwing nihilists because she's vowed that the era of the kollege kangaroo kourt is over, and due process and evidentiary standards are back.

"The era of 'rule by letter' is over,” Education Secretary Betsy DeVos said Thursday afternoon, in reference to an Obama-era practice of issuing guidance documents that acted as laws. DeVos' speech signals yet again her agency's willingness to end the injustices that spread under the Obama administration, which made women into unquestioned victims and treated men as perpetrators without giving them a chance to defend themselves.

"Through intimidation and coercion, the failed system has clearly pushed schools to overreach," DeVos told an audience at George Mason University’s Arlington campus. She also accused the former administration of "weaponized" federal guidance documents that "work against schools and against students."

This was the first time a federal official spoke publicly about the need for due process and the presumption of innocence while highlighting instances where students had been falsely accused. It was also a welcome change from the guidance the Obama administration issued in 2011. At the time, the "Dear Colleague" letter issued by the Education Department's Office for Civil Rights (OCR) greatly changed how schools would be required to adjudicate accusations of sexual assault to retain access to federal funds and prevent federal investigations.

That letter did not have the force of law, but when you're threatening to pull a school's government subsidies for noncompliance, it sure seems like a law.

Ashe Schow reports more on DeVos' speech, including DeVos' proposal to have more rigid definitions of sexual harassment, and to stop telling people who didn't even think they were assaulted that they were raped.

"If everything is harassment, then nothing is," DeVos said.

The left greeted this speech with their typical reasonableness and coolness of head:

She didn't say anything at all about "brushing off" or "blaming." She said she'd like actual due process to protect the provably innocent, and some standards of definition of what "crimes" are being prosecuted, and some standards of due process in hearings.

You know -- like the musty, ancient "but the Constitution is like old, man" belief that an accused must be afforded a chance to view and respond to the evidence against him, with the assistance of an advocate.

Betsy DeVos didn't just speak in generalities -- she cited specific instances of institutional failures in these makeshift Rape Courts. Including situations where the school's utter inability to handle such an investigation properly resulted in actual rapists going free.

None of the harpies attacking DeVos want to talk much about the false accusations, but Robby Soave notes each of the examples DeVos gave, and offers some background.

I've really had it up to my neck with Trump, if I'm being honest, and have proclaimed "Done with this" privately a bunch of times.

But then something like this comes along, and it reminds me: Oh yeah, we're in a civil war and the other side is now waging politics by other means: specifically, violence, coercion, intimidation, and the weaponization of government against the citizenry.

They've done it through student conduct courts for a while.

BUT, in 2011, the O administration threatened to withhold federal funding from schools that didnt, basically, aggressively go after "rapists" (since 1 in 4 women are raped on college campuses, apparently). So the schools set up these absurd kangaroo courts to keep federal funding.

Of course, at this point, there's no way they'll get rid of them, because then they'll be called pro-rape.

Right. But, originally, if you were convicted of a serious crime, that could be a student conduct case.

You know, post-conviction.

But you know how these things work. Slippery slope and all of that.

The 2011 "dear colleagues" letter really pushed it in the direction of "FUCK THE COPS AND CRIMINAL JUSTICE SYSTEM, TRY PEOPLE FOR FELONIES HERE!"

Of course, the accused can't testify on his behalf or have a lawyer present. Plus, any lawyer would definitely say DONT TESTIFY NUMBNUTS, since any testimony in a school kangaroo court could be used against the accused in a real criminal court.

So yeah, it's a system designed to fuck young men.

Nope. It's not a criminal trial.

It's a student court hearing to decide if the accused should be kicked out of school or not.

The school decides on the burden of proof, rules of evidence, etc. etc.

But again, for an accusation like rape, no male is going to testify or get involved because ANYTHING HE SAYS can and will be used against him in real court if it ever gets to real court.

So basically, you get tried in absentia, kicked out of school, and 99% of the time, the cops never get involved and the victim never files a police report.

Posted by: Skandia Recluse at September 07, 2017 06:49 PM (m9X4Y)

88 All I know is that since these College Courts have happened, the claims of false rape seems to have gone up...at least between that Rolling Stone article & some other exposes/charges that turned out false.

That is just horrible for true rape victims. Now it will be even tougher for them. smh
Posted by: Gorilla Gumdrop at September 07, 2017 06:45 PM (Ejylv)

Bigger issue is that Rape is against the Law, and the vast majority of these cases never get reported to actual law enforcement...

Thus, if it IS indeed Rape, the Rapist does not go to Jail...

The FIRST thing a college should do if they learn of a rape, is get the victim to go to Police.

Its WHY we have a Court system.

Posted by: Don Q. at September 07, 2017 06:49 PM (NgKpN)

89 ...and good luck transferring to another college when you have to disclose why you left your last college. "oh, I was convicted of rape by the school, no big deal. Can I get in here?"

90 question - would Hillary do this, or double down on Obama's numerous persistent illegalities until we become a third world shithole?

Answer - I'll take anything Trump tosses just to get rid of this shit. I mean, without the rule of law, there is no hope of ever reversing anything? It just becomes a question of who howls the loudest, or who get to punch the most people.

We are once again a nation of laws, not men.

91 Right, and of course -- if a real rape DID occur, you're letting a rapist roam free on the world. The only punishment he got was being kicked out of school.

But if a rape DIDN'T occur, then someones life is ruined over an unsubstantiated claim.

150 The trouble with being done with Trump is right now there is no suitable alternative.

Like it or not, even if it was bluster, Trump moved the football in the right direction. I have decided to let it play out and see where this all goes.

Lets face it what if Kasich, or Rubio, or Bush had won the presidency? We would already have had amnesty and massive immigration increases. There would have been tens of thousands of the American troops in Iraq, Ukraine, Afghanistan doing nation building. We would have signed on to another climate deal, and lots of awful unbalanced trade deals.

As for Cruz, I am not so confident in his views anymore. He was always for more trade deals, and it is doubtful that "cheap labor" message would have sold in Pennsylvania, Michigan, or even Ohio. Also is anyone so confident about his views on immigration and borders? I am not.

If you are of my opinion, and that the country is in the early stages of a civil war, Trump was and still is the right choice until someone else comes along who can prove they can do it better. For starters can they tell the difference between a leftist mob beating people up in America, or a jihadist group in Syria, and who are the "freedom fighters".

Right now even Cruz has failed that test several times. Lets see if he can learn.

I know some rape victims and can sympathize with the trauma aspect. No amount of support could convince one I knew to go to the cops. The process is nearly as difficult on them as the crime itself on the victim.

Still that is not justification for empowering private support groups/ colleges/ other students/ etc. with the authority to ruin people's lives.

I've also seen the other side where private and public "support systems" become swords instead of shields.

We either have a system of laws or we don't. I have little faith in our legal system but the alternatives are far worse.

There's nothing else to do, anyway.

But he has been a major disappointment and has, basically, reneged on every single major campaign promise he made. The only thing he's come through on is the SCOTUS and some judicial appointments. Yay .... But for the rest of the stuff he's pretty much blowing it. Sure, he's blowing it less badly than pretty anyone else would have blown it, but ... it's sad that that's the best we can even hope for, anymore.

He likes the little illegals. He likes leaving BarkyCare in place. He likes China eating our lunch. He likes it all. Sure, he likes it all a bit less than the others ...

That's okay. Trump only represented one last, slim-to-none chance to save the Union. But, he's really not that. National divorce is where it's all going to.

How f*cking outrageous is that? Illegal aliens living illegally in the U.S., who were given temporary protection from deportation through a blatantly unconstitutional directive from Obama, and Microsoft is publicly threatening the government if it actually attempts to comply with existing laws?

Why should any American tolerate this bullshit? Microsoft is one of the companies that has been blatantly abusing the H-1B visa system for years now, bringing in foreigners to do jobs Americans IT workers would love to have. And now Microsoft is announcing that not only will it not obey the law, but it will fight the government if it tries to enforce the law?

I agree with you. But it shouldn't be a binary choice.

If a guy was assaulted & beaten, he should be able to go to the Student whatever, and be supported and directed to the Cops & the ER.

Not to the Campus cops, or the College Crime courts.

The Universities have a vested interest in keeping their crime stats low. They tried to do this by setting up these ridiculous
Depts. & Crime Courts for rape. To give the pretense of justice. And to keep their rape stats low.

They screwed over these girls...twice. Which disgusts me. It should have always been reported to the police. Never have been solely a college issue. And then when Obama came on scene it got way worse. Broad brush here.

The system became flawed b/c of a college workaround for selfish/enrollment/financial reasons; Obamas weaponized it all; and the women and men became victims.

Something like 7,000 voters registered and voted using out-of-state IDs on voting day in RI. they claimed to have "just moved to RI". Now, just 10 months later, most can't be found in the state and only 1,014 of them have an RI driver's license.

Hillary won RI by 2,700.

There had been several other girls her age who had been murdered (or disappeared) in the Charlottesville area in the preceding years, yet this girl was still walking around town alone, drunk off her ass in the middle of the night, and willingly walked off with her killer (as shown on the videotape).

We went from slut-shaming rape victims for what they were wearing or their prior sexual history in the 1950's and 1960's, to pretending that a woman victim could never, ever bear any responsibility for putting herself in a position where she was vulnerable to attack. She could dance naked through a men's locker room while willingly guzzling down enough liquor to render a grizzly bear unconscious, but it would still be sexist to suggest that she bore some responsibility for her plight if she were to be sexually assaulted.

But he has been a major disappointment -

Hmm, walking away from TPP was great.

So was pulling out of the Paris Accord.

Oh, and then there's the appointment of Gorsuch.

The uptick in jobs is a promise kept, too.

His work cleaning up the VA is also a promise kept.

Our national debt is decreasing.

His publicly calling out Antifa for the terrorists they are and his pardon of Arpaio are another examples of me not getting tired of winning.

I'd say President Trump is doing pretty well keeping campaign promises.

He has done some very good things despite zero help from the GOP which he gave a landslide to in both houses.

I so want him to focus on deep, ideological and transformative issues and not deal-making. But I guess it is not in his nature. And with the outsiders purged and the Deep Staters in, we just have to hope his instincts can carry the day.

I don't think Trump is responsible for the GOP holding a big lead in the House and a narrow one in the Senate. I think there were two different dynamics at work last election, one for president and one for local races.

And it really isn't the GOP against Trump. The House has passed more bills than it did when either Obama, Bush or Clinton was in office. The problem is the bottleneck in the Senate. And we are still only one John McCain vote away from having killed Obamacare.

This while Trump against the GOP makes for a lot of good articles but it really is much less a big deal than it has been made out to be. The real enemy remains the same, the left and their coordinated attack to slow if not stop everything.

Goodness, Trump was practically the best of all possible choices last
year. If it hadn't been for opposition from the party that reneged on
every promise made over the course of almost a decade, Trump would be
the single best conservative President since Coolidge.

likewise there isnt a single thing that trump has done wrong so far that clinton wouldnt have done terribly worse

from devos to pruitt to gorsuch to sessions to transgenders to daca... im happy

with clinton in the white house we would have had the father of a domestic terrorist as vp and black lives matter would be a cabinet level department and being transgendered would be a prerequisite to get into the military...and oh yeah...wed be at war with russia right now

Reince Priebus was there to represent the GOPe types (like Ryan). Bannon was a Cruz guy in the primaries. He only joined Trump after Cruz was out. He was there to represent Cruz and similar.

The outreach was a failure. The GOP refused to play nice with Trump even as he sought to make deals with them. The failure to pass the Obamacare repeal says it all.

I expect Trump will adopt a more take no prisoners tactic in the future. He won't hesitate to play the Dems against the GOP in order to force concessions.

Am I happy it turned out this way? Of course not. We all would have been better off if the GOP was willing to stand with Trump.

It's impossible to even measure the amount of contempt I have for Congress. But that doesn't free Trump from his major campaign promises - and trying to put all the blame on the lowlife douchebags in Congress doesn't cut it.

Trump is far better than anyone else has been in a long time or would have been. But he still falls far short of his campaign. I was a very early supporter of his (probably the earliest, here - and not a supporter as an anti vote against the others but actually a pro-vote for him) and I am very disappointed in how he thinks that he's not responsible to even try - really try - to fulfill his campaign obligations. There have been a lot of unexpected bonuses, and for that I am grateful.

There are also a lot of missed opportunities which I fear will never return because 1)Trump is Trump. He's not going to change and 2)Ryan and McConnell are not Gingrich and Lott. As much as those guys have major warts, they actually accomplished conservative things with a Democratic president.

You can't be incarcerated through a civil or administrative proceeding. The only exception I'm aware of is a criminal contempt proceeding which is part of a judge's inherent authority.

397 Give up on Trump?

Why just today, I got a really NICE letter from Melania, with a nice picture (suitable for framing) of Melania and Donald at the Inauguration.

Well, yes, she is asking for money. But I don't THINK she's a hooker.

Seriously. What was that other choice, that TrueCon that was going to fix everything?
We are seeing just how stupid and feckless the Republican Congressional leadership really is. Throwing away the opportunity of a GENERATION to actually implement new policies to reverse the social welfare state.

But, everything after Hillary's defeat is gravy. So I'll flow with the go.

Posted by: J.J. Sefton at September 07, 2017 07:56 PM (mbhDw)

++++

Well, if both sides were open about wanting the same thing, then all would be lost. But one of the sides pretends to want something else. And then obscures that fact by always finding a way to do nothing. But, if Trump occasionally plays footsie with the Dems, it forces the GOP to take a stand.

Trump is going to want to force funding for his wall in December. He wanted to do it now, but with the hurricane relief issue happening at the same time, he figured it would be a loser to try to have the fight now. So, he punted the fight to December. That's why the GOP wanted to push the issue 18 months out: to screw him on the wall. Let's see what the GOP does in December when trump is willing to shutdown the government to get his wall. What will they do, try to override by dealing with the Dems? After they just claimed he wasn't TruCon for just doing a punt with the Dems help?

Posted by: Anon Y. Mous at September 07, 2017 08:07 PM (pvjTE)

408 He won't hesitate to play the Dems against the GOP in order to force concessions.'

That may be the only way to play.

I agree.

There is probably some level of Game Theory going on here; I just don't understand the complexities enough to see it correctly.

Or maybe it's just like dealing with children.

Child A is sulking, hates Daddy and is defiant

Child B is a bit hostile, but mostly neutral and opportunistic.

Daddy gives positive attention and rewards to Child B, but nothing to Child A.

Child A might not like that.

/at least in theory.

409 >>Really, Jackstraw, the Dems made Congress stay in session during the break?

And? Republicans did the exact same thing under Obama? So what?

We have never had a minority Party in Congress, cheered on by the media, go the extremes the Democrats have, particularly in the Senate, to thwart a president of the other party. They are using every parliamentary trick in the book to slow things down and thwart virtually every single piece of legislation.

If Republicans had done this to Obama the media would have been screaming racism every single day all day long. But when liberals do this to Trump the media applauds and blames the Republicans.

Look at the facts. The House has passed more bills in the first 6 months than the House did under the previous 3 presidents. Did you hear the left whine that the liberals in Congress were against Obama? If McCain had voted yes instead of being quintessentially McCain, Obamacare would be dead and we wouldn't be having this conversation.

The media will do anything to hurt Trump and the right. I'm sure Trump is frustrated. He is a businessman and is used to having his orders carried out immediately. Well this isn't that. This is government and politics and he is still learning how the game is played.

After Reagan's first year when the economy didn't take off people said he was done too. That's why presidents get 4 years. We are still in the first innings, if Trump and Congress are still in this position in a year then I will be worried.

President Trump has already done more for us than the whole lot of them put together. He deserves the benefit of the doubt. He's earned that much.
