Federal Judge, Get This, Blocks Enforcement of Democratically-Passed Texas Sanctuary City Bill
The Optimates have decided the public is no longer permitted to pass laws of their own devising.
Note that the state law imposes duties on state law enforcement. Specifically, it demands they comply with the federal law. This judge -- Orlando Garcia -- decided that a state law demanding that state actors comply with federal law runs afoul of federal law.
U.S. District Judge Orlando Garcia blocked portions of Senate Bill 4 (SB 4) requiring local law enforcement departments to comply with federal requests to hold unauthorized immigrants in custody. Also blocked: a provision that stopped local departments from implementing policies that would "materially limit" enforcement of immigration laws, the Dallas News reported.
An aspect of the law permitting police officers to ask about immigration status was not blocked, but the ruling did limit the actions officers would be allowed to take after learning that a person was undocumented – officers could only report the person’s immigration status to federal authorities.Why? Why can't a state law instruct state law enforcement officers what their duties are? Here's his "reasoning:"
In other words, illegal non-citizens don't like this so citizens are no longer permitted to pass laws that citizens prefer.
In a 94-page ruling, Garcia wrote that there "is overwhelming evidence by local officials, including local law enforcement, that SB 4 will erode public trust and make many communities and neighborhoods less safe" and that "localities will suffer adverse economic consequences which, in turn, will harm the state of Texas."
"The Court cannot and does not second guess the Legislature," he continued. "However, I'm a-gonna do it anyway. YOLO, bitches."I made up the last sentence, but pretty much that's the spirit of it.

The various "rulings" interfering with the president's clear unchallenged plenary power to regulate admissions to the country ("travel ban") didn't even cite law in most cases. And they included things like "intent" and CAMPAIGN STATEMENTS. Absolutely ridiculous.
The political difficulty is understood, but it's arguable that Trump violated his oath by *complying* with any of those rulings. His oath is to the constitution, not to an unworkable, arbitrary, and completely confected "judicial review" that dares to usurp executive power, thereby shredding the constitution.

The discretion of what is and what is not prosecuted is the fatal flaw in our misunderstanding of the State and its relationship with the People.
Government is sufficiently weaponized now to selectively prosecute threats without suffering consequences. It's immune from itself because the component parts are corrupted and self-castrating either by choice or by default.
So, yeah, technically there's still a Constitution and all sorts of rules at every level of jurisdiction; but it's really just a bunch of words to be folded, bent, or ignored on an as needed basis.

You are confusing arbitrary process with law and the constitution.
You are alleging something about principle. It's absurd on it's face to equate a judge's ruling with law, or with the constitution, regardless of substance. The substance is everything. In this case, as in many others, it's nonsense. Courts have no authority to make policy decisions, nor the competence to do so. Submitting to lawless, indefensible judicial usurpations is not "rule of law" - it's the exact opposite.
If, alternatively, you want to make a *practical* argument, that OMG the only workable way is if "somebody!" has final say, you're still wrong. Centuries of experience have shown very good pattern of compliance with judicial rulings, including very dicey ones, and those that get reversed or legislated around.
But there are limits. There's not the slightest possibility that a consequence of ignoring this, or the "travel ban" rulings would be chaos or other negative consequences. Not the slightest chance. These are lawless rulings wherein courts are usurping executive AND legislative power - THAT is the chaos.
Mindless deference to illegitimate, inertial "authority" is irresponsible, and as the state of the country shows, the greatest danger.

Only congress can do that, and only with federal judges. State judges, their legislature usually has to (with impeachment) which is almost never, ever used. In the whole history of the United States, over thousands of judges, only 15 had been impeached, and of those only 4 thrown out of office (3 resigned).
That's out of more than 3000 federal judges since the USA was formed.
Impeachment is only a grand jury, it doesn't remove them from office. It decides if a court trial is justified to do so.

Mississippi and Arizona's challenge to DACA failed due to their being unable to show an injury to the state that would give them standing. When Texas challenged DAPA, the state had real, concrete evidence that they would be injured, so the preliminary injunction in the trial court was upheld on appeal. It was sitting at the Supremes as of November 8, the Supremes did nothing awaiting the outcome of the election, and the cert petition has since been withdrawn by the DOJ (you know, do-nothing Sessions).

But if the criminal happens to be a judge, and simply declares his act to be legal, then it is the law, and you are forced to comply. You are not permitted to defend yourself. If the open border advocates file suit to stop the revocation of the illegal Obama EO the states can still file suit on the basis that they already won in Brownsville and the Fifth Circuit. It could be a lot of fun seeing federal judges from different jurisdictions go at it.

I would guess they could come back with a showing of standing. The defeat wasn't on the substance.
Note that the PI against DAPA wasn't on the substance either. It was based on the Obama Administration not following the Administrative Procedures Act by giving notice and taking comment before issuing the DHS Secretary's memo that created the program.. There is no indication how the substance would have gone, if it ever got to that. Courts are surprisingly deferential to Presidents not named Trump.

Administrative fixes (dividing the 9th Circuit) are irrelevant to the problem, which is the disappearance of integrity, and the conversion of courts into unelected ruling tribunals (not accountable to the constitution, the law, or the people).
Restoring/creating integrity is, historically, a somewhat magical process, which distinguishes the few countries/cultures that have done it, from the majority. If we could bottle it, we'd have had more success in our foreign aid programs, which have spent lots of effort (not much $) on precisely this sort of thing.
As a practical matter, administering a wake-up shock to the system would be best - ignoring a lawless judicial ruling.
Repudiating lawless, unconstitutional actions *is* upholding the law, wherever those actions originate. Judicial supremacy is obviously a ridiculous and dangerous expedient, whose adoption was understandable but whose pathologies have now outgrown its benefits.
It's no different than the other pathologies that have eaten away much of America's unique and hard-won civic culture: irresponsibility has led to fiscal insolvency, race-guilt has led to racism being institutionalized instead of shunned and eliminated, etc.
Mindlessly mumbling "but, but 'rule of law!'" when defending something that was no more than a practical expedient - judicial supremacy - is like pretending those other cancers aren't destroying the civic culture.

The win in SD Texas and the Fifth Circuit was not on the merits. It was on the Obama Administration not following the Administrative Procedures Act when it issued DAPA. It is of no use with DACA. The states still could win, but Texas v. US will not be useful as a precedent.

be a judge, and simply declares his act to be legal, then it is the law,
and you are forced to comply. You are not permitted to defend yourself.
You must take him to court and appeal his decision that he is innocent,
and hope for the best.

It doesn't work that way in real life.
The Judge was appointed and confirmed to rule on lawsuits by the system we live under he is not some criminal breaking into my house. There are laws dealing with that.
If you don't like it, change the system or the people controlling the system like we did twice since 1776, but don't make false equivalencies in my name.
There are procedures to get rid of the Judge.

The legislative branch is either leftist/beholden to special interests (D) or impotent afraid (R)
The executive branch is dysfunctional and actively subverts the president
