Federal Judge, Get This, Blocks Enforcement of Democratically-Passed Texas Sanctuary City Bill

The Optimates have decided the public is no longer permitted to pass laws of their own devising.


U.S. District Judge Orlando Garcia blocked portions of Senate Bill 4 (SB 4) requiring local law enforcement departments to comply with federal requests to hold unauthorized immigrants in custody. Also blocked: a provision that stopped local departments from implementing policies that would "materially limit" enforcement of immigration laws, the Dallas News reported.

Note that the state law imposes duties on state law enforcement. Specifically, it demands they comply with the federal law.

This judge -- Orlando Garcia -- decided that a state law demanding that state actors comply with federal law runs afoul of federal law.

An aspect of the law permitting police officers to ask about immigration status was not blocked, but the ruling did limit the actions officers would be allowed to take after learning that a person was undocumented – officers could only report the person’s immigration status to federal authorities.

Why? Why can't a state law instruct state law enforcement officers what their duties are?

Here's his "reasoning:"


In a 94-page ruling, Garcia wrote that there "is overwhelming evidence by local officials, including local law enforcement, that SB 4 will erode public trust and make many communities and neighborhoods less safe" and that "localities will suffer adverse economic consequences which, in turn, will harm the state of Texas."

In other words, illegal non-citizens don't like this so citizens are no longer permitted to pass laws that citizens prefer.

"The Court cannot and does not second guess the Legislature," he continued. "However, I'm a-gonna do it anyway. YOLO, bitches."

I made up the last sentence, but pretty much that's the spirit of it.

well, you understand how the thinking goes. You just ignore that all nations are marked by their own particular mix of ethnicities and religions and that by definition each nation is different, thereby meaning that any one nation wants to hijrah to another, there's a mismatch of religions and ethnicities.

To US judges, this means that all imigration law is racist because, well, up until 23 years ago or so, the usa was 80% white.

I believe this was debated in the legislature, and this was the point the opposing side tried to make. That point was voted down. The lawmakers took that point into consideration and decided to go with FEDERAL LAW.

Its an amazing trend and the reason for the trend is there are just so few consequences for getting something wrong and getting reversed at an appellate level. It used to be that a reversal was humiliating and could seriously adversely effect a judge's ability to rise in the ranks but nowadays, judges seem non-plussed by reversals and if they have the right politics (ie if their rulings, however wrong and in contrast to the law, signal the right kind of virtue- see the 9th Circus and Hawaiian judges) then being wrong constantly is actually a resume builder, especially on the federal bench, with a liberal picking the judges.

How would that work? The ball theoretically is in the President's court, but like trying to deal with a bureaucracy that is insubordinate and traitorous, how can he say "I'll see you in court" when the court is so obviously part of the same traitorous insubordination.

Arpaio's lawyers asked her to vacate some other crap that was pending, and they also asked her to set a hearing date. The judge basically just complied with their request.

These are lawless rulings wherein courts are usurping executive AND legislative power - THAT is the chaos.

Only congress can do that, and only with federal judges. State judges, their legislature usually has to (with impeachment) which is almost never, ever used. In the whole history of the United States, over thousands of judges, only 15 had been impeached, and of those only 4 thrown out of office (3 resigned).

That's out of more than 3000 federal judges since the USA was formed.

Impeachment is only a grand jury, it doesn't remove them from office. It decides if a court trial is justified to do so.

Mississippi and Arizona's challenge to DACA failed due to their being unable to show an injury to the state that would give them standing. When Texas challenged DAPA, the state had real, concrete evidence that they would be injured, so the preliminary injunction in the trial court was upheld on appeal. It was sitting at the Supremes as of November 8, the Supremes did nothing awaiting the outcome of the election, and the cert petition has since been withdrawn by the DOJ (you know, do-nothing Sessions).

The suit is ready to go. The deadline to pull the trigger is 09/05. If the open border advocates file suit to stop the revocation of the illegal Obama EO the states can still file suit on the basis that they already won in Brownsville and the Fifth Circuit. It could be a lot of fun seeing federal judges from different jurisdictions go at it.

I would guess they could come back with a showing of standing. The defeat wasn't on the substance.

Note that the PI against DAPA wasn't on the substance either. It was based on the Obama Administration not following the Administrative Procedures Act by giving notice and taking comment before issuing the DHS Secretary's memo that created the program.. There is no indication how the substance would have gone, if it ever got to that. Courts are surprisingly deferential to Presidents not named Trump.

The SCOTUS refused to hear the fired judges complaints, stating that Jefferson could do it to them as well ( decrease the size of the SCOTUS to 1, then increase it back to 12, and appoint 11 new justices ).

439 Impeachment is an utterly impractical approach to restoring rule of law.

Administrative fixes (dividing the 9th Circuit) are irrelevant to the problem, which is the disappearance of integrity, and the conversion of courts into unelected ruling tribunals (not accountable to the constitution, the law, or the people).

Restoring/creating integrity is, historically, a somewhat magical process, which distinguishes the few countries/cultures that have done it, from the majority. If we could bottle it, we'd have had more success in our foreign aid programs, which have spent lots of effort (not much $) on precisely this sort of thing.

As a practical matter, administering a wake-up shock to the system would be best - ignoring a lawless judicial ruling.

Repudiating lawless, unconstitutional actions *is* upholding the law, wherever those actions originate. Judicial supremacy is obviously a ridiculous and dangerous expedient, whose adoption was understandable but whose pathologies have now outgrown its benefits.

It's no different than the other pathologies that have eaten away much of America's unique and hard-won civic culture: irresponsibility has led to fiscal insolvency, race-guilt has led to racism being institutionalized instead of shunned and eliminated, etc.

Mindlessly mumbling "but, but 'rule of law!'" when defending something that was no more than a practical expedient - judicial supremacy - is like pretending those other cancers aren't destroying the civic culture.

The win in SD Texas and the Fifth Circuit was not on the merits. It was on the Obama Administration not following the Administrative Procedures Act when it issued DAPA. It is of no use with DACA. The states still could win, but Texas v. US will not be useful as a precedent.

There are procedures to get rid of the Judge.
