Supreme Court Offers Muddled Response to Hawaiian Judge's Judicial-Fiat Rewriting of the Travel Ban

The Hawaiian judge made a couple of rulings. First, he found that the government's definition of a "bona fide relationship" to a US citizen was too restrictive -- limited to parents, children, siblings and spouses -- and opened it up to... practically everyone.

Watson subsequently expanded the definition of "bona fide relationship" to include grandparents, grandchildren, aunts, uncles, nieces, nephews, cousins, or siblings-in-law.

Then he claimed that the US could not limit immigrants who had a "formal assurance" from a refugee assistance group. Which seems to me to be something he just sorta made up on the spot.

The Supreme Court blocked that second ruling, but seems to have made no judgment on the first -- for now. The case will continue to be litigated at the Ninth Circuit Court of Appeals, which has well-earned its nickname of the "Ninth Circus." After that, the Supreme Court will have the chance to review their ruling as well.

The Supreme Court did decline a DOJ request for a clarification of the Supreme Court order putting most of the travel ban into place -- about what they meant by a "bona fide relationship." What does that mean, exactly?

A lot of outlets are reporting this as some sort of victory for the left. I don't think so. I think the Supreme Court routinely declines to decide until the correct procedural moment for deciding, which in this case would be after the Ninth Circuit's review.

However, they could have struck the Hawaiian judge's order on this point down, but declined to do so.

But perhaps that's because they thought the issue was currently moot -- as the State Department, of course, has rewritten its rules of who is permitted in under the "bona fide relationship" exemption to include all the distant relations the Hawaiian judge ordered.

Thus, at this moment, there really isn't a bona fide dispute over the question, which is something essential for a Supreme Court ruling, particularly on an emergency basis (as such injunctions are).

All in all, basically a rap against the Hawaiian judge, with additional questions put off until the Ninth Circuit writes up its completely error-ridden opinion.

SCOTUS didn't spell out "bona fide relationship" to a US citizen. Normally courts defer to agency interpretations if they're not crazy, but not here.

Probably me, but where in the pertinent legislation does it talk about the president's power to restrict entry to the country being subject to exemptions and bona fide connected persons and the price of tea in China?

The only, slim hope is that the judiciary (reasonably) takes this whole saga as confirmation there are now absolutely no limits, no usurpation or lawless act too audacious or injurious, that they can't give it as shot. To the point that Trump, who at that point would appear to have been put in the job for precisely this purpose, finally says "no" and repudiates the judiciary's ravaging of the constitution.

I said slim. We'll get the first thing, or a lot of it, but probably even Trump won't be able to bestir himself to restore the constitution and rule of law. There's nobody with any profile or influence who does other than to work within the insane, lawless make-believe world of the executive and legislature subordinate to the courts.

It wouldn't stop it all together, but it *would* reduce the impact.

Like the Federal Reserve Districts, Circut Court Districts are from a time when the population was mainly concentrated in the Northeast USA. The 11th Circut forthe Southeast USA was long overdue, for that matter.

I took my Nephew and his roommate from Hawaii to a Supermarket near me and it was like I took a Soviet refugee to a grocery store, he flipped out on the price of Milk, Butter, Beef etc it was amazing to see. I was helping them move into there Dorm room and they needed some food. It was eye opening.

In general, Congress has the given the president the power to limit immigration by groups he deems a threat to US security. The SC really can only say he isn't following the law and not rule on the Constitutionality of the issue because Congress has full power over immigration.

Any SCOTUS opinion that puts any question about POTUS's plenary authority on immigration is wrong, and is an affront not just to POTUS authority but also to the authority of Congress, which delegated its express Constitutional authority to POTUS in the first place. So this is not the place for SCOTUS to put a check on POTUS.

Rhomboid argues against SCOTUS ever being a check on POTUS, which has been part of our Constitutional scheme IN PRACTICE for over 200 years (since Marbury v Madison).

Else we'd have it OK for Presidents to seize factories when they felt like it, or round up citizens without adequate cause, etc, etc.

That's kind of like what Italy is doing. Overrun by "migrants," thanks to Frau Merkel's open door policy (which she has doubled down on, saying she refuses to put any limit on the number of "migrants" Europe will accept), Italy is threatening to issue all the "migrants" that show up on its shores with Italian visas, so that they can then "migrate" to other, more welcoming countries in Europe (and get the hell out of Italy, which doesn't want them).

I hope Italy does it, and that all the "migrants" set up residence in Berlin and demand their lifelong welfare hand-outs from Mama Merkel and her magical money tree.

And it would be only fitting for the Trump administration to fly a few thousand (or more) muzzie "refugees" to Hawaii and let the Hawaiians provide for them, since they're so damn eager to welcome them.

I thought those relatives were not even eligible for visa petition by American (naturalized) citizens at all.

Also, extending to those relatives from a heavily inbred culture with poor official records (those on the list) leaves the whole damn country eligible for relative visas.
