Charlie Gard Granted Permanent Legal Residence in US for Treatment, but UK Doctors Still Think He Should Be "Permitted to Die"

The judge-appointed expert attempted to explain to his UK doctors why he thought treatment was viable and should be attempted-- but they still want to pull the plug without all that "first do no harm" baggage weighting them down.

The digest from the Daily Mail:

Charlie has been given permanent US residence so he can fly there for treatment

Connie Yates and Chris Gard release photo of Charlie 'looking' at a colourful toy

Charlie Gard's doctors are still convinced that he should be allowed to die

The medics failed to be persuaded by American neuroscientist Dr Michio Hirano

Dr Hirano had spent five and a half hours trying to talk round Charlie's doctors

The governing board of Great Ormond Street Hospital in this case are acting as a Death Panel and demanding that this child be killed.

52 I have a good friend who keeps bees. One stung him about a week ago and within 24-hours he was having problems with vertigo and nausea. Never happened to him before and he's been stung plenty of times in the past. Met over the weekend with a husband and wife - both MDs and both beekeepers. Told them each, separately, his story. One MD said "almost certainly an allergic shock reaction" while the other said "almost certainly NOT an allergic shock reaction".

Taught him something I learned a long time ago - most folks with MDs, despite their arrogant know-it-all attitude, basically don't know shit. My MD - good man, good Christian - admitted as much to me as I noticed him typing away during an office visit on his Professional Version of WebMD. His admission was that most "modern medicine" is basically nothing more than the science of big data sets. They use "best practices" and expect "typical results".

Medicine used to be called "medical arts" and used to be practiced by local folks who made housecalls and were very up-front (for the most part) about their limitations. Now? Seems that Big Medicine has a bit of a god complex, these people are making life-and-death decisions for people using essentially the upgraded version of what you or I could pull from the internet for free.

Apologies to all the MDs on this thread, I mean no offense. Just calling it like I sees it.

Exactly this.

The parents want to try a desperate experimental treatment that they know has a .000000001 percent chance of helping. They raised the money to pay for it. There is literally no reason in the world for the courts to stop them other than to reiterate that your very body belongs to the State.

Here's the thing. And this is an awful, terrible thing. Even if the treatment fails, which it will, it will still generate data which may serve to help people in the future. It's not just this child that the court is harming, it's future children as well.

Also everyone knows why the hospital will not let the parents take him home. If they do, there are many people who will help them flee the country with him.

126 >>Why does the UK government want to deny treatment to little Charlie?

Because they can't admit that their system is flawed. This is a high profile case, largely because the patient is a baby, but people are denied treatment in the UK all the time. Mostly older people who have outlived their usefulness.

Any government controlled system has limits and rationing. The "principle" at stake here is who should receive those limited resources, a patient with very little chance of surviving or someone with better chances. If they let him go it will expose the simple truth that free markets provide better solutions and they can't have that.

Palin accurately if not very articulately hit on this years ago and was roundly scorned for it. She was right of course.

My mom was born in 1943 in London, right in the midst of WWII. She was premature and weighed a pound and a half. The doctors thought she was dead, and when she wasn't, they figured she'd almost certainly die quickly. Still, they cared for her.

She didn't die, and just turned 74 in April.

Had she been born today, they'd have cut her open and harvested her organs to be donated before she even had a chance to open her eyes.

I don't think that the other eight judges get involved when one judge refuses the case.

138 "My understanding from my reading is that health care in the UK is perfectly fine and caring and advanced right up to a certain level of care."

That "certain level" is not very high, for some patients.

Consider that PSA screening for prostate cancer in middle-aged and older males came in as a regularly recommended thing in the USA back in the 1990s.

It didn't take long before there was a sharp and definite improvement in five-year survival rates for American prostate cancer patients. Early diagnosis matters.

The UK NHS never funded routine PSA screening on the grounds that it hadn't been proven to be cost-effective overall, and they still haven't approved it for regular use.

As a result, the gap in five-year survival between America and Britain has become a chasm.

164 I was stationed in the UK about 35 years ago. When I was pregnant with my oldest spawn, I came down with bronchitis and was admitted overnight to the Air Force hospital at RAF Lakenheath. My roommate was a British lady, a military wife who told me in no uncertain terms that the NHS was ALMOST as good as going to the local witch doctor. Almost. Said that it was no secret that lots of British girls married Rich American GIs for the health insurance. And that was a long time ago. I can only imagine how much worse it is now.

165 "[NPs] are taking over all primary care functions."

NPs, and the imported wave of IMGs, international medical graduates, fresh from dirt-floored "medical schools" in the Third World.

By the way, did anyone here note the names of the doctors in the huge illicit-opioid-prescribing and Medicare/Medicaid-defrauding scheme that was busted up in Michigan recently?

Among those indicted were Dr. Mashiyat Rashid, Dr. Yasser Mozeb, Dr. Abdul Haq, Dr. Tariz Omar, and Dr. Mohammad Zahoor.

Golly, it's almost as though there's some sort of, y'know, _common thread_ amongst these names. But I just can't quite put my finger on it.

170 T: I love the doctoring of language in that Daily Mail headline. "Allowed to die."

Also, why stop there? Everyone in hospital needing intervention is being "allowed to die" or "allowed not to die". Absurd wordsmithing there to cover up a failed and inadequate health system.

Which is, of course, the point. Charlie is not a patient; he is a political pawn.

6 years ago a periodontist told me I needed $16,000 worth of surgery not covered by my plan, or all my teeth would start falling out within a year.

I got a second opinion, which consisted of, and I paraphrase: "Is he f'ing kidding?"

6 years later, haven't lost one yet.
------

That is a common occurrence. I've known two people, one very recently to whom that happened. Went in to the dentist because he was having headaches - no dental issues whatsoever.

The general dentist said I can't touch you until you see a periodontist and have these major, painful deep cleanings. (Again, no complaints of dental issues, mouth pain, bleeding, etc.)

So, he goes to this periodontist who does this hellacious cleaning up under the gums with a drill-like device. The pain after was so excruciating, he couldn't eat for MONTHS. Then on the follow up visit, she says he needs all these skin grafts on the gums or he's going to lose all his teeth.

I told him that I wouldn't go back and that I thought she was a quack. I think I got through to him.

240 The U.K. medical establishment does not want this to happen for one primary reason: even if it fails and the baby dies, it would open the door for public outcry and demands for alternative treatments that the National Health can't afford or simply doesn't want to pay for. That's the main reason behind the resistance.

That, and the communists' innate love for imposing arbitrary death upon faceless others.

My father was in the hospital last October due to vasculitis. After all these tests, they bring in a nephrologist who says that he's in Stage V kidney disease and needs dialysis.

I've worked in hospice for nearly 20 years and have seen a lot. I told my parents that I don't think he should go on it because once he does, it'll be downhill from there. They refused the treatment which pissed off the wise Latina nephrologist.

Lo and behold, here we are today and he's doing pretty well and his kidney function has vastly improved. I do think the chemotherapy they used to treat the vasculitis fucked him up though.

I think it's part of a very large equation, there are lots of reasons Europe was and is so effed up.

I mean, just in that context, the cultural shift of the fact that WWI confronted entire civilizations with the fact that they had industrialized mass slaughter basically gave them civilizational PTSD. On top of losing so many people. The gene pool is part of it, but only part.

Of course, part of their solution to the first war led to the second, though not in the way some people think (the collective ideas that would supposedly save them were the larger motivation).

TOTALLY different.

The Fabian socialists started in the 19th century. The basic philosophy was "patience, patience -- socialism will arise naturally if you just wait for humanity to evolve toward it." The Frankfurt school was a post-WWII movement to intentionally degrade the concept of morality so as to accelerate the collapse of Western civilization.

Couldn't get more different when it comes to "socialist philosophy."

You mean like this:

"But even if you are not subject to immigration control (where you could use other methods of identity, like a photo driving license), your airline may insist on you using a passport at check in, and may not carry you without one.

The problem is, even if Irish or British citizens don't need to use a passport for travel between the two countries, other travelers with other citizenship on the same flight technically do need to show a passport, and comply with immigration rules. If the traveler is an EU citizen they have a right of entry to either Ireland or the UK anyway, but have to prove EU citizenship. Other nationals from non-EU countries may need to be in possession of a valid visa. So there may be immigration controls, and it is much easier to show a passport if you have one than to worry that your other chosen form of identity is sufficient."

Pretty much one and the same. The Fabian Society begat the London School of Economics which was the scene for the famous Hayek vs Keynes debates.

Hayek eventually left the LSE and wrote The Road to Serfdom, largely as a repudiation of that school of thought and a warning to the US not to go down that road. Not enough people listened.

314 Speaking of Hayek, I've posted about Hayek and his book Road to Serfdom before.

Reagan, a closet intellectual, was a big fan of Hayek. Hayek is mostly ignored by American academics today, because he's contra the current left-leaning academic narrative. His mathematical economic work is at odds with current Keynesiasm (Keynes wouldn't be a Keynesian by today's standards).

Hayek had a simple argument in his Road to Serfdom: in addition to being inherently coercive, central planning is sub-optimal because it's not as good as free market pricing at processing information in order to make informed decisions. Even when bureaucrats are smart and well-intentioned, they don't always have all the information they need. If they do have sufficient information, they get overwhelmed by it. Free market pricing wins every time, with the exception of the occasional grand military-oriented project.

An extension of this idea is that bureaucrats don't like change and won't admit to making mistakes. Compare the private sector: even monopolistic companies that don't change and won't admit to making mistakes will eventually fail.

These basic principles explain why the Soviet Union fell. It was part of Reagan's plan.

If you understood Hayek, you'd have known that ObamaCare was doomed to fail.

The book itself is a bit of a slog because of Hayek's academic style. You can find a Reader's Digest summary version online, which I recommend. This summary version was read by millions back in 1945, when we had far fewer people getting higher education.

317 >>52 I have a good friend who keeps bees.

I understand from a purely bean crunching point of view not wanting to spend money on what you think is a lost cause, not wishing to continue to use resources to keep a doomed child alive until he can get treatment, as ghastly as that is. But I don't comprehend refusing to allow them to move the child to another place for treatment which would then cost them nothing.

I can't help but wonder if they are afraid they'll be shown up as incompetent, uncaring, or simply wishing the kid to die and be off the system when he could be saved because its too expensive. I'd like to believe that's not what is happening but what other explanation makes sense?

I have to assume one of the types of senility that affects short term memory. This "fixated idea" kind of thing seems to be kind of common. Woman is so *out of it* that she can't attribute her eye pain to anything she has done, but has this idea "well, it's time to put my contact in", but since she can't remember having done so, she does it over and over and over.

It's the same phenomenon that would relate to seniors overdosing... or in the more rare circumstances, that woman who ate a whole bunch of staples.

380 >>I don't understand why the UK health system is so furiously determined to prevent this kid from even being seen by outside medical experts, let alone treated somewhere else. I just don't get it.

Because it isn't really about this child, it goes to the fundamental choice of government control vs free markets.

The treatments being offered to the baby are not available in the UK and certainly not covered by the NHS. If they start letting people become comfortable with the idea that there are better treatments available in systems that aren't top down government bureaucracies, there is a danger that people will start demanding those very things. And that would be a disaster for them.

This case is a camel's nose in the tent. Must not let those pesky camels in the tent.

Why do school principals argue with parents about bullying, poor teachers and carrying medicine?

Why do government agencies double down on useless policies and spending?

Why do police sometimes shoot innocent people to death and get away with it?

A: For the same reason Obama would pursue policies even if it were proven that they would not work and would be detrimental; he said 'fairness'. In truth, it is arrogance and an unwillingness to cede power. To be seen as being wrong.

Democratic assemblies cannot function as planning agencies. They cannot produce agreement on everything - the whole direction of the resources of the nation. Even if a congress could, by proceeding step by step and compromising at each point, agree on some scheme, it would certainly in the end satisfy nobody.

360 I don't understand why the UK health system is so furiously determined to prevent this kid from even being seen by outside medical experts, let alone treated somewhere else. I just don't get it.

Point I failed to make is that "best practice" amounts to a weird combination of constantly evolving conventional wisdom, fad-driven initiatives and job-threateneing diktats. Which is not exclusive to education but if one is around the industry long enough, let 10 or so years go by and one sees prior scrapped initiatives resurrected, tweaked and repackaged as something NEW! AND! EXCITING! The bolder old timers always say "We tried this years ago when it was called ______ and we quit because it didn't work" but it don't matter because the district already paid through the nose to buy it.

402 One of the points Megan McArdle used to make during the ACA debates is implementing a system like the NHS in the US might not actually be cheaper, since it's all about the expectations people have.

In the UK it's considered perfectly reasonable for the NHS to tell you "Look, we could operate and take out your dad's tumor, and he'd probably live for a few extra months, but his quality of life wouldn't be very good and we don't have endless resources so we're not going to."

404 "Allowed to die" doesn't sound the least bit creepy or Orwellian.
It's in the passive voice not only to sound less active (and disagreeable), but to obscure the actor - and the verb choice is intentionally oblique.

This is quite deliberate, because they wish to conflate "Allowing Charlie to die (heartless jackholes murdering infant by omission)" with "allowing Charlie to die (actor wishes to die, wishes to be allowed)". The elision of all differences allows them to imprint the suggestion on a weak mind that Charlie really wants to and should die - or that the state acting on his behalf has made up his mind for him, justly.

Having stolen a base on whether people may "choose to" die according to their own will, the next step is *axiomatically* to erode certitude of will.

405 Jen, no, can't help you on the mechanics of the latest judicial lawlessness on the EO, but an efficient way to view it is: judicial coup status ..... intact.

President was completely - and obviously - entirely within his authority to pause/limit/etc. admissions to the US, based on national interest, in a discretionary manner.

Courts simply usurped that power - and they're really doing donuts in the front yard of the Rule of Law, and the constitution, by not just denying a president the ability to exercise his lawful authority, but jumping in to legislate new aspects of the relevant law (there are no actual or implied exceptions of any kind anywhere in the pertinent statutes).

That's the romantic ideal, certainly from Mrs. Miniver. But the Small Boats are over-hyped. Lots of the ones used were seized from their owners and most of the evacuation was performed by the RN.

Honorable mention for the Miracle at Dunkirk goes to the Hitler and Von's Kluge and Rundstedt. If Guderian had his way, been much less romance.

450 I think it's even worse than WWI. Every guy with an ounce of courage or a lick of sense emmigrated out of Europe, THEN an entire generation was killed in WWI plus a crapton more with the Spanish Flu. The children who had been conceived before WWI were then killed in WWII. The whole shithole went full socialist out of fear not learning a thing from WWII statist tyrannies.

These are their children and grandchildren and great grandchildren. Genetically, they're as picked-through as the survivors of the plagues where only those with a natural resistance to it ended up surviving to breed. Except in this instance it wasn't the hale, hearty, and brave to survived, it was the opposite.

To be fair, but on the odds, baby Gard is probably not only deaf and blind, but incapable of developing a coherent conscious stream due to both impaired neural development
and active neurodegeneration. The reality is that even if (and it is a big if) therapy works, this will still be a neurologically devastated child. THAT said, I think the parents should be given a shot. It isn't known to be futile, and it isn't abusive. I'd be surprised if it works, but really, who cares: the fact is that it is being offered by a reputable physician, and it is not known to be futile.

Although I often disagree with Charles Krauthammer , his opinion on this, based on his background as a psychiatrist and as a paraplegic whose own experiences with being intubated for weeks is not something he would wish on anyone really puts this entire episode in perspective.

He personally doesn't believe the that the child will live once he is taken off life support and doesn't believe there is any miracle treatment for the child and he said he was disgusted by doctors who are attempting to make a name for themselves with offering such treatments. But he said that it should be up to the parents, who have the best , least bias interest in the child, not the state, which has no interest in him, and has no relationship with him either.

Do you remember that little kerflufflle called WWII where thousands of American boys gave their lives to save you Brits from Adolph taking over your country? Good I knew you would. Now the way I see it you Brits owe us one and I'm cashing in our chips for little Charlie. I'm sending my private plane over with Melania to pick up little Charlie and his parents. And you are going to have your personal security team go over to the hospital and escort them to the airport, okay? And oh by the way, also on board my plane will be a team of Navy SEALS just to make sure there are no problems with any of the NIH witch doctors that think Charlie should be permitted to die, kapich? Good, I knew you'd see things my way once I reminded you of the whole Life, Liberty and the Pursuit of Happiness thing we hold dear to our hearts on this sid of the pond. Bigly. Great talking to you Queen. Tell little Charlie I can't wait to see him when he arrives in the good old US of A and I'll have a team of the very finest doctors on the ramp to give little Charlie a chance at life, however small it may be. Bye now and say hi to the King for me, okay? Gotta go...

489 . In truth, it is arrogance and an unwillingness to cede power. To be seen as being wrong.

That certainly has to play a major part. Doctors tend toward this anyway, and doctors given the power over life and death by the state in an already feudalistic society? Yeah.

I'm inclined to agree with him. On the other hand, if the parents have the money and are willing to pay then its none of the state's business to say no.

Posted by: Christopher R Taylor at July 19, 2017 03:30 PM (39g3+)

491 Jen, yeah the brain damage (possibly prolonged by doctors not allowing alternate care) is worrisome. But it should be the parents that decide, like Krauthammer said.

There were parents in Utah that refused chemo for their kid, despite all medical and public outcries that he should do it. The state tried taking the kid away from the parents do they give him chemo but was eventually denied. If I remember correctly the kid survived just fine without chemo. Even if they think the parents are crazy, it's their kid. They should have final say on their care.

492 Funny... I remember this same exact issue playing out a few years back in California. Brain-dead girl after a bizarre complication during routine tonsil surgery. Parents refused to accept that she was brain-dead.

493 Re: Why Europe is, and always will be, a mess.

Imo, it wasn't the mass die off of any particular war.

It is because of the European mindset. Europeans are simply not capable of accepting a non Totalitarian government system. European mindset demands someone tell the individual what to think because the individual European does not want to think for himself. Ever. On any issue.

All the European governance philosophies since the "end" of feudalism have been all about flailing around in an attempt to invent a new form of feudalism. The only real differences between any of the philosophies of governance is about who is established as the new aristocrat class.

494 UK health should admit that they are not going to let baby Charlie get an experimental treatment for the simple reason that they cannot risk being pressured to pay for that treatment for the next baby with that disease.

But of course every government health board aka death panel hides behind the veneer of "it would be wrong to prolong suffering" and blah blah blah.

Funny, but hypoxic ischemic brain injury is a very well defined clinical syndrome, so it isn't really the same issue, unless you are a clueless fuckwit.

My bet is that if you are playing the race card here, and you are, you are probably a clueless fuckwit. So the question is: how did you manage to grow up into a clueless fuckwit? Humans are naturally such a gifted species, and here you are, a stupid twat, reduced to starting empty headed posts with the whole millenially moronic "Funny..I recall derp derp derp....." shit schtick.
