8 I posted on this earlier yesterday. Sessions put a whole lot of restrictions on this to prevent the abuses that went on before. But the only way to really prevent abuses is to not allow it at all until conviction.


I have hoped for a long time that some judge would strike this shit down but no luck so far.

Even if it has to do with drugs, the government should have to prove beyond a reasonable doubt that the owner committed the crime and that the property is in fact proceeds of that crime. Until that point they can fuck off.

amen to that. some were defending the minnesota cop's decision to kill the woman because the cop might have thought her phone was a gun like that magically makes it a good shoot. and to be specific they weren't defending it on whether it was a criminal act, which could be argued one way or the other, but that he shouldn't necessarily lose his job for fatal fucking incompetence if he had good intentions. 70 I've said it before, and I'll say it again: people who think hard drug use is a victimless crime probably never had a junkie in the family. Still, I'm having a hard time continuing to support the war on drugs these days. So much of what passes under that banner seems wasteful, both in money and human toll.

Asset forfeiture without a conviction or even filed charges is evil, however. If this doesn't get halted by the courts, it will someday be adjudicated in the streets. Eventually, I fear good cops will pay the price owed by the abusers of this travesty.

I think the Supremes will put a halt to it, if ever a case gets there.

It seems to be the Feds asserting a right to seize assets from localities that have already stolen the assets from citizens if there's any nexus to a violation of federal law.

78 Yeesh. Even I don't see where he's going with this. Literally every administration priority served with this- drugs, immigration, etc- could be better served some other way.

About the only thing that makes sense is using such a law as a pre-emptive strike against criminals, but again, none of the prerequisites for Total War are met yet.

Very disappointing, and that's coming from someone who thought Sessions was a huge net plus to the ticket.

I think you're right. It seems to say, paraphrasing heavily that property lawfully siezed by state/local authorities under their state laws can be grabbed up by the Feds if the actions resulting in the seizure violated federal law. It's still shitty but not quite what the tweet says.

If the issue is drug dealers' elicit gains, why not just levy heavier fines upon conviction?

There is absolutely no justification for allowing the police to steal property because they think the person with it might have committed a crime.

We've got this odd trend where rather then creating heavier punishments with stringent ground for conviction we are making it far easier to convict people for things but then reducing the punishment.

Are they also stating they will release the assets back to their owner if siezed illegally?

106 If you read the document, it looks like the directive is to turn over seized assets to the Feds - not to encourage more of them. I think they want to remove the financial incentive for the local police to just grab stuff, since the police won't get to keep it anyway.

That was my impression. Try as I might, I couldn't find the part where it authorizes forfeitures "Even in States Where the Unconstitutional Practice is Banned by State Law." But I did see language about "in compliance with state and Federal law."

To my knowledge there has been only one case taken to court for asset forfeiture. And that was case AFTER conviction. There has been no case taken to court for taking assets w/o conviction, much less no charges even being filed.

There have been court battles by victims to get their assets back. And in almost all cases they did get their money back, but not always all of it. None of those though have gone to SCOTUS. and they had to pay the legal fees.

There is absolutely no justification for allowing the police to steal property because they think the person with it might have committed a crime.

We've got this odd trend where rather then creating heavier punishments with stringent ground for conviction we are making it far easier to convict people for things but then reducing the punishment.

Christopher, I'm not going to disagree with you, but I will say that I believe that, rather than going after those who have broken the law and expect (in some way) to be caught and punished, Sessions would do himself and the DOJ a great favor if he would prosecute high-ranking criminals like Lerner and Scankles and their ilk and prove that the law still applies to the highest in the land.

The cameras are always on. There's 30 seconds worth of video in the camera buffer. When you turn "recording" on it includes the previous 30 seconds in the camera buffer.

Alright - let's establish a few things - first, civil forfeiture has been held constitutional under certain circumstances but is, as far as I am concerned, only a borderline constitutional practice even when used appropriately (i.e where there is also an accompanying criminal indictment and the assets are directly implicated therein). It is rife with abuse and fascistic over reaching, particularly by State and local authorities - and should be curtailed wherever possible.

That all being said - this letter - does not expand current Fed practice and in some ways may curtail States from abusing. The letter certainly does NOT have anything to do with the idiot CBS MSM'r's headline - which was my point.

I may be somewhat disappointed with Sessions - but it is NOT because of this stupid letter. Can we talk about meaningful issues as opposed to some made up MSM BS please?

AG Sessions said on Monday this is mainly designed to seize property of drug cases.

I know of one case this year, involving gang-banging murder and drugs...where the house they were squatting in was titled to a long dead person. It was in a bad neighborhood and no one cared. Think of the empty houses and apts in squalid and not so squalid neighborhoods. Where gangs come and go and do their deals. I just read of this a month ago.

I am concerned, as well, of the properties being snapped up by foreigners right now in the US market.

A few years ago, the "worst house" in neighborhood was owned by someone from Turkey. Very dicey characters, children having DUI's and speeding and dope. A party, til it was reported to police, with drug activity and public nekkidness. House completely falling apart til several foreclosures (you betcha this was bought during the Fannie/Freddie mortgage heyday. And this was in a very nice neighborhood.

So I am going to wait and see. If it is drug stuff like I mentioned above, I don't think someone is going to drive by my house and think, "Wow, like this one! Let's accuse the owners of drugs and take their property."

As much as the MSM wants people to believe this is Venezuela under President Trump, I don't think we are there yet.

Anyway, I am no lawyer,just an aging supermodel, so what do I know?
