Supreme Court Rules State Cannot Discriminate Against Religious Schools

Gorsuch strikes twice.

The case involved grants made generally available to all schools in the state for refurbishment of run-down playgrounds. But then the state ruled that, while these funds were appropriated for all schools, religious schools nonetheless had to be affirmatively discriminated against, because you can't have government money ever going to icky religious schools (even if the money is not specifically to advance religion, but is just another state boondoggle of taxpayer cash for hard-to-argue-against feelgood spending programs).

Gorsuch and six other justices said Nah, brah.

The justices ruled 7-2 that Missouri stretched the constitutional separation of church and state too far by declaring a Lutheran church ineligible to receive a competitive state grant for playground resurfacing. The decision could have implications for more than 30 states that block public funds from going to religious organizations.

Chief Justice John Roberts wrote the decision. Only Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented.

Even though the state's denial of funds likely would lead only to "a few extra scraped knees," Roberts said, "the exclusion of Trinity Lutheran from a public benenfit for which it is otherwise qualified, solely because it is a church, is odious to our Constitution all the same, and cannot stand."

...

"It does seem as though ... this is a clear burden on a constitutional right," liberal Justice Elena Kagan said then, in reference to the state's refusal to treat Trinity Lutheran Church equally to other non-profits seeking state grants. The church had met all the neutral criteria for the program.

Gorsuch and Justice Clarence Thomas would have gone further than Roberts, who suggested in a footnote to the court's decision that the case "involves express discrimination based on religious identity with respect to playground resurfacing. We do not address religious uses of funding or other forms of discrimination."

Gorsuch wrote: "The general principles here do not permit discrimination against religious exercise -- whether on the playground or anywhere else."

So once more: Gorsuch would have gone farther.

No John Roberts taint on this one.

I don't think they were saying that grants are a constitutional right. I think they were saying, parochial schools are allowed to apply for any pertinent grants, and that they should not be denied access to grant money simply on the basis of religion. In other words, they get to compete alongside everyone else.

I think there's some preliminary research that those little rubber pellets you see on turf fields coming in contact with open cuts has a correlation to higher cancer risk.

They'd be one of 50 states trying to amend our current constitution.

No amendments (or changes in general) that have to meet the approval of 37 states is going to be hugely drastic, probably just some structural changes (like term limits).

It was a whole lot easier for the convention that eventually made the current Constitution to go off the rails and abandon the Article of Confederation for a few reasons, none of which are germane for today:

1) The Articles of Confederation were only about a decade old, as opposed to over 200, meaning there's a whole lot more reverence for our current set up than the previous one.

2) It's a whole lot easier to convince 8 states to do something drastic than 37.

3) The Articles of Confederation never really worked.

A church is running a school. The state has said "we have some money to help renovate school playgrounds for schools in need." Some private schools apply. The church school applies but is told "no, you are a church so bugger off."

I'm hard pressed to see how that's valid given the incorporation of the 1A.

Asked to explain why they would kick Jews out of their event, Dyke March organizers were unapologetic and unambiguous. The flags, they explained, “made people feel unsafe” and the march was “anti-Zionist.” Forget equating a piece of cloth with an act of physical intimidation, an illustration of the hysterical progressive rhetoric that likens speech to “violence.” There was nothing “Zionist” about the allegedly threatening flag (other than its containing the Star of David, which also appears on the Israeli flag). What made these people “feel unsafe” was the presence of Jews. Censoring this Jewish symbol, meanwhile, organizers were perfectly content to let participants wave the flag of Palestine, a political entity where LGBT people are routinely harassed and murdered."

What do you think would happen? 37 states would band together to make religious institutions no longer tax exempt? Or they roll back the 2nd amendment? Or that they give the EPA more governing authority than the President of the United States?

If we were to get an Article V convention, we'd probably see term limits and maybe a balanced budget amendment. I'd hope for something that limits the authority of the administrative state as well.

People who fear the Convention would end up laughing at it because they would fear things like, "Abortions are now punishable by firing squads" and instead they'd get "Senators can't sit in the same chair for more than 12 years."

Roberts apparently paid the mother to go to Central America and have the twins there. It's not a hanging offense, and I doubt that Roberts and wife would have been forced to send them back.

Roger that - the Virginia GOP being one case. Rest assured, the wishes of the governed really don't enter into their calculations much, until it is forced in and even at that it's grudging acceptance and adhered to with the absolute minimum of effort.

I have zero faith in the Virginia GOP to lead any kind of conservative effort in any kind of Article V convention. It's far more likely they will "compromise" with the Left to get some figurehead meaningless amendment heard in exchange for codifying a blanket "assault weapons" ban. And I don't doubt that there are other states who would do the same.

Yes, and surprisingly accurate historically. Prescott in his definitive history of the Spanish Conquest cites the horror of the conquistadors (and also the cannibalism the Aztecs practiced on leaders and warriors of other tribes, to gain their strength).

So it wasn't all grins and giggles before Cortez. In fact, the arrival of the Spaniards just catalyzed a general uprising by all of the surrounding tribes, all of whom hated the Aztecs, for understandable reasons.

It's amazing how few leftists grasp this. There were 300 conquistadors armed with muzzle-loading weapons, and a million Aztecs. If the other Indians hadn't helped the conquistadors, the first battle would have resulted in 999,700 Aztecs and 300 dead Spaniards.

Pretty much, most of the Koran is lifted from the Bible as Mo's limited memory allowed him, then filtered through Arabic culture, and shaped to allow him to be a conqueror. Just the Koran isn't nearly as awful as the Hadith and later stuff added on. Its a crappy religion but it got a lot crappier over time, where Judaism for example got a lot easier and less restrictive.

I choose to live in a pro-gun State, Indiana. Keeping the Fed out of our State Constitution, which enshrines gun ownership in stronger and simpler terms than the Constitution, means I never have to worry about that being infringed by the Supreme Court. As I understand it, Elem/Middle/High schools within a school district have different territory boundaries for the District therein, but the District as a whole is still what it is.

IIRC, traditionally many city school district boundaries followed city boundaries, until San Jose undertook rapid expansion and wound up with 34 different school districts in various parts of its expanded city, which became a court case, at least here in California it did.

Before then, there was a serious legal case to be made that State Constitutions should be regarded as being on the same legal level as the US Constitution, maybe even higher.

After 1865, these State constitutions have the same amount of authority as your local Homeowner's Association guidelines; which is to say that the only have the amount of legal authority that some higher level has decided to temporarily grant to them. State Constitutions only have legal validity to the point that they agree with and enforce the Federal Constitution. No more.

Bottom Line - when the SCOTUS rules that a part of any State Constitution is just pointless, unenforceable verbiage, that part becomes pointless, unenforceable verbiage.

Part of what really bugged the Europeans was the fact that by every other metric, the Aztecs were relatively "Civilized": City building, written language, complex states, etc. Our revultion towards such practices predate Christianity. It didn't matter who encountered the Aztecs: Spanish, Portugese, French, or English; they were gonna get fucked up. Human sacrifice and cannabolism is, to western civilization, a sign a society/nation "Needs Killin". I.e., the fact that the Aztecs weren't savages to the same extent as other tribes likely made the practice even more abohorrent. The only difference between Mayan Human Sacrifice and the Aztec variety was time period. The Aztecs were at their peak when Cortez came and the Mayans were no longer empire builders and had quit doing it. Oh, and the Aztec variant was arguably more fucked up, if such a thing is possible.

Go up the chain to the school superintendent, and if need be, go to the District Superintendent. You could also ask for a meeting with the Speech and Language Pathologist in the school where your child would attend if they were in public school. Ask for an evaluation. They must give you one. Upon the outcome of the evaluation, your child should receive a therapy plan in 4-6 weeks. (That's about how long it takes in Wisconsin)

Per here ... and most other shit I've ever read ... the 14th Ammendment has not a damn thing to do with this current notion of Incorporation - the primacy of the US Constitution over the States in all matters. Slaughter-House Cases in 1872 settled that shit - State Law was outside the purview of the Federal.

No ... this current tack that everyone loves because Our Favorite Folks got free shit started after ... as a work-around to the above. Really got going in the twenties.

But hey ... I get it. Hell - I always SAY IT. Republicans differ from Democrats only on the Ends. Not so much on the Means.

Sotomomayor benefited from Lemon and other court decisions which broke through the NYS Blaine Amendment to provide transportation (busses, subway passes), books and other religiously neutral goods and services to the students at Catholic (and other religious) schools on the same basis as students at public (and non-religious) private schools. Note that these benefits accrued to the students, not to the school itself.

The Blaine Amendments were the basest form of Anti-Catholic discrimination. The Mass Constitution specifically excludes the Blaine text from the initiative process that every other part of the Constitution is subject to. The non-initiative process for amending the Blaine text couldn't be satisfied if the College of Cardinals sat as the Massachusetts Legislature.

Parents have the right to request having their child evaluated for whatever concerns -- whether the team (which includes the parent) decides to evaluate is another matter. But if they're blowing you off, call and leave a message for the building principal that you're being blown off -- I guarantee that will get the sp. ed. supervisor's attention pronto. The LAST thing admin wants is someone contacting the district via a parent advocate/lawyer because the first thing out of the superintendent's mouth to the principal will be, "Why did YOU let it get this far?" even if the sp. ed. department dropped the ball.

Go to the principal.

We seem to have changed in 15 years. There was an issue with W. Bush's Faith Based Initiative to fund social services provided by religious organizations. Courts rules that OK at the time so long as there was no religious content provided with the services. Now, the Court is requiring states to include church -based organizations in grant programs if not for specific religious purposes.

Perhaps my interpretation is in error, but the Court seems to be requiring equal funding of religious-affiliated entities to a large extent. Seems like a significant change to me.

546 No. He court is saying that church schools cannot be excluded from consideration for funding by grants simply because the are a church school. If the grant is open to schools. It is open to any school. This doesn't immediately equal "state funding" of a church for two obvious reasons. 1) the school still has to apply and *win* the grant and 2) the money isn't necessarily going to the church, but to the school. Of course we have those here who rail on about how horrible public schools are and that they've just indoctrination centers. But DO something that puts private schools on a little more of n even keel and the sky is falling

547 RioBravo, you misunderstood the case and the decision, I believe. Missouri made a decision to allow free asphalt to all schools, public and private. They stated this publicly, to all. Many schools, public and private, applied. Trinity Lutheran scored 5th out of a large number of applicants, meaning that the met every published guideline for this program.

THEN Missouri stepped in and said "oh wait you're affiliated with a religion, we have to discriminate against you in a way that we will not do against any other non-religious public or private schools, therefore you are out, ONLY because of your religious affiliation".

The Constitutional Issue here is Equal Protection under the Law. The US Constitution has guarantees, most of which are in the Bill of Rights, which prohibit the Government from using different laws against different groups of people, ESPECIALLY when this is done for reasons of Race and Religion.

NO State may use it's constitution to take away Equal Protection under the Law without Due Process. Those judged to be Criminals, for example, can have their freedom taken away, but only AFTER an painstaking amount of Due Process.

The Court in this decision today did NOT "require" that religious schools receive any funding - that is a foolish misreading of this case. The Court ruled that Religious schools cannot be discriminated against SOLELY because of their faith, in programs where all other private schools are welcome to participate.
