Supreme Court Reinstates, Mostly, Trump's Travel Ban;
Dissenters' Argument Is That They Should Have Restored All of the Ban

The only limitation the court is permitting on the travel ban is for those who have a bona-fide pre-existing close relative in the country or bona-fide, established-previously business in the country. Such persons may visit the country.

But for all others, the Trump ban is back on.

Incidentally, the opinion doesn't even mention Trump's campaign statements, suggesting that the Court views this entire line of argument to be so illegitimate as to not even be worth a rebuttal.

This is a decision about a preliminary injunction -- the Court has struck most of the lower courts' injunction against enforcement of the ban down. But the case has not been heard in full on the merits yet. That'll happen later -- but it's not looking good for #TheResistance.

The resistance's greatest legal victory has been gutted, and not even Ruth Bader Ginsburg accepted its most extreme arguments.

On my quick read, Thomas, Alito and Gorsuch dissented in part because they would have gone further to uphold the EOs.

What the majority seems to have done is to decide that many of the plaintiffs have no standing, and left the rest of the case until the Fall.

So it's going the right way, even if slowly.

This is a ruling on preliminary injunctions (emergency actions). It's quite rare for SCOTUS to rule on these until there's a fuller hearing.

This is actually as good as we could have expected, in the circumstances.

At my last job, I was good "work friends" with our file clerk. One day she showed me a draft of a long complaint e-mail she was going to send to management.

After reading it, I STRONGLY, in no uncertain terms urged her not to send it. Left unsaid was, you're a file clerk. And not to sound arrogant, but this is a white-collar professional office and the complaints of the file clerk, even if every single complaint she had had merit, just wasn't going to be taken well.

She sent the e-mail, and she was escorted out the door 3 days later.

Dual Citizenship is another thing forced on us by the Supreme Court...

And has created nothing but trouble for us since that ruling, which was clearly unconstitutional, as the Congress was given explicit Jurisdiction over Immigration and Naturalization.

Note, prior to 1965 the ONLY Legal Dual Citizen, was Gen. Lafayette... who was granted it via a special Bill from the Congress of the US...

As this was the FOUNDER's who did this... its pretty clear what they meant by the whole damn thing...

The guy who said it to me was the same one who once was trying to loom over me about something (he's 6'7") and made the mistake of doing so while we were standing next to a flight of stairs. I remember it was a popular idea in the GOPe in the mid-00s that conservatives would be better served by picking someone who was effective, but not conservative, and would agree to specifically advance conservative agenda items in return for conservative votes.

When the GOPers were making this argument, it was not in good faith - they wanted to be able to drop even the pretense of Republican politicians having to pretend to be conservative.

Sorry, we're going to be two different nations when it comes to gun rights. There's about seven to ten states which are hostile to gun rights. The rest have nearly all moved to allowing concealed carry.

The anti states have a greater share of cities with high gun violence. From a practical standpoint (not a constitutional standpoint) I'm not sure if I want more guns in the hands of residents of these cities.

I think one fundamental sign of a good company is that it rewards not only the people that come up with ideas, but their managers (if managers are developing those sorts of people).

I took over a team at one point with two people on the verge of being fired and another very junior person.

By the time I left the team two of the three had been promoted and the third was at least no longer a problem employee...

It's magnificent and really calls out the other justices for not accepting the case. They compare how many times in seven years theyve reviewed First and Fourth amendment cases and then state there is zero for the Second and that is prejudicial and indefensible.

Why would "nice" reasons be required to restrict admittance to your house? If a country can be compared to my house I have no obligation to let anybody in particular in. I realize the comparison between house and country is not perfect.

I also remember a time, many years ago, when my brother and his family lived in grizzly bear country. Residents of the town were expected to leave doors unlocked in the event someone needed to get away from a bear.
This town was owned in entirety by Alcan Aluminum, so residents weren't actually homeowners.

This is a stay of the injunction. What they are saying is that until the case is decided on its merits, those with legitimate claims are allowed to enter. The opinion was very specific on the nature of the claims. Also, EO-2 (the modified one) said basically the same thing.

The big issue is that, unlike the Obama appointed dominated appeals courts of nonsense, they said NOTHING about the likelihood of the plaintiff winning on the merits. Zero, zilch, nada.

That they said nothing despite the very strong language of the appeals court decisions is very, very telling. If this is not mooted by October (likely given the ban is only from 90 days), the plaintiffs will lose, big time, big league.

I'm not sick yet of all this winning.

494 One thing that's not clear to me (and I have not read *all* the comments) - were the carve-outs for people with relatives/job offers/other "pre-existing relations" - for getting into the USA - are those a function of the original executive order and how it was written; or a function of the way the injunctions were written, or were those created out of the air by the SCOTUS? If the last option, then it seems the SCOTUS is engaging in policy creation, not in adjudicating. But if it's a function of the way the lower court decisions were written, or of the original EO itself, OK fine.

495 What is abundantly clear to me is that this Supreme Court has said "enough is enough"...they will try desperately to avoid 5-4 decisions in this political atmosphere. No doubt this was a 5-4 going the way of Gorsuch and Thomas but Roberts and Kennedy made a deal to make it 6-3 without having a long-term negative affect.

Their 'exception' that they agreed to will go out the door with the final ruling and offers no precedent on dealing with any other lower court injunction.

6-3, 7-2, 9-0.....lots of those decisions coming in the next couple years as it looks like the Supremes recognize the danger of the charged political atmosphere.
