Officer Jeronimo Yanez Found Not Guilty of Second Degree Manslaughter (and Unlawful Discharge of a Firearm) in Philandro Castille Shooting Death

As a commenter noted, expect this to be a weekend of riots and violence, alas.

The name Jeronimo Yanez does not scream out to me "White Supremacist Oppression" but they have intersectional sub-theories to explain how even a Jeronimo Yanez is upholding the White Power Structure, brainwashed or bought-off or otherwise doing Our Bidding.

I don't even know the guy, but apparently he's out there doing my bidding. Who knew.

Also that girl who callously, evilly texted to a suicide-threatening boyfriend that he should man up and just do it already -- which he did -- has been found guilty of manslaughter, which she shouldn't have been. There is no such crime as Murder By Text, and it tears at the foundation of criminal justice -- that all things which are illegal must be specified as illegal in a written code before the fact --to make up a crime post-ante and then convict someone of it.

No word yet about Cosby. Seems like a hung jury.

So something is off.

I'm sure not all the shootings are justified. If they prosecute every shooting, it both promotes to a certain segment of the public that ALL shootings are unjustified, while simultaneously undermining the faith of the entire public when the cases come back not guilty.

I'd like to see cases of unjustified cop shootings prosecuted and see those cops jailed. And I'd like to see the opposite cases dropped and maybe have the DA actually stand behind a microphone and blame the perp for once.

I'd also like a new built NA engine for my 350z. Keep your damn ponies.

Except if she had told him to murder anyone else, like if he was ranting about how his neighbor was evil and needed to die and she texted him that he should go ahead and just snuff the guy out, she would be culpable in that death.

But, applying that to suicide is a bridge too far. Suicide is not manslaughter and pretending that it is in the name of "justice" is anything but.

80 OK on the suicide-encouraging texter - and to conflate reality with fiction - years ago on season 2 of Prison Break (which I recently Netflixed to get up to speed on the re-launch), William Fichtner's character, a sinister FBI agent/hitman for the "eeeevil" secret organization - was trying to kill off all of the escapees who had made the breakout at the end of season 1. One of those escapees was clearly mentally ill. When Fichtner caught up to him, and had him cornered on a tower. Fichtner knew he was very mentally unstable and desperate, and literally *talked* the whacko into jumping to his death.

It was very chilling. It was morally reprehensible. And Fichtner's character *was* a murderer (he'd killed one of the other escapees in custody in cold blood in a fake 'escape attempt'). But you know what?

It wasn't a crime. Just evil. Probably the most evil thing he did during that season. (In the classic ways of TV, he changed from villain to ally/good guy in season 3.) But it was the one 'kill' he got that did not involve committing a crime. Evil isn't always illegal.

The chick with the texting may be an evil c-word - and she may have known the guy was a high suicide risk, and there's probably a special treat waiting for her in hell. But - not a crime.

84 Ace, there was a lot more to her conviction for involuntary manslaughter (reckless and wanton conduct leading to a death) than the texts. Evil at those were, the "actions and inactions" the judge cited in support of the verdict encompassed more than her insistance by text that he kill himself.
She was aware of his mental health history and suicidal state, which made her conduct on that score culpable morally at least. But she also knew his attempt was in progress, where he was, and had a means of communication, and failed to summon rescue. She also actively obstructed efforts by his family to find him while the suicide was in progress, to prevent their interference in his suicide.

I agree she was criminally negligent, and deserves her conviction. She is to be sentenced as a youthful offender for involuntary manslaughter, and her conduct is at least as culpable as a teen who never meant to kill someone but pours gasoline on a bonfire and achieves through reckless and wanton conduct a similar result.

99 I saw the video of Philandro Castille Shooting Death. {I have seen other disturbing videos of police killing people, mostly black of varying ages} I did not sit through the trial. The verdict surprises me.

I have seen political groups like BLM and various race baiters exploit the deaths of black people at the hands of police. It struck me that the exploitation is always in the questionable cases {and not the unambiguous wrongful death cases}, like Ferguson where the Eric Holder justice department cleared the office involved.

It has always bothered me that the cases that appear clear to me of wrongful death at police hands never get proper coverage.

It bothers me that there is not one organization that tracks deaths at the hands of police. Something showing the numbers and dividing the numbers by the unambiguous wrongful deaths and the justified {excused} deaths.

There are too many deaths by cops that do not seem justified to me. When you feel the justice system does not dispense justice, and the political system is unresponsive to the voters, what does one do?

102 Hard to know how to feel about that Yanez verdict. Seems as if the victim was trying to do the right thing (letting the cop know he had a gun), but after he said that he apparently kept moving his hands, which freaked out the cop and caused him to over-react.

The cop has been fired from his job, which seems appropriate.

As for Cosby, I think he is guilty of being a sleaze, but I also think that Andrea Constand, his accuser in this case, was pretty sleazy herself.

Constand knew Cosby was interested in her for sexual reasons, and instead of telling him that she was a lesbian and not interested, she was having intimate dinners with him, accepting personal gifts (perfume, cashmere sweaters, etc.), going to his hotel room when she knew he was there alone, etc. None of that gives Cosby an excuse to drug Constand and molest her, of course, but I can understand how jurors might be reluctant to send Cosby to prison based on her testimony. She comes across as a person of rather dubious character. I also found it odd how she explained why she continued calling Cosby and asking for tickets to his show after the alleged molestation. "My family wanted to go." Uh, this is the guy you claim raped you (digitally) and ruined your life. Why not just tell your family that Cosby is a horrible person and that you're never going to have anything to do with him again because he did something terrible to you? You don't have to give them the details. But she says (essentially) "hey, my family wanted to go to my rapist's comedy show, so I called my rapist for tickets" -- like that's a perfectly normal thing to do. Weird.

My review of our state's concealed carry law says that's a no-no.

It doesn't necessarily justify shooting him, but any pretense that "the cop had nothing to fear" goes out the window if the gun was in his lap.

He had two times the legal limit in his bloodstream. Supposedly she told the boyfriend she didnt think it would hurt to give him booze. The prosecutor wanted second degree murder but the judge said there was nothing that showed this was premeditated. This all happened less than a year after her husband's death. She was guilty of a bad decision but she really loved her son.

It wasn't just the ongoing encouragement to commit suicide, which is bad enough but probably not something that could be considered a homicide (though it's got to be some kind of psychological abuse). I think what tipped the judge's finding was the fact she was texting him during the suicide itself. It reached a point where he became frightened, didn't want to die, told her so ... and she told him to get back in the car. She knew he was trying to kill himself, and contacted no one except him ... to tell him to nut up and suck down those fumes, already.

She's a loathsome piece of excrement no matter how you slice it. Still, I wouldn't be surprised to see this reversed on appeal.

I think it's a proper finding because the statute she was found guilty under requires "wanton or reckless behavior" that leads to someone's death. She KNEW he was suicidal, she KNEW he had mental issues, she KNEW he was -- at that precise moment -- at his car pumping it full of exhaust. I think it's entirely reasonable to consider her instructing him to get back in the car and telling him things like "you don't want to live like this anymore" to be *at least* reckless or wanton.

I don't know what the law is in MA but I guess that will determine the outcome of her appeal. I don't think this particular case is a 1st-amendment issue.

If Johnson had gone to cops with her story at the time and tried to have him prosecuted for what he did, I'd say throw the book at him. But she didn't. She was afraid of not being able to get jobs in the future, probably a reasonable fear under the circumstances. And a lot of the other Cosby accusers seem to have made the same choice.

It's too bad, but we have statutes of limitation for a reason. It's not fair for the accused person to have accusers coming forward 20 or 30 or 40 years after the event, and saying "hey, he molested me too, and now I want justice for a rape that happened in 1969 and that I never reported until now."

I understand that Cosby had more power in the industry than the women did, but sometimes you have to take a stand, even if you think you might not win, and even if you think it might cost you some jobs or some friends.

And if, for whatever reason, the woman decides she's not willing to take that stand, then she doesn't get to demand that her molester be convicted in some other case, where the evidence against him is dubious, just so she can get some satisfaction for her case -- the case she was not willing to bring. That's not how our justice system is supposed to work.

Yeah, that is definitely the most troubling aspect of this, and the real worry is that this becomes a stepping stone to find people guilty of homicides just for being rude to someone who later kills themselves. That's what nearly happened a few years ago with that kid who threw himself off the GWB after his roommate took video of him having sex with another man. There was *no* evidence that the video was the reason he killed himself, no note or even hearsay that he was upset over it, but they tried to nail him to the wall for it anyway because Sympathetic Dead Gay Kid.

I think this is a highly unusual set of circumstances, partly because she was *so* brazen about it, but I personally find the verdict completely defensible.

The reporter did not give the gun's make, so if it's the SKS reported yesterday, this report is so stupid I don't know what to say.

326 Some good news. My swamp cooler hasn't been working since monday. Kidlet and I fixed it today and I am rockin 74 in the house. It's 96 outside. Had to go up on the roof and adjust the float a few times, but I think I'm good now. Gonna be 100+ for the next week.

Take the Charles Manson case. The law found him culpable because he inspired, plotted, and bamboozled the scumbags into doing murder. But the law also found the scumbags guilty.

Or how about that school teacher who seduced her student into killing her husband? Yeah, she was the mastermind and manipulator, the originator of the plot, so she got life. But he got 30 years or something --- because, as you say, he wasn't a mere robot.
