Media on Trial, For Real: ABCNews Could Face $5.7 Billion Damage Claim in Defamation Case Revolving Around "Pink Slime" Claims

$5.7 Billion.

A judge has dismissed their motion to dismiss (on First Amendment grounds) and the case now goes to a live jury. A live South Dakota jury.

The potential loss is so vast that Disney has listed this case, and no others, in a shareholder report noting possible liabilities.

I wish them luck with a capital "F."

71 It's an interesting case, but a long way from a judgment trebled to $5.7 billion, and then actually collected. As these things typically go, expect a settlement sometime soon for a couple of hundred million, at most.

That's not a killer for DIS, which has a market cap of $164 billion, but it would be a warning to MSM.

MSM may get sued by Trump for libel. Yeah, yeah, The NY Times v Sullivan case. But MSM is creating quite a record of actual malice with things like using anonymous unknown unvetted sources, and what their reporters say on social media.

The major banks all paid back their tarp loans, but GM defaulted.

The taxpayers basically bought GM, gave it to the UAW, and let the new GM have that "loss" as a tax write off for future earnings to the tune of billions.

It remains to be seen if it's practical. A lot of this kind of stuff works fine in the lab, but only as long as the temperature and humidity remain in a certain range, or only for a few weeks before it stales out. That is, it's not practical for combat couture. We shall see.

You are both wrong. The GM pre-packaged bankruptcy and subsequent reorganization did not involve the use of TARP funds, and was negotiated entirely by and during the Obama administration.

I'm not saying it was done properly, or that the US government did not issue securities to guarantee the transaction during the transition (although all of that has been unwound by now). Just that GWB and TARP were not involved. At all.

The only one he is being criminally charged with raping, at least in this current case, is the Constand woman from Temple U. One of the other women is being allowed to testify about a similar assault she says happened in the 80's, to establish a pattern.

The Constand woman testified today and she has some serious credibility problems. She claims she just thought Cosby was trying to help her career, but she was accepting very personal gifts from him (cashmere sweaters, perfume, an expensive hairdryer so she "could style her hair the way he liked it"), calling him incessantly, going over to his home for one-on-one dinners with him in front of his fireplace, going to his hotel room at night when she knew he was there alone, etc.

Also, she told conflicting stories about when the assault happened. In one version, she told police it happened on a certain date when she went to Cosby's house, but then her phone records showed that at the same time she claimed she was unconscious, or nearly so, and unable to move because of the drugs on that date, she was making multiple phone calls to various friends, and even to Cosby himself. So she changed her story and said that it happened on a different night, and that she had just been thinking of confronting Cosby on that night, and that is why she was confused. Sounds pretty dubious.

The main problem is that she claims she was never interested in any kind of romantic or sexual relationship with Cosby because she's gay, but then why was she leading him on the way she was? Why accept the personal gifts, why keep going to his house for intimate dinners, why go to his hotel room, why keep calling him? Just say "No, dude, I'm gay and not interested." She was apparently trying to get something from him -- money, favors, whatever, and she was using his sexual interest in her to try and keep him on the line. Again, does not give him the right to drug and/or molest her, but it makes her look like an opportunist and with all the other discrepancies in her story, it makes her look less than credible.

Unfortunately, since close to half or even more rape accusations by women are false allegations, I'd like to hear all the evidence. But from what I know, it sounds like regret and not rape, and there is a huge difference you know.

It is a he said she said, which is why they should have immediately went to the police and filed charges. I expect the paper trail to be available for all of them if this is the case.

My comment was a clear implication that there was consent because of the years and decades between the incident and because they voluntarily took recreational drugs and alcohol with the man. You know when you go back to party with a man that sex is 100% a given.

Sounds like they all have a case of regret decades and years later.

You will not address the Mike Tyson example. The victim immediately pressed charges. Mike Tysom was 100 times more intimidating and more valuable than Cosby.

No taking a drug and alcohol willingly does not mean you consent. But changing your consent to a non consent years and decades later with SJW standards of law on the books does not mean at the time that they did not consent.
