Wonderful: Our Judicial Overlords Overturn Sentence on Younger Member of the Beltway Sniper Duo

He was sentenced to life without parole at age 17 -- but a judge has vacated that sentence, claiming that a 17 year old can't be exposed to our harshest penalties, as they have the greatest chances of reform.

Malvo appealed to the court saying he should not have been sentenced to life without parole because he was 17 years old at the time of the murders and he based his appeal on the Supreme Court ruling in Miller v. Alabama.

The decision in the Supreme Court case ruled juveniles are constitutionally different from adults for the purposes of sentencing "because juveniles have diminished culpability and greater prospects for reform," which makes them "less deserving of the most severe punishments." Judge Raymond Jackson agreed and made his ruling to vacate Malvo's sentence.

Even though this guy committed serial acts of terrorist murders, shooting random people over a several-week period.

And he did it for Allah.

There's a lot of real terrific Reform Stories about Islamist murderers, right?

And yesterday, the Fourth Circuit Court of Appeals upheld the national injunction against the travel ban. I guess they want more Manchesters.

Every week I'm shocked to see how the nation has chosen to completely forget 9/11, and now it's begun the hard work of forgetting all the terrorism that happened in the year following 9/11.

In two years, Djokhar Tsarnaev will be The Bachelor.

And I'll just leave it at that.

87 The decision in the Supreme Court case ruled juveniles are constitutionally different from adults for the purposes of sentencing "because juveniles have diminished culpability and greater prospects for reform,"

Sentencing of serial murderers is not based on their 'prospects for reform".

That said, so Lee Boyd Malvo might have "greater prospects for reform" than adult serial killers ... but his prospects still hover right in the neighborhood of ZERO.

And serial killers are not entitled to any chance to reform. They have proven themselves dangerous enough to be taken out of society forever.

Malvo never should have gotten a life sentence. He should have been fried. And this judge is an accomplice of the Beltway snipers, now, too.

135 T.Rex also, unfortunately, opined that Western countries "need to do a better job" of welcoming immigrants and helping them to assimilate.

No. Wrong. The burden isn't on us. It's on them. Generations of immigrants before them have successfully assimilated. If a specific group of immigrants won't, or can't, do so, that is not the fault of our society. It's their fault.
Posted by: torquewrench

It's boilerplate platitudious nonsense of course, but there is a point to be made in term of assimilation.

The US generally and Western Europe in specific have adopted a broad societal pyschology of self-loathing primarily through media and academia. The West is inherently evil and responsible for all the world's problems, past and present. I'm sure you're familiar with this.

In this atmosphere it's a damned near miracle that immigrants would want to assimilate. Why would they if all they hear is "RACISM, RACISM, ISLAMOPHOBE, COLONIALIST, ANTI, ANTI, ANTI!!"

We've allowed the Left to turn our countries' intellectual resources into our own enemy propagandists.

159 Judicial coup status:

[X] Intact
[ ] Reversed

When I started providing this valuable update service (immediately following the first illegal, non-binding order from the WA district court), I wondered whether the only apparent path to restoring rule of law was for these judicial rulings to get more and more outlandishly lawless and ridiculous - and to affect more and more concretely important things.

That is, that only by being emboldened by this brazen lawlessness, the judiciary would quadruple down in such a way that, finally, "something" had to be done.

Pretty clear now that NOTHING will shake people out of their brain-dead, lazy, and constitutionally/historically illiterate torpor that, zombie-like, can only murmur "must defer to courts, must defer to courts". If there were an administration where the stars had aligned for the long-overdue correction, this one (product of a national rebellion, in effect) was it.

But here we are. Almost June. The review period mandated by the EO would have expired by now.

Still have a teeny bit of hope that *some* level of outrageous, brazen lawlessness by the judiciary *might* provoke the desperately needed response - repudiation, with comprehensive explanation, aggressively explained. Cannot believe that these dim, largely alien, lawless dipshits in the judiciary will be able to resist assuming further executive and legislative powers.

But Sessions is unlikely to have other than the robotic default mindset that stipulates the effective end of the constitution (without understanding that). So it all comes down to a bombastic real estate developer.

No. Wrong. The burden isn't on us. It's on them. Generations of immigrants before them have successfully assimilated. If a specific group of immigrants won't, or can't, do so, that is not the fault of our society. It's their fault.

Not much to "work out" with any completely mislabeled "progressive". Racist as a Klan kleagle, authoritarian as a Bolshevik true believer in the Russian civil war, ignorant and unworldly as a hamster on science, economics, and history.

And the masses of dumbed-down NPR-listening suburbanites, who have less and less f***ing clue what "their" side even stands for any more - marinating in the toxic soup provided by media/academia/pop culture/(even some churches) .... if they aren't directly immediately hurt by some stupid policy, they're for it.
