Revealed: Obama's NSA Absused Data-Collection To Spy on Americans for Years

In this article, "upstream collection" refers to collecting data from the infrastructures of communication -- phone signals and the backbone of the Internet itself. So a sort of global collection, I guess. Vacuuming up all signals from their sources.

I suppose "downstream collection" would be targeted at individuals, intercepting, for example, signals on a specific phone line or from a specific computer.

Sara Carter reveals that Obama's NSA ignored its own "rules" on this for years.

The National Security Agency under former President Barack Obama routinely violated American privacy protections while scouring through overseas intercepts and failed to disclose the extent of the problems until the final days before Donald Trump was elected president last fall, according to once top-secret documents that chronicle some of the most serious constitutional abuses to date by the U.S. intelligence community.

More than 5 percent, or one out of every 20 searches seeking upstream Internet data on Americans inside the NSA’s so-called Section 702 database violated the safeguards Obama and his intelligence chiefs vowed to follow in 2011, according to one classified internal report reviewed by Circa....

The normally supportive court censured administration officials, saying the failure to disclose the extent of the violations earlier amounted to an "institutional lack of candor" and that the improper searches constituted a "very serious Fourth Amendment issue," according to a recently unsealed court document dated April 26, 2017....

Officials like former National Security Adviser Susan Rice have argued their activities were legal under the so-called minimization rule changes Obama made, and that the intelligence agencies were strictly monitored to avoid abuses.

The intelligence court and the NSA's own internal watchdog found that not to be true.

"Since 2011, NSA's minimization procedures have prohibited use of U.S.-person identifiers to query the results of upstream Internet collections under Section 702," the unsealed court ruling declared. "The Oct. 26, 2016 notice informed the court that NSA analysts had been conducting such queries in violation of that prohibition, with much greater frequency than had been previously disclosed to the Court."

I can't wait for CNN's wall-to-wall coverage of this.

It was not until the Snowden revelations that anyone in DC even acknowledged the possibility of the NSA scooping up US citizen's information.

17 It's bizarre to me how quickly people just accepted that we now live in a country where the government can and does spy on everyone at all times, and now we're just arguing over what loopholes they should have to jump through to "unmask" your name.

No one's saying "uhh... the NSA can't operate on US soil. And they always swore they didn't until, like, last Tuesday. And yet, here we are saying they didn't even follow their rules while already were in violation of the law, but its probably not a big deal anyways."

45 Binney says NSA collects everything on fiber optic, and at this point anyone has access with no trace left behind. Obama made sure the Democrat deep State would be a fully operational death star against a non-Dem duly elected president.

But Binney (former NSA that set up much of the program) said much of that open access could be rescinded by Trump. So that might eliminate a couple thousand people that have open access to things like Trump's calls to foreign nation leaders.

But that has not been done, and Trump still needs to fire and hire a lot of people. Maybe they have all the blackmail material they need to keep every politician under their thumb screws.

68 The Clintons had always been famous for using every aspect of the state for both money-grubbing monetizing events and campaign purposes. Whether Pardon sales, Lincoln Bedroom rentals or using citizenship programs as voter mills, all programs were corrupted for their private use, down to the theft of the silverware

But the everyday use of Deep State surveillance as just another routine campaign tool like yard signs or balloon drops is a staggering hallmark of the complete and total ideological corruption of the Obama/Jarrett/Brennan mal-Administration.

And not just for campaigns, either. It was a standard tool of political power. Congress was surveilled to pass the Ayatollah's Christmas Package. Scalia told people the Court was surveilled, too.

Again: If Brennan and his Deep State Stooges hadn't been so busy spying on the Congress, the Court, journalists and Trump, they might have actually had time to do their jobs and stop the devastating Snowden, Manning and NSA leaks. And now the latest Chinese breach in which all our spies were rolled up there starting in 2010. The Times just did a big story on it that left out three words:

Obama, Brennan and Hillary.

99 The NSA keeps track of Kim Dotcom in New Zealand, and Seth Rich was spotted, tracked and unmasked when he reached out to Kim Dotcom. Someone realized what he was doing, and called in the cleaners.

I have to say though -- I've known of Kim Dotcom for a long time. I was a megaupload customer for years (disclaimer: I only used the service for public domain material!!).
I remember when he was arrested.

It would never occur to me to reach out to him of all people if I had emails to leak.

Glenn Greenwald? Sure.

That hot Icelandic chick who is the wikileaks public face? Sure.

Kim Dotcom? Ehh... I mean, it'd be akin to reaching out to John McAfee.

In other words, I don't know how much we should invest in believing that Kim Dotcom is doing anything other than trolling and/or trying to get himself back in the news.

He's an attention whore. He was running a business whose entire business model was to allow people to download pirated content w/o being tracked, and instead of being normal and lying low somewhere, he traveled the world in private jets and partied like a rapper.

The OPM "breach" by the Chinese made it pretty clear that the mass Obama-era intelligence spillages were sanctioned from on high, and set up deliberately.

Consider: handing out a federal contract for deeply classified database management and administration, _including full read AND write privileges for the database_, to a firm that was physically located in the People's Republic of China?

That goes beyond the realm of even galactic ineptitude, and into straight-up, no-chaser treason with premeditation.

What are the chances that NSA was not monitoring wikileaks email traffic?

Well, he was accused of hosting a platform for pirating copyrighted material. In other words, facilitating copyright theft.

It's a thing. Big copyright holders have gone after cassette tape and VCR makers and others over the years for it, with various level of success.

But his defense was, of course, that he was like any other content provider and was protected by the digital millennium copyright act and that he had no control over what was hosted on his site and the same kind of stuff YouTube (google) says every time they hauled in to court.

In their defense, I believe the Chinese government was using a front company based in Argentina or some such nonsense.

Either way, the Chinese took some effort to obfuscate their trail.

161 OT, but I looked at the sidebar link about why the US flag is reversed on a shoulder patch. In the video, the guy's explanation is correct, but he keeps pointing to his left shoulder when he talks about a uniform patch. A patch worn on the left shoulder looks "correct", i.e. the stars are to the left. The flag only looks "reversed" if the patch is on the right shoulder.

A simpler analogy is to consider the little flags on the front fenders of the Presidential limousine. If you're looking at them from the left side, they look "correct", but if you're looking at them from the right side, they look "reversed". The same goes for uniform patches.

From the photos I've seen, in WWII the flag patch was worn on the left shoulder, but today it's worn on the right shoulder. When and why did it change?

174 Theoretically, there is proof of this theory. If it is true, there is an unmasking request somewhere in the records of the NSA FISA section. Except the DC Police will never go there, even if they could.

The US Congress could. But it won't.

Theoretically.

I'm just saying that he's not exactly an unimpeachable witness.

I would not be surprised if he came out and said, "Eh, actually I just made the whole thing up. I have no idea with Seth Rich is."

Also, remember when he claimed to have Hillary's other 30,000 emails? Still waiting for that doc dump, Mr. Dotcom.

178 Well, he was accused of hosting a platform for pirating copyrighted material. In other words, facilitating copyright theft.

Yeah ... it was bullshit.

It's a thing. Big copyright holders have gone after cassette tape and VCR makers and others over the years for it, with various level of success.

Exactly. Total Bullshit. Might as well call Xerox the ultimate criminal enabling enterprise.

But his defense was, of course, that he was like any other content provider and was protected by the digital millennium copyright act and that he had no control over what was hosted on his site and the same kind of stuff YouTube (google) says every time they hauled in to court.

Posted by: Harry Paratestes at May 24, 2017 07:19 PM (wmaTe)

And it's a perfectly valid defense. The law doesn't like it so they storm in to people's houses who are making fools of them and chase them around like they were a bunch of terrorists.

But this is how thi8ngs are done these days. We have red light cameras that just send tickets out in the mail, as if the car is the offender. It's total bullshit - and totally un-Constitutional - but cops and local governments do it because they see everyone pulling the same shit with everything else. Nothing ever stopped cops from just looking at your plate and sending you a ticket ... but they never did that ... because it wasn't legal. They had to stop the car and ticket the actual driver.

So, same shit. Government takes an un-Constitutional shortcut because they can't catch the actual "criminals" with proper procedures ... Total bullshit.

Why will my old Twitter profile, which was for humor and was a sock, not allow me to delete somebody I followed. I deleted everything months ago. But It will not allow me to delete Aubry Plaza? So how can I break this connection with her? She is obviously obsessed with me and refuses to let go.

196 It's been a week or so since Rod Wheeler reported on Rich's computer. And the Professional Liars have ruled "CASE CLOSED"!

Compare that to Trump. They've been spying on him with every tool the NSA and the FBI has for at least a year. And turned up zip. So we need a Special Counsel to go a few more years.

In the Rich case, there is a corpse, double-tapped in the back. There are motives and opportunities. There is a putative witness and documents. There is the asshole Assange. And the habitual criminals we call Clintons. We'll see if DotCom produces.

But there is already a helluva lot more evidence in Rich's case than in Russiagate.

215 BTW, it is time for Disney to extend the US Copyright for another twenty years. Can't let Mickey Mouse become free to all.

They already figured out a backup plan. They now use the animated Steamboat Willy as the "trademark" on their videos. Trademark protection is weaker then copyright, but perpetual. So even if copyright lapses, they will sue you for trademark infringement - and even though you might win (trademark is weak after all), they will bankrupt you in legal costs to get there.
