Detroit Female Genital Mutilators Planning to Claim Their Practice is a Right Supported by Religious Freedom

Can't wait to hear all the feminists not talking about this case.

Defense lawyers plan to argue that religious freedom is at the core of the case in which two physicians and one of their wives are charged with subjecting young girls to genital cutting. All three are members of the Dawoodi Bohra, a small Indian-Muslim sect that has a mosque in Farmington Hills.
The defense maintains that the doctors weren't engaged in any actual cutting -- just a scraping of the genitalia -- and that the three defendants are being persecuted for practicing their religion by a culture and society that doesn't understand their beliefs and is misinterpreting what they did.
First Amendment scholars across the country -- liberal and conservative alike-- are closely following the case, noting that the fate of the accused will largely rest with scientific evidence.
The key question for jurors to answer will be: Were children harmed physically? If they were, experts say, the religious freedom defense doesn't stand a chance.
But if the defense can show that it was just a nick and caused no harm, some experts believe, the defendants could be acquitted on religious grounds.

Religious freedom has been found to be a defense for fairly small-bore deviations from legal behavior. But the Supreme Court has ruled against Christian Scientists, for example, who left an eleven-year-old boy's diabetes untreated, in accordance with some religious doctrine that God will heal the sick without need of doctors. (That case wasn't criminal -- the boy's father sued the couple with custody over the boy for $1.5 million in damages. The Supreme Court found that religious liberty could not be interposed as a valid defense.)

(No offense to animals -- some of my best friends are animals.)

This is murky, but circumcision does not deny the pleasure of the act. A more apt comparison would be castration at birth. Even then the lines are murky. It is still a matter of degree- but it is a pretty large step from one to the other.

71 What Soona said. The foreskin is just skin; a traditional circumcision is kind like piercing your ear -- you're not affecting the core performance or use of the organ itself. A clitordectomy, in the BEST of circumstances, would be more like cutting off the entire head of the penis. They're actually the same organ in the early embryonic stages, just expressed differently based on sex.

And that doesn't go into the other effects of FGM, which usually result in UTIs and yeast infections, extreme pain or tearing during sex, and potentially death (to mother and baby) during childbirth because of thickened scar tissue.

Circumcision is a minor procedure that a baby quickly recovers from when done in infancy. It is not a minor procedure on adults so, IMO, it should be done in infancy if it is going to be done at all.

Uncircumcised infant males are about 20 times more likely to get a UTI than circumcised infant males (about 4% chance vs .2%)... and about 13 times more likely to get a UTI than infant females (about 4% vs. .3%). When they get a UTI, it is comparatively more likely to cause permanent damage to their kidneys also. Circumcised males also have lower risk for penile cancer and their women partners have a lower risk of cervical cancer.

So I wouldn't say no medical reasons.

The inside of the foreskin also has a high concentration of Langerhans' cells. Those have particular receptors to which HIV binds to begin the process of entry into the cell, where HIV will then begin viral replication and spread.

Circumcision doesn't confer immunity to infection with HIV, but it certainly eliminates one easy anatomical route.

Sure. There are different forms of FGM: they range from cutting of the clitoral prepuce, through clitorectomy (amputation thereof) to infibulation (removal of clitoris and labia minora). They are documented here:

Not someone I particularly cared for either. On her second marriage after cleaning out first husband. High self-esteem not in agreement with much of anything.

She eventually lawyered up and thoroughly cleaned out the second husband. The pair of them were an accident waiting to happen.

My life is the worse for having known them. There's very few people I could say that about.

Because then it would mean the girls were not seriously damaged. That would also imply that other girls were also spared the gross mutilations, and that other families don't seek them.

IOW, I would rather hear that the crime isn't being done.

Another point, though: there is no Islamic basis for FGM. Islam, like Judaism, requires male circumcision, and the rate is 100%, everywhere. The rate of female "circumcision" among Moslems varies from 100% in a few African cultures to 50% in Indonesia and 15% in Yemen.

Michigan GOP house and senate members are generally pretty squishy, but in this matter, they have been swift and decisive. One bill has passed making FGM illegal, with more severe penalties. The next set of bills will address taking minors across state lines for this purpose and penalties directed at medical professionals. Michigan GOP intends to set the standard for intolerance of this heinous practice.
