Of Course: Federal Court Rules that Firing of Phoenix VA Official, Who Is a Felon, is "Unconstitutional"

You've got to be kidding me.

Note that the procedures ruled "unconstitutional" are from a 2014 law, and this firing happened under Obama.

Though Loretta Lynch also declined to object as to the "unconstitutionality" of the procedures -- Government Workers Uber Alles.

A law was recently passed under Trump to make firing of incompetents even easier -- but that law too utilizes the procedures of the 2014 law, now ruled "unconstitutional," thanks to Mr. Government Obama and his corrupt mob boss.

I mean, look, I reject the notion that an administrative law judge has any authority at all but since the APA was ruled constitutional WHICH IT'S NOT ARRRGGHHH then if Congress has the right to delegate out authority then Congress also has the right to go back and alter the terms of the delegation.

54 The judge decided that an administrative law judge did not have the constitutional authority to fire the person because that person would have to be fired by a Cabinet Secretary, and the administrative law judge got called into the fracas because the union appealed the firing decision of the Cabinet secretary.

So, you see, the person who holds the policy position to fire someone who is not just an employee can't fire the person because the appeal process would be decided by an administrative law judge who doesn't have the constitutional authority to fire.

It really is quite clear. Catch 22 was not just a movie.

Whats odd to me is that they are originally fired by a US officer but then can appeal to an administrative judge who then gives thumbs up or down on the firing. What they threw out was the judge having this final say but under the old law it was still a judge who had the final say they just took years to say it, finally.

My Dad worked in a Supervisory capacity in the VA for thirty years. Basically, forget about firing anyone, if you can dodge the guilty until proven innocent discrimination charges, you are ahead of the game.

And he was best friends with African American head of Personnel who had a multi decade career at the EEOC previously.

Yeah, the court's not wrong per se on this IF and that's the big if IF you accept the underlying premise regarding delegation.

If you're going to speak Delegation Doctrine, then speak all of it, not just few words you sort of remember for that show on Netflix that time.

Hilariously, though, if you take my view to the logical conclusion then the firing would still be unconstitutional since the entire administrative law judge system would be unconstitutional but *waves paw* let's ignore that, shall we.

80 The 9th is destroying what little credibility the courts still have with the average person. At some point, Congress and the president need to breakup that jurisdiction and some of those appointees need to be removed.

In this judge shopping environment, the courts are only as good as their weakest link. The 9th circuit is far from being any bench that equally applies the law. It's essentially a rogue court.

So why doesn't congress just change the law to say that the 'Secretary shall" review and approve all the decisions of administrative judges before they are final. That way the admin judge is not getting the last word on the firing, the Secretary is. Problem solved.

After all, it's not as if thousands or even hundreds of VA employees are being fired every day. So the Secretary can certainly rubber-stamp his approval on the few who do manage to get axed.

Well yeah, that's exactly my concern. If this is unconstitutional then half of what goes on in Washington DC, down to having staffers write laws in congress, is unconstitutional. Is that their intent? Its the same kind of sharp focus imposition of the 14th amendment that has huge implications if taken to its logical conclusion. If you cannot treat x person differently than anyone else based on the 14th amendment then you can't do that to anyone in any circumstance.
