Pro-Life Activists Who Used Standard Media Technique of Undercover Sting Video to Expose Planned Parenthood Fetal Tissue Trade Indicted on 15 Counts

As Randy Barnett remarked (approximately), they told me if Trump were elected the machinery of the government would be turned against journalists, and they were right!

Sean Davis notes that such sting videos are routinely made in California, particularly by animal rights groups who surreptitiously record slaughterhouse workers, who are never prosecuted. Indeed, their sting videos spur the state to investigate crimes the targets of their sting videos might have committed.

David French's link (the first one) notes that California caselaw has limited the law against unconsented recording of a conversation to situations in which the target could have a reasonable expectation of privacy, and has specifically ruled it did not apply in situations like the one we find here (strangers meeting in a public place with no expectation the other party will keep their conversations private, discussing business in a manner they'd discuss business with with any other potential business partner).

But if you're pro-life? Well then. Now the state is coming after you with everything it has.

This cannot go on much longer. When you are this blatant about telling people that they will not have the protections of the law, that some favored groups are permitted to break what is supposedly "the law" while "the law" will be used vindictively against the state's enemies, then there is no "law" at all, and people will very soon stop acting as if there is.

When the state declares large swathes of people to be Enemies of the State, they also simultaneously make the state the Enemy of the People.

What cannot go on, will not.

Corrected: It wasn't Ilya Somin who'd used Instapundit's "and they were right" line, but Randy Barnett.

74 "What cannot go on, will not."

But, ace. The key thing about all the degradation in the US - ever bit of it, in every sphere - is that it *can* go on.

Because when you have the most free, vibrant, productive, adaptable, law-abiding, secure, consequently prosperous country in history, you can nibble away or whack away at chunks of these foundations for a loooong time before it reaches a breaking point.

And - crucially - when one of the key foundations has been largely removed - the American mindset, sense of fairness, recognition that rule of law must prevail - then there is a verrrry long run time on the looting/degradation phase.

Also helps to break the political system such that there is not much representation in representative govt. Other than micro-targeting and micro-servicing of select players (donors, etc.).

This is very well advanced. These comment sections abound in the evidence that the above processes are happening, and show no sign of being stopped.

82 One thing to remember is that freedom of the press is an individual right that applies to all citizens. It does NOT mean special privileges for a self-anointed priesthood employed by big corporations.

If 60 Minutes has the right to pull a stunt, so has Jimmy Snurd.

The MSM have many people convinced that the "press" mentioned in the Constitution refers to a designated professional class. It does not. It refers to the activity of writing and publication.

106 All these lawsuits achieve is to further publicize the sting videos!

So, go right ahead, left-o-fascists, keep at it. By the time you're done, everyone in the entire world will know about Planned Parenthood's illegal sale of aborted body-parts.

Historical parallel:

When the very early Catholic Church tried to "unify" Christianity by banning many of the wide variety of Christian sects and offshoots, Origen wrote a tome called Contra Celsum in which he tried to discredit the more unusual Christian sects (and pagan religions). In so doing, he described them in detail.

Well, as time went on, the Church's attempts to suppress the variants and sects and other religions was successful, and most of them disappeared from the Earth.

Except, Origen unwittingly had preserved their ideologies forever in Contra Celsum. Now, most of what we know about these long-vanished sects is from this one book -- which was intended to extirpate them.

If Origen had never written his book, the sects would have indeed been successfully erased from history.

In the same way, if the left just gave The Silent Treatment to the PP sting videos, they would have more quickly been forgotten. Now, with this suit, they will go down in history forever.

The Law of Unintended Consequences strikes again.

Can you imagine if conservative judges played the same game as liberal ones?

Declare any specific implementation of the income tax as unconstitutional.

Declare deficit spending as a tax on the not yet born, and unconstitutional on the basis of "no taxation without representation" (in the Declaration, but a fundamental concept assumed in the Constitution)

etc...

The problem is there are very truly rural areas left in Europe. I was reading an article a while back about how depopulated rural Normandy has become. The kids (the few the native French have) have left for Paris. All those cute little cottages that dot the countryside are apt to be vacation homes for Brits.

There's a good book called Ordinary Men, by Christopher Browning, that discusses the German Order Police- a bunch of middle aged men recruited to police conquered towns in the General Government, and the Wartheland, as well as filling a security role in areas conquered in the East when the Molotov-Ribbentrop agreement fell through. Your basic, good guy men who became sadistic bastards when given a little power.

365 I just looked up some stuff to refresh my memory, and can safely say it isn't fair to blame the debacle with the Harris County D.A. (Houston) on Rick Perry.

What happened was that a good conservative ex-judge named Mike Anderson was elected to be D.A. in 2012. His wife was also an ex-judge. He died of cancer in 2013, and it was up to Perry to appoint his successor til the next election.. There was a groundswell of feeling that his wife would rule like him and be a natural successor, so Perry appointed her to take her dead husbands spot.

Sadly, once her husband's influence was gone and she had THE POWER!!!, Devon Anderson decided to turn into a typical female SJW idiot. Not only did she support bringing charges against Veritas, she also found disrepute by jailing anyone who didn't please her, including a rape victim. She was bounced out of office by the voters in 2016, and it's safe to say her career is over.

Yet another would-be ruler promoted up to her level of incompetence.

366 I've been too lazy to look up anything about the health care replacement bills. But I never heard whether they got rid of the "All policies must cover every damned thing" that was a huge part of the high rates (the other part being that Barky invited all the drug companies to charge as much as they wanted and the cost of even basic stuff like insulin that shouldn't be under any patents anymore went sky high)

A parallel to Obamacare would be if the government decided everyone should take a vacation every year and then mandated that everyone has to pay for a week at a 4 or 5 star hotel. They will subsidize people below a certain income threshold but "NO, young people cannot opt to just buy a tent and spend a week trekking the Appalachian trail" and "NO, you cannot decide you'd prefer to just stay in a Best Western because you want to have more disposable income to spend on movie nights or bowling leagues instead" Plus the hotels cannot have a surcharge or refuse people who have fleas who are going to cost them a bunch of money because that would be *unfair*

Brings back the lesson, often told and more often forgotten of how unusual it is, if not without precedent, to be born in a society based on individual liberty and rule of law.
The world-historical default is various forms of tyranny, mob rule and the corruption inherent in both of them.
The ones tearing down our precious experiment forget that if they succeed, its very unlikely something anything close to what we have can be rebuilt in our lifetimes.

Moki, this is what my now-retired surgeon uncle told me about 20 years ago. He regularly performed surgery pro-bono, usually when asked to by the local Health Dept.

He cited as an example a gunshot victim who came into the emergency room. He said his allowable deduction, after the surgery and follow-up office visits, would often be $100 or less.

Cops will obey their commanding officers, all the way to the top. At the top they're all political animals unless they are elected, and even then their actions will reflect political considerations as much as law.
So a blanket statement about LEO can't be made, other than they'll do what they're told.

379 Some important Pro-Life leader should make the post's point in no uncertain terms to the prosecutor and judge involved in this, basically let them know if they do this the gloves come off and that they will not discourage violence anymore. It is the only way the left will learn, Don't doubt for a minute that if the roles were reversed the left's activists wouldn't be willing to spill blood if it came to that.
We as Conservatives need to realize that the left is getting themselves worked up to start playing for keeps and the sooner we punch them in the nose the less bloody things will be in the long run.
Trump could do his part by publicly ordering the DOJ to go after Planned Parenthood and the Prosecutor in California who pulled this stunt.

380 Recording is a form of writing down (the most accurate form). To say people can't record is to say that they can't write down, which is a direct attack on freedom of the press and freedom of speech. Thus any restriction on recording must be narrowly tailored to block only those things that cannot be considered to be anyone's business but the speaker's (assuming that rights to privacy are actually constitutional rights at all). The CA law contains no such limitation, making it (and all broad requirements for permission to record) an obvious violation of First Amendment liberties.
