Rep. Nunes: Trump Transition Team Members, Possibly Including Trump Himself, Were "Under Surveillance" After November Elections
Update: Nunez Says He's Seen "Dozens" Of Intelligence Reports That Indicate Some Kind of Surveillance
Although he does go on to say this, which is just confusing:
Nunes said the surveillance appears to have been legal, incidental collection and that it does not appear to have been related to concerns over collusion with Russia.This piece from The Hill makes the Politico piece look like it's been, get this, whitewashed to protect Obama.
The U.S. intelligence community incidentally collected information on members of President Trump's transition team and the information was "widely disseminated" in intelligence reports, House Intelligence Committee Chairman Devin Nunes (R-Calif.) said Wednesday. "I recently confirmed that on numerous occasions, the intelligence community collected information on U.S. individuals involved in the Trump transition," Nunes told reporters. "Details about U.S. persons involved in the incoming administration with little or no apparent foreign intelligence value were widely disseminated in intelligence community reports." The information was "legally brought to him by sources who thought we should know it," Nunes said, though he provided little detail on the source. Nunes also said that "additional names" of Trump transition officials had been unmasked in the intelligence reports. He indicated that Trump's communications may have been swept up.
If it was "legal," I presume this means it was done after securing a warrant, in which case, I don't understand why various people have denied just this thing. If this has nothing to do with Russia, then I assume it's part of a domestic criminal investigation -- and so I'm confused about the "incidental collection" part. I get that if you're talking about intercepting the Russian ambassador's calls; I don't get the usage in a domestic criminal case. Also -- what crime? Or -- are calls just generally intercepted? "Incidentally" collected, but then deliberately disseminated -- with Obama's 11th-hour order permitting the names of US citizens caught up in alleged "incidental" collections to be unmasked. By the way, when Nunes was asked if this establishes that Trump was being spied on, he said: "It depends on one's definition of spying." Update: People are knocking Nunes for giving that answer, which they find "Clintonian." Two points: One, Nunes has been one of the guys pushing hardest to uncover the spying-on-Trump mystery. Two, I can easily conceive of many scenarios in which one can honestly say "It depends on what you mean by spying." Let me offer a few scenarios. Scenario A: An intel group purposefully targets Trump personnel for data interception. Everyone would say this is spying. Though if it were done pursuant to a legal warrant, we wouldn't necessarily say that. We'd say they were lawfully surveilled. (Though we might also say they were surveilled by a warrent obtained for political purposes.) Even in this easiest-case scenario, there are arguments. Scenario B: An intel group targets Russian officials, incidentally picks up Flynn conversations, then reviews its intercepts later specifically looking for Trump associates in the collected information. This seems like spying, but one can argue about it: the capture of Flynn's conversations was incidental, but the determined effort to sift through captured conversations specifically searching for Flynn's voice is deliberate. Is this spying? It's not before-the-fact spying, but it sure looks like after-the-fact spying. Scenario C: Let's say Trump's team did not take the threat of Obama loyalists seriously enough for a while. Let's say that certain well-placed Obama holdovers could overhear Trump communications. Let's say the loyalists then collected the communications they had overheard to and began using them for purposes of Opposition Research. Is this "spying"? In this scenario, the communications were not illegally intercepted. They're being used after-the-fact for purposes not intended by Trump, but they were not exactly "captured." Anyway, Nunes seems like a pretty stand-up guy and I would not knock him for his statement. I would believe him when he says it's a bit complicated. I mean, to me, this is "spying" at least in the broad, sloppy sense Trump intended, and vindicates Trump well enough. But it wouldn't legally be "spying," and I think Nunes is probably just keeping safe and honest in not overselling what he knows. Otherwise, the next media attack will be "Representative Nunes Peddling Fake News." I'd call it spying, in a general way. In a strict legal can-you-go-to-jail-for-it, maybe not. I wouldn't fault him for staying on-sides as far has actual level of information.

There's been a marked increase in this sort of carefully parsed "depends on what the meaning of 'is' is" language, as the D.C. deep state mandarinate gets increasingly nervous.
My favorite so far is the assertion that, no, Trump wasn't wiretapped. Because, you see, wiretapping is a *physical* modality involving connecting directly into the phone lines, as the name itself implies, and none of that was done.
The reality is that for quite some time now, the absolutely overwhelming majority of "wiretaps" have been done in software, at the switch, in the telco central office serving the phone in question.

That reminds me of when a SS guy explained to me the difference between a wiretap and a pen register. Same tool used, but with pen register it captures dialed digits. To be a wiretap you simply turn the volume up and listen. Then he joked that unfortunately sometimes one could bump that volume function and hear a conversation by mistake.
Why do I get the feeling the eventual explanation of Trump's surveillance will be some sort of similar "oopsie" (*wink, wimk*) where some klutzy agent just happened to overhear something or installed the wiretap on the wrong line, etc..

The answer to this is "yes".
Certainly one could parse the definition of the word "intercepted", and certainly, not every call is reviewed.
But anyone with an interest and a warrant (or not, depending on the carrier's legal team) can listen to any call they want at any time. Quite often, they don't even need to listen to it live. Records are kept.

But anyone with an interest and a warrant (or not, depending on the carrier's legal team) can listen to any call they want at any time. Quite often, they don't even need to listen to it live. Records are kept.

True enough, for desktop and laptop computers not connected to the internet by wifi, the amount of leakage power is small; but when you're using that machine in public, say on mass transit, just like other passengers, you have no expectation of privacy. All that you do is open to those who have eyes to see and ears to hear.

Which means about a third of all US cell phone users.

One has to carefully parse the terminology they use. I believe it was Clapper that said when they gather up, say, the Verizon data into their vast server farm, they don't consider that "collecting" intelligence. The intelligence is only "collected" when they type a selector like "Donald Trump" into the system and interrogate the database for Donald Trump's intercepts.
The government publicly claims that it is only metadata that is collected, but both the metadata headers and the body of telephone calls are digitized and sent together through the fiber optic system.
So you could consider it "legal" in the terms of gathering the data into the server farms pursuant to the warrants, but in terms of searching the database for someone, that is supposed to be governed by internal policies and procedures at the NSA and presumably the other friendly governments like the UK GCHQ that have access to the database, and we are told that when someone searches the system for, say, info on an ex-wife, that person is fired.

If you think judges exert any kind of independence on reviewing for probable cause when a warrant request is made, well, then I can see over the steering wheel when I drive.
Warrants are rubberstamped on every level for everything. From the start of the FISA court (1979?) to 2015, there were a grand total of 12 warrants denied. Not per year. Total. Out of over 35,000 requests.
The John Doe WI Supreme Court opinion goes into how the John Doe law has specific provisions on getting warrants that the lower court ignored.
Probable cause as it is practiced is an utter joke. This should concern everyone and isn't a Left/Right issue.

Here is the interesting part and the mens rea for their subversion.
They went to the FISA court for the first request which was denied because it was too broad. They wanted to sweep up as much as they could once they found a premise. The court denied it. But the Obama DOJ just used that to navigate a second request. When that was granted, Obama then loosened up who could see the SIGNET. That included poltical employees who then started illegally, selectively leaking what they believed would be damaging.
My blind parrot could figure out what happened here. But meanwhile the media has their collective thumb up their asses.

From the use of the term "incidental" I would guess Obama people used the NSA database to look up Trump people.
Under the mass gathering of US telcom communications under the omnibus FISA warrants, it's all considered merely "incidental" data because the theory is no one looks at it except with good reason.
So when they want to find out what Russian spies Boris and Natasha are up to, they search the database. The fact that everyone else in the USA happens to be in the same database is just considered "incidental."

Incidental collection means the target wasn't Trump or his associates. They contacted people who were already under surveillance, who we can presume they got legal warrants for. The question is: If they don't have evidence of malfeasance, why were the Americans' names leaked?

From the use of the term "incidental" I would guess Obama people used the NSA database to look up Trump people.
Under the mass gathering of US telcom communications under the omnibus FISA warrants, it's all considered merely "incidental" data because the theory is no one looks at it except with good reason.
So when they want to find out what Russian spies Boris and Natasha are up to, they search the database. The fact that everyone else in the USA happens to be in the same database is just considered "incidental."

I THINK - and I could be wrong - that there was a completely unrelated investigation going on concerning individuals at Trump Tower, not connected to Trump or his team. In the course of that investigation, Trump team communications were caught in the surveillance net.
Where it gets particularly damning is that those in Trump's team - which was NOT under legal surveillance - were then "unmasked" and their communications shared freely among the intelligence agencies. THAT is a very bad thing, on top of already questionable actions.
Again, I'm not really sure what happened, but that's the impression I've gotten from reports.
