Winners and Losers in Last Night's Maddow Debacle

Let's say the obvious first: By dramatically revealing that Trump had paid an effective tax rate of 25%, $38 million in tax on $150 million in income, Rachel Maddow embarrassed herself, and the media, and even managed to make Hillary Clinton look like an even bigger liar than we already thought she was.

Remember this old Hillary Clinton attack line?


This was soon after the New York Times revealed that due to huge, huge losses in one year, Trump could carry over those losses for 15 or so years, so he "might" have paid no taxes in the interim.

Well, $38 million in one year is more than $0. I'm no professional fact-checker, but I believe this makes Hillary Clinton a big fat liar.

It was so bad that Brian Fallon, Hillary Clinton's former spokesman, had to admit... this was nothing at all, and then had to start changing the subject to other matters:



Even the squawking gigantic socialist emu Sally Kohn had to admit this was a "nothingburger:"


But don't worry; she rallied and said a bunch of stupid things later. We'll get to those.

MSNBC's sister network, CNBC, had to admit that Rachel Maddow had done a big favor to Trump.

They tweeted that story out, but then I guess management decided to suppress the truth so they deleted the Tweet. Left the story, but stopped advertising it.

They did later put it back out -- only after they clarified this was just an op-ed, not a fact or anything.

Now, a little more before, obviously, the usual nutters -- the Blue Checkmark Mafia and the NeverTrump bitter-ender fake conservatives -- were ejaculating stupid all over themselves in anticipation.

Anyway, many expressed deflation similar to Rosie afterwards.

A few intrepid souls, however, tried to polish this very mushy turd.

Sally Kohn attempted to lock herself in the Radiation Chamber to save her Captain Rachel Maddow by saying this stupid thing:


First of all, she claims to be a lawyer.

If she were any kind of real lawyer, or even someone borderline fluent in policy, or someone making $100,000 or more, she would know the Alternative Minimum Tax is an additional tax assessed when the actual income tax you owe, once deductions have been taken, fall below a certain level. The point of the tax was to keep billionaires from structuring their income in various tricky ways to pay little tax.

Trump actually had a low income tax liability -- remember, he actually could take those big carryover losses from his bad years -- plus depreciation on his construction equipment, etc.

So his actual owed tax was 4% of his $150 million. But in swoops the Alternative Minimum Tax to come in and say, "No way buddy. You're paying 20.7% more than that, because 4% is so low."

Anyone who's in law and policy -- or who makes enough money to get hit by the AMT ( and more and more people do -- it's called a Hidden Yearly Tax Hike, because the income level you hit it at hasn't been updated in decades, and so more and more people get hit with it even though in real dollars they're making less money than the tax was initially targeted to kick in at) -- knows this, knows what the AMT is, and knows it's a real tax. Donald Trump paid it.

This is all news to squawking gigantic socialist emu Sally Kohn, who thinks if you pay 20.7% in the AMT on top of the 4% in actual tax liability you're... I don't know. Not really paying the 20.7%? Like it's just an imaginary thing? Like you pay it in Fake Dollars?

This is pig-ignorant, and anyone saying something so catastrophically stupid should be barred from making any commentary on any public issue.

Our media, which pretends to know all that needs knowing, spoke of the AMT as if they were attempting to translate those stupid circles the heptapods kept making in Arrival:


The "so-called thing which anyone who is barely fluent in policy already knows about."

That guy's a Daily Beast "journalist," by the way.

This guy answered thus:


Old pal Andy had this point -- if our Media Elites are as Elite as they claim, how the hell don't they know about the AMT? Aren't they already paying it themselves, as many upper-middle class earners are?

By the way, people don't even call this the Alternative Minimum Tax, and certainly not the "so-called Alternative Minimum Tax." They just call it the AMT, because everyone knows what it is. Or anyone who knows shit about taxes does, anyway.

This is like saying "the so-called '1040 form'" or "the so-called 'taxable income.'"

Or like saying, "Trump paid 38 million so-called 'dollars.'"

Other people attempted to play the "It's not important this thing we claimed has now been proven false, we should look at this other thing!" card:


I haven't worked out the math, but I'm going to guess that a guy with $10 billion in total assets should be pulling in more than $150 million a year.

However, this was 2005, not 2016, and many of Trump's holdings in New York rose in value dramatically during that time.

And anyway, this is a pretty bullshit point -- it's not illegal to claim you're worth more money than you are, and most of us already factored in the fact that Trump is a bullshit artist and was probably including the full value of properties he merely only had a percentage interest in.

And anyway further, we all know what the media was looking for here: Proof that Trump paid no taxes, or took a deduction for $17 million for "Kompromat payoffs to Vlad" and "Business Entertainment Expenses for Business Entertainment Hookers With Really Big Tits and Really Small Bladders."

For Kurt Eichenwald to claim that this is the real story that everyone should be focusing on... well, who knows, maybe someone sent him an animated gif tonight and scrambled his noggins.

Finally, one more embarrassment. Remember that kid whose ass-cheeks Emillio Estevez duct-taped in the Breakfast Club? Yeah that kid -- he's got his own shoe on MSNBC, and he's called Chris Hayes.

He tried to defend his Partner in Stupid Rachel Maddow by attempting to use some young-people slang to snark at Maddow's critics.

It's very unfortunate when 40-somethings attempt to use the venacular of 15 year olds which is now officially dated -- and you can tell it's dated, because Chris Hayes is using it:

(4) The merits of the case. It doesn't shed any new light on the Trump. It's equally possible that this is a typical return or that it's the only year he ever made money and he leaked it.

It's not exactly new light, but it does illuminate the illiteracy and innumeracy of the professional commenting class.

So trump could reset the basis and take the difference (between the earlier appraised and current) as a deduction spread out over (I now hear) 18 years.

It was not really losing a billion in a year, it was taking the real estate dive (which happened over several years) in that one year, even though the "losses" were not realized, it was just an accounting thing. those that were forced to sell "realized" the losses, but Trump survived the hard times in NY.

And the reason for such tax structures is it encourages building, which provides construction jobs but also ongoing jobs, and housing. Most/many billionaires (Soros/Buffet/???) have been trading in highly leveraged stock/bond markets, getting favorable easy money policy to juice the markets which has made the rich richer and diversified our economy to foreign lands, often to enemies. Then we bail them out when they fail, but average people lose their homes and jobs.

And Trump made this argument to a congressional committee back in 1990, and was way ahead of the curve, but instead they kept blowing up the bubbles and Wall Street gained control over Main Street, and over DC.

The question is, did he do anything illegal?

Why do so many Americans refuse to hold their government accountable for the laws they impose? Why do they continue to elect law-happy power grubs?

I promise you all of these tax whiners, left and right, are getting whatever deductions and credits they can get down at H&R Block this month. They're not overpaying on purpose. But if you think the system is "rigged," one would surmise you ought elect someone to un-rig it rather than shrieking about people who are in fact following the laws and regulations.

Same goes for immigration, same goes for drugs, same goes for everything else. Maybe we do need to change some laws, repeal some laws. But 'til then, rage about actually observing the laws on the books is both crazy and wrong.

If Trump didn't actually violate the tax code - like, say, Jackson, Mavroules, Rangel, Traficant, Tucker, etc. - there's nothing to report.

There's absolutely nothing wrong with being bigly rich or taking bigly losses. Laws followed, story is a red herring, get the law changed if you don't like the outcomes that observing it brings. That's the conversation that would move the ball.

The Wealthy hold on to these things (large tracts of raw land being the most convenient example) in hopes of future appreciation, not current income. This has always been one of the prime ways for wealthy families in the US to shelter assets, going back to the Vanderbilts in the 1800's.

I remember reading this, it might have been in one of those supplements that Shell Oil put in Reader's Digest, that the US had more oil in shale than Saudi Arabia had in the ground, it was just going to be available when oil hit $85/bbl to make it profitable.

That's pretty spot on.

The cute thing about student loan interest deduction is it phases out at a very middle class number. I believe it's like $80k.

One would think that, if you're going to take out 6-figures worth of loans, you'd expect to be making that during the repayment period. $30-40k at 4% is like $200 bucks a month, cost of a daily latte or monthly parking in an affordable city. The kind of debt that's lifestyle-changing, reaching levels that matches housing costs, justifying some kind of tax break, should be for a graduate/professional degree or something complex that's highly marketable so you can service the debt effectively and in the long run come out ahead.

That's not the approach though. With the state of play - fast and easy and unlimited loan money, political pressure for education, untouchable college staffs, shift to relativism, shift away from objectively-gradeable subjects, and an ultra-fast-rising cost of education - I submit that this deduction is essentially ANOTHER subsidy to make it easier to study crap, remain a longterm dependent child, and participate in the greatest progressive indoctrination machine in western history. My personal AMT story: Many years ago, I received a large bonus and then an even larger raise. This was a significant amount of money and she asked why and I told her that if she did that, I would be $600 over into the AMT and that $600 would cost me in excess of $5,000.

I know other people who had a very rude awakening indeed that the raise they got ended up costing them more in the end due to the AMT. This is not some obscure issue.

A note on the raise: It was very significant indeed and you know what that told me? No, not that the firm wanted to keep me that badly but that I was an utter fool who didn't stand up for herself and demand to be paid her worth all those years before. So, yeah, don't even try to tell me the patriarchy kept me down. I didn't stand up for me and that was 100% on me.

Not necessarily. Depends on how many of the assets are income-producing. Assets like real estate, art, gold, stocks, etc., can be worth millions or billions, but they may not produce income. I don't really believe in "hard ceilings" especially when I remember $150/bbl oil.

But the point of the shale at $85/bbl to be profitable is that the amount of oil we have is dependent on the price of oil.

The way we measure the amount of oil we have depends on the price. There is less oil at $10/bbl than there is at $100/bbl. Because it is a measure of "economically recoverable."

Shale started coming on line when prices were close to $90/bbl because it made economic sense. Then with research going into it and sunk costs already sunk, it is profitable at lower rates. I think the number right now for shale is about $40/bbl

Yes - the guy who was saying that Trump would have been better off buying an Index fund doesn't seem to grasp this point. The S&P 500 may have been up 9.5% in 2005, but those stocks weren't throwing off 9.5% in income. (The dividend yield has been about 2%, according to the internet.)

Yes. Or don't get taxed at all. Like appreciation on real estate. I'm sure Trump structures his real estate holdings so that none of them make a profit. It's easy to do when you have capital depreciation, shit tons of money owed to banks, staff to pay, etc. etc.

It's how Warren Buffet can claim to pay less in taxes than his secretary. He only pays himself something like $100,000 a year in income, donates a bunch of it, and keeps all of his wealth in his company.

Which is smart or tax reasons and for business reasons.

But when you own your houses, cars, etc. cash, and have your personal staff set up in a separate LLC, what are your actual living expenses? Electricity and groceries? I mean, why WOULD you pay yourself millions a year? Just so you could give half to the government?

It depends how much you think the "Trump" name is worth. If it's worth zero, then Trump is not worth multiple billions. He owns percentages of buildings, and you can find out the present value of that (average NYC cost per foot to rent, 6% CAP rate -- or whatever it is in manhattan--) minus all of the money he owes to banks.

However, if you think the "Trump" name is worth something, then Trump Tower and other holdings are probably worth more than just the average cost per square foot to rent the property in Manhattan. That's where you get those wildly different wealth numbers for Trump. It depends on what you think putting "Trump" in front of "non-descript Manhattan tower" is worth.

It's frankly a complete guessing game, because until he goes to sell the building, theres no real way to know what the market values that at.

Either way, Trump is much much much more wealthy than me, I can say that for sure.

Most likely some employee, long since departed, at any one of the dozens of NY Banks that would have seen these as a part of one of Trump's financing deals kept a private copy (which he shouldn't have, obviously) in the hope of selling them to someone some day.

I wonder how much he was paid for them.

Also could have been someone employed by Trump's accounting department - the 2005 date suggests this person left a long time ago. Even though Trump has made a big deal about not releasing these publicly, it's easy to believe that hundreds of professional people have seen them over the years. Which also would lead to the conclusion that there's really not much that is very surprising in any of them.

Well that's my point, it's all speculation. It completely depends on what you think the "Trump" name is worth. There's no way to quantify that unless Trump starts a mass sell of properties so that there would be a baseline of comparable properties to get an idea of how far above market rates a building with the name "Trump" on it is worth.

I suspect that Trump is well in to billionaire range, but there's no way to know unless he sells properties and sees what people are willing to pay for a "Trump" building.

I think that might be the point; trying to do to Trump what they organized for Milo.

The problem is, a lot of people disapproved of Milo's lifestyle and not his politics and may have been looking for a pretext to dump him. I am not sure what is bad about Trump other than 30 years of "crass self important businessman", and it is a bit late to be worked up about that if you aren't already.

Yes, Lewis is a worthy follow-up to the Morse series, and if you have not yet seen it, please find the Endeavor series. Which is a prequel to Morse, set in the 60s, when Morse would have been a Constable (and now Sergeant??).

It's still running, and to be quite honest, I think it's better than either of its predecessors.

But will he then make it look like it was Trump that lied? Because the NSA tapped the tower and the rest of America, and the intel sharing thing lets Obama call the Brits and get the NSA wiretap info circuitously, with no US IC fingerprints. And McCain is setting deadlines for Trump to come clean ... (March 20).

But maybe Comey reveals that Trump may be correct on being "wiretapped" (surveilled) ... but the FBI didn't do it. Maybe he will reveal who has been feeding the "Trump is a Russian spy" type agitprop to the FBI.

The plot thickens ... and sickens ... yes the tower was surveilled. We all are surveilled, and the bureaucrats are seditious leakers. Obama opened it up in his last two weeks for thousands in the IC to have access to all that NSA data, even the "five eyes" other nations.

It's not even about what he has saved, it's the value of the real estate. You may own a building worth $100,000,000 but it only pays you 5,000,000 a year in rental income (at a 5% cap rate).

The way rich people get rich and stay rich is by accruing a large amount of investment principle monies-

and then investing those monies to generate some form of dividend or interest.

But, and here's the point-

You never ever touch the principle for whatever. That stays invested.

Depending on circumstances(interest rates, etc) your yearly spendable income can vary but you will never be poor because-

you never touch that big bulk o'cash.

In Trump's case, his principle is invested in real estate, land, and resorts.

Whatever they generate is what he makes.

Apparently, progtards have a hard time understanding this.


But, it's such a well-known principle of the rich that even Nelson DeMille in his novel "The Gold Coast" quotes the whole 'you never touch the principle thing" and the reasoning behind it.

You get taxed on income, not assets. Trying to tax one year of income (also, a year that Trump was supposed to be in pretty bad shape) and trying to determine current net worth is an exercise in stupidity.

In Trump's case, it's even weirder. His primary asset his the Trump brand. Valuation of intangible assets can be murky at best.

Add that to property. If you own a home, how much has the value changed between 2005 and now? Now apply that to the properties Trump owns and add a variance for properties in development, etc. that are likely on the books for a value far different than market value on completion.

RE investments, particularly hotels & casinos have seen large fluctuations in FMV over last few decades - and most of these are highly leveraged financings, so it is expected that when Trump's Net Worth or Billionaire Status will fluctuate as well
- i.e. Atlantic City holdings

Another Point that I think that she (and I have to assume the majority of Bernie / Hillary voters that insist on tax the top 1%) is this differential point that when we talk about Billionaires that is wealth, not income.

If they really think Mark Zuckerberg, Bill Gates, and the SnapChat Founders' status of being in the Billionaire club is tied to them pocketing >$1B per annum, them they are sorely in dire need of understanding these basics principles.

Bloomberg says Trump is worth $3.5 billion. He's highly likely to be worth at least that and likely a lot more, as Bloomberg has incomplete information.

First, you're leaving out leveraging debt. Let say you want to invest $1. If you're in the business, you will borrow exponentially on the dollar- as much as you can get away with. Now, instead of making a $1 investment, maybe it's $10. Let's say it's real estate. You by $5 in land, put $5 of improvements on it and sell it for $15. You make $14 on $1 less interest and taxes.

Next, see my post at 497. Particularly the part of the majority of Trump's net worth being based on the intangible Trump brand. On that along, Trump could say, "my brand is worth 10 billion" and someone else could say, "Nah, i will give you $10 and not a penny more". Both and neither would be technically correct at that moment.

It's not much different than someone saying a old, broken item that they inherited from their great great grandmother is "priceless". To them, this is 100% accurate. Since they would not sell it at any price, it is indeed priceless to everyone. Then they die and the estate auction people show up and sell the item for $1 along with a box of $2 dog biscuits.

Net worth is far more complex than anyone trying to multiply income for one year understands.

Let's say you have zero dollars in cash, but a bunch of stock. Your net worth is whatever that stock happens to be trading for at that second.

You hear about an estate sale, selling an old barn. Instead of selling the stock, someone agrees to lend you a percentage of that value of the stock so you can go bid on the barn. You're the only person who shows up for the auction, so you get the barn for $1. You call a real estate guy who says that the market value of your new barn is $10,000. You pay back all the money you borrowed against your stock (since you didn't use it) minus $1. You are now worth $9,999 + the current value of your stock- interest due on your $1 loan. You have no cash again, nor do you have any reportable income (unless your stock gained value, but let's assume it lost value since you've owned it).

You go into your new barn and find a rare Ferrari buried under a bunch of hay. Now you're worth Ferrari+ barn+stock- interest due.

This all happened on 12/31. Your interest payment is due on 1/31. You file your taxes and report the prior year loss on your stock value as a deduction and zero income. The govement sends you a check for EITC since you had no income. You use that check to pay back your dollar loan and interest.
