I think what the Times is trying to say is that certain truths are so important that they justify lying, even if those lies lead to injustices, wrongful convictions, or deaths.
Ex. men have oppressed women for centuries, so it's ok to wrongfully convict a male college student of rape. If the truth about terrorism were published, it would trigger a backlash. We have a 20 year plan to repeal Obamacare with the first phase scheduled to kick in 2018 with 2% reduction of subsidies every year for 10 years. Then the phase out of some other things really kicks in the year 2028 and by 2036 we will have the health care system restored. This is a bold plan that will help all Americans.

If everyone involved is dead and gone, it's *idiotic*. Trademark, on the other hand, is more of a reputation law kind of thing. I'm okay with Disney enforcing a degree of *trademark* protection, and that can continue generationally as with any business imprimatur, but what has happened is that Disney has obtained copyright protections over matters that should be trademark only. Do I think that the character of Mickey Mouse needs to be public domain, fully? Not so sure. For me, that is not much different than buying some land, building a house on it yourself, and leaving it to your wife and children. They, of course, can keep it, leave it vacant, or sell it and turn it into cash. The death argument, IMO, is the same as saying that the house become public domain after death and anyone who wants to can live there, rent free. This, of course, is more complex than just Walt and his family. Since Mickey's creation, thousands of people invested in Walt (the man) and his creations, both privately and publicly. In exchange for their capital, they were given shares in the hopes that they could benefit from future value. They bought something virtually worthless and, by benefit of their capital, it grew exponentially in value. Many of those people left their shares to family. I believe in protecting that faith, risk, and value. I agree that there are further complexities and there probably needs to be some limitation at some point (ex. I self publish a book, die, and it becomes a giant hit and I have no heirs... should people be denied access to the book on the sole basis that there is no one left to pay? Probably not. I can see that, perhaps, becoming "public domain"). Again, I respect the counter argument but placing limits on how, when, or for how long someone can profit from their intellectual, time, and monetary investment sounds too much like, "Sooner or later, you've made enough money" to me. Even if I could conceive of a situation where that statement could be valid, the absolute last judge and arbitor I would want is the government. We make laws and elect people on the false assertion that government is a disinterested, neutral party. Nothing could be further from the truth. If it were, we'd have no such concept of "career politician" and the net worth of politicians would not unfailingly increase exponentially in line with their time in office, committee assignments, and seniority. Extremely well stated. My view is still a bit more extreme in on protections than you illustrated but, as I mentioned, i think there is some room for negotiation. Your illustration of property rights, I think, gets to the core. My opinion is that someone either owns something (and can profit by it to its maximum potential, sell it, burn it, or do nothing with it, entirely at their own discretion) or they cannot. If not, then you end up with all the ills of communism. So as not to just play labels, communism works- if you're willing to accept sharing the lowest common denominator, equal shares of scarcity, decline, and make exemptions for someone to oversee it. From the perspective of being in poverty and no ability or willingness to take risk or do better, I can see the appeal for some. I just disagree and prefer to accept the consequences and potential rewards of risk and freedom. You make another excellent point about the correlation of innovation and property rights. I agree. I will go further, in line with my earlier argument, and extend those rights to heir, families, and stakeholders. Unless I combine atoms to make it, build a factory to package it, and take on risk to produce and distribute it, I consider air to be public domain. If it occurs in nature without the assistance or intervention of man, it's public domain. I still object to public domain and government domain being synonymous, even with government as an arbtor, until such time as government can be detached from and not profit by acting in its own interests.
