Kasich Rejects Six-Week Abortion Ban, Signs Twenty Week Ban

The six-week ban is based upon the finding that the fetus' heart starts beating at six weeks. Kasich rejected that as too likely to survive a court challenge, but signed a 20 week ban as more likely to pass muster.

There are a lot of people in the middle* who would be amenable to persuasion on a heartbeat standard, but oppose an outright ban on abortions. The cut-off is not that different from the European norm (2-3 months), and if a majority won't support an earlier ban, I'll take this.

*Hell, I would be considered among that group by most pro-life groups; I support legal abortion in cases of rape or incest, and contraceptives that can terminate pregnancy at conception rather than fertilization.

True. "Eliminate" should not be the standard though. Laws against murder carry enough penalty so as to be a deterrent to murder. Laws against abortion would also have to carry a penalty that would deter abortion. Is that jail time for mom? I believe this is where the "outlaw abortion" crowd runs into trouble. Passing a law doesn't do it unless that law has consequences and most people are not for the types of consequences that would be a deterrent. That's the reason the war on drugs is a failure too. The economics of supplying drugs outweighs the consequences. Same reason that gun laws don't stop mass shooters. There is no law that is going to deter a mass shooter.

The rule Obama did today cannot be undone by Trump simply by an EO.

It can be undone by creating a new rule that undoes it but apparently there is a period that has to happen during which public opinion is polled, and we all know what that means. Remember the popular vote thing.

The only other way is to have it be voted out by both houses of congress, and you know what that means, also.

Fucking Obama did it to us again.

That's because the rule that passed was not an EO, it was a regulation by the Dept. of Health and Human Services.

The Obama admin first proposed the rule 3 months ago, so Trump should be able to undo it in the same time frame. There is no opinion poll. What there is is a period where public commentary is allowed to be submitted. The agency can then give whatever weight to the comments it desires.

Or, like any regulation propagated by an agency, it can be overturned by Congress. Congress doesn't have to wait for public comments; it can overturn the rule expeditiously. If it so desires.

179 fyi, apropo of nothing, I really hope Trump just totally fucks with California for the next 8 years, just because he can and there's nothing they can do about it. They're never going to vote for him or for any other Republicans, so there's nothing to lose. And I don't mean just the obvious things like cutting grants, but pick some laws and perks that the movie industry really, really likes and revoke them, just to piss them off. Allow open file sharing for video media, just because they don't want it to happen. Find a way to put a knee into silicon valley's groin, just because. But revoke it if they will move some jobs into the rust belt. That kind of thing.

I would really love that.

I'd love to see that too, and I live in California. Repeal the Hollywood tax cuts, as Glenn Reynolds always advocates. Unbundle cable services; bye bye MSNBC! Prosecute city officials for running sanctuary cities, maybe as accessories after the fact or something? Make sanctuary cities financially liable for crimes committed by those to whom they gave sanctuary.

Best of all, find some particularly onerous liberal laws or regulations from which they've been exempted (either formally or de facto), and stick those law/regulations up their asses.

Just a few thoughts.
