Jeff Sessions May "Prosecute" Sanctuary Cities That Don't Obey Federal Law

Laws and federal supremacy are racist now.

Can't wait for the arguments about states' rights and local control. Hypocrisy on their end, but not on ours to argue against those things in this particular case -- immigration and the border are matters the federal government is uniquely empowered to control. There simply are no states rights or issues of local control about subjects which are, by definition, national in nature and thus under the ambit of the federal government.

Sen. Jeff Sessions is on record saying so-called "sanctuary cities" that protect illegal immigrants should be prosecuted. He himself may get that chance next year.

Mr. Sessions is president-elect Donald Trump’s pick to be the next attorney general, and if he's confirmed, he will mark a 180-degree turn from the Obama administration on a host of issues, but nowhere more so than on immigration, where he’s been the Senate's leading crackdown proponent.

From his first day in office, Mr. Sessions will have the power to strip some federal funding from sanctuary cities, thanks to rulings this year by the Justice Department's inspector general, who said federal law requires localities to cooperate with immigration agents -- and who provided an initial list of a handful of the worst offenders.

"The sanctuary cities thing is huge. I think most jurisdictions are going to fold like a cheap suit," said Rosemary Jenks, government relations manager at NumbersUSA, which lobbies for stricter immigration laws.

Maybe the cast of Hamilton can show up at the DoJ and do some really biting interpretive dance disses.

14 If Trump yanks funding from sanctuary cities and the illegals leave Denver, Colorado might go back to being a swing state. Might even lean R if some of the white guilters figure out that not exempting a chunk of the population from the rule of law increase quality of life; but that would probably require them to put more dots together than they are capable of, since the local MFM will no doubt be full of sob stories of families scared about going back to their home countries.

I think Reid only used the "nuclear option" for inferior Court appointees (to stack the DC bench).

Not sure if that applies to everything.

Agent Orange Boehner had a chance to shut off the tap. He did nothing.

Now's the time. Cancel the funds. Insist that SF (one of the wealthiest municipalities in America, per capita) pay for its own white-elephant projects out of pocket.

And that's the important thing to consider and remember. States are absolutely sovereign regarding activity and events within their borders, the federal government has no right or constitutional authority to interfere.

Yeah, I wrote that poorly. I meant she was not jailed by the executive branch for breaking a law.

And of course I submit she was right, there was no conflict of law in that case.

In any event, you cannot compel a state official to enforce federal law. Follow it yes, but if follow it means they have to report to ICE or ask questions - no. If they are obstructing the federal government somehow. That's different. I honestly don't know what specifically the sancatuary cities are doing.

I'm not disagreeing with you that that's how it SHOULD be, but that's not how it is. States have very little sovereignty in reality. Usually federal funds are used as the carrot and the stick, but the fedgov runs the show in pretty much every matter.

Take medicaid for example -- federal program that forces states to spend money on poor peoples medical care.

Or a drinking age of 21. Federal law using federal highway funding as a stick to enforce it.

Or any number of things.

Do you check immigration status when a parent enrolls a kid at school?

Shows up at an emergency room?

Do you check when someone's pulled over for speeding?

Drunk driving?

Domestic abuse?

Only when there's a conviction?

I'm pretty sure that's within his power as an executive over the elections commission, but not 100%. States are by constitutional rule, able to run their own electoral rules, but the constitution does without possibility of question, say that the election takes place on one specific day. Only a sleazy lawyer would claim technical obedience by counting the votes then -- and they count them earlier anyway.

However, I object to a blanket negation of vote by mail. Military serving overseas should be able to vote by mail, and I have no problem with the clearly infirm and unable to travel being able to vote by mail as well. But only them, ever.

So police use detainers for "persons of interest." They are not court issued warrants, but it's basically a note that says to all other police "hey, if you have this guy locked up, let us know -- we'd like to talk to him."

Sanctuary cities refuse to honor the ones issued by ICE, and refuse to even ASK the people in custody if they're illegals.

Now could the police ignore that? Arguably, yes. Putting aside the "assisting illegal immigrants" federal laws, the local PD could, theoretically, ignore federal detainers if they so desire.

But the federal government has a million obvious and less obvious ways of "forcing" the municipalities to comply. It could be as simple as saying, "okay, then we will ignore your detainers." or "Okay, then we will charge you more to process fingerprints through the FBI system" or any number of things.

It could also be as drastic as "okay, then don't call us next time you need the FBIs help." or "okay, then you lose all / some federal funding."

The left has been doing this for decades and decades. It's time we used it against them for once.
a) it might fix the illegal immigration problem
b) it might fix the problem of the left weaponizing government when they see what happens when its used against them.

In my opinion, DNA evidence and fingerprints from people not prosecuted should be expunged after a certain time period. They do not have any right to hold on to information on people who are innocent of crime. Of course you would prevail in a court that actually follows the law. Federal immigration law trumps local and state laws.

Well, you'd have certain issues with confidentially that clergymen enjoy, but I wouldn't be against going after tax exempt statuses to start with.

And again, I'm not saying that this is the first move. Legally, I think it would be a fairly easy move to get convictions. Politically, I think it's much easier (and accomplishes the same goals) to follow the left's playbook and use threats of withholding federal funding.

That's not an element of the law unless there are court cases that I don't know about that have teased that out of the text.

the elements are (as I read it)
a) needs to know or should have known the person was illegal (done, no way to argue they didnt know or should have known if there is an ICE detainer)
b)conceals, harbors, or shields from detection (maybe a little more tough, but it'd be hard to argue they weren't concealing, harboring or shielding from detection by not telling ICE that they had a suspected illegal immigrant.)

The trouble with that argument is that if the Left had won they would eventually be using that same argument for imprisoning clergymen for refusing to marry gays or even for not providing equal bathroom access for trannies. They would also start barring doctors who refuse to perform abortions from practicing.

We're seeing now how the rules the left favored (ie the nuclear option and the use of Executive Orders) might come back to bite them in the ass in a big way. If we're not careful the same will be true of us.

So then you go up the chain, and then the question becomes did that person do something specifically against some illegal alien - not a class.

I just think it is a tough prosecution. But the prosecution itself would have an effect because unfortunately the prosecution is the punishment.

I'm not a fan of a federal government that takes that approach, and I'm not a fan of a federal government that threatens to withhold legally appropriated money.

But yes, this is how the game is unfortunately being played. Doesn't mean I have to like it.

ICE detainers are done via NCIC. They know and can track when a there is a hit on a detainer based on who performed the check. If there is a hit but yet no prisoner is delivered, they will come asking. It happened to me. He used a false name which had a detainer. Fingerprints showed he was someone else(also wanted on detainer) 2 days later I get a call wanting to know where he was. That was pre king putz though, so its probably changed. BUT it's very easy to track if there is a hit. So, if NCIC shows a detainer but a body not delivered its very simple to show that someone ignored it.

Well, courts are much less willing to force someone to do something against their will (abortions) then they are willing to punish someone for actively doing something that is against the law (illegal immigrants).

But that's not a precedential issue, thats a judicial issue. Theoretically, if a state doesnt have religious exemption for gay marriage laws, there is nothing right now stopping a judge for sentencing a priest to jail.

Yep. When we moved to Phoenix we had to wait a year to be considered residents for tuition, even though we changed license plates, bought home etc. yeah, not illegals.

They should handle 10' "just fine". The reactor lost a cooling system, but they have backups. It must have been a problem directly from the quake, not any waters. They just said it would take one week to get too hot, if the system was not restored. And they of course have other systems if the one could not be repaired ... problem last time was all backups got wiped out as it was all within the tsunami zone.
