The FBI Illegally Refuses to Supply Congress With the Unredacted 302 Interview Notes from Hillary's Interview; Jason Chaffetz Has Something to Say About That

The FBI has taken it upon itself to decide whether or not Congress itself is allowed to see the notes from Hillary's interview.

Apparently the FBI has now decided it is a superior institution to Congress.

Watch to the end: It gets good.

Don't bother defunding.

Start locking people up. And not in the cushy prisons. Scary, real prisons.

If that happens, will Obama step in with his UN forces to keep the FBI traitors out of jail?

Yes, I know that sounds crazy, but we went from "possible Hillary health issues" to "parkinsons seizure, dragged into van, treatment at the Chelsea Clinton ER room, then a body double showing up and waving to the press" in 24 hours.

197 It would be funny to see the SGT of Arms of Congress go over to try to arrest Comey.

It is EXACTLY what is required. To provoke the FBI response. To show that these agencies don't give a damn about Congress.

Which is why Congress - and PermShitz - would rather do a photo op.

Which is also why Roberts always finds a way to rule the right way on the important decisions.

Better to maintain the illusion of power than get smacked the hell down and remove all doubt.

210 If these bureaucrats knew that when they left to testify that they might not be coming home and instead spending the night in Congressional jail for contempt, they might get the idea.

Posted by: Mr. Peebles at September 13, 2016 08:39 PM (mBYZv)

211 Congress does have the power to order the Sergeant-at-Arms of either chamber to arrest someone. They can be jailed (on the Capitol grounds), as well. This has been held to be an inherent power of Congress.

They haven't done it since the '30s, adopting this "statutory" contempt and civil contempt, which requires the executive and/or the judiciary to get involved. That's all they do nowadays and pretend that's all they can do.

They are too chicken, too girly-men, to exercise the "inherent contempt" powers the courts have ruled they have.

Here's the way it would work. FBI tells them to go fuck themselves, they ain't turning over the documents. The House then passes a full inherent contempt resolution finding Comey and whoever else in contempt of the House.

It passes. The Speaker then directs the House Sergeant-at-Arms to go out and arrest Comey and whoever else. They bring them to the Capitol, and throw them in some pokey they make or wherever they decide.

The courts have ruled this can only be done over one session of Congress. If Comey and his buddies sat it out, under House jail, until the next Congress, they'd have to be released. But the next House could re-pass an inherent contempt resolution and arrest them again.

Again, the House and the Senate have this power. It applies to contempt, refusing to comply with a valid Congressional subpeona and all that.

Congress cannot execute the laws, meaning it can't arrest somebody for violating law, but it can arrest someone for interfering with it's proper legislative power.

I know it's crazy, and I don't think Trump will be a "conservative firebrand", but he's one of the few people that could talk conservative during the primaries and then more believably tack to the middle as the general approached. Despite the MSM'S best attempts, most people realize Trump isn't a normal politician, and is more of a moderate historically.

If he's elected, however, I doesn't give a crap about consistency with his prior statements...so could he become the stealth conservative Ace hoped for (or at least the 75% solution)? Honestly, I don't think Trump cares about 70+% of governance topics, and will delegate. Will he be corrupted by the GOPe, or have more conservative "chamberlains" that handle things?

That runs contrary to everything you've ever seen in your working lives. People that seek power are to be distrusted by definition. THEY WANT POWER !!!

It isn't that the "GOP controlled Congress" is a joke, it is that the separation of powers has been horribly damaged by the delegation doctrine.

That is why this idea that Congress will hold a President Trump in check is a rather insane idea, because it won't hold ANY president in check anymore. Not unless we have someone IN CONGRESS that will actually be jealous of the Congress' powers.

any criminal prosecution that may or may not occur at a later time.

That was my whole point. Congress has "inherent contempt" powers. The Supreme court has said so. But this is different from the executive power I was describing. I was making a distinction between these two things.

Congress can jail someone for contempt, which includes refusing a subpeona. But they're too chicken to actually use this power.

I don't believe it. The evidence just does not speak in favor of this claim. About 90% of the time, Congress just defers to the executive branch. And this is a bipartisan deferral. Look at the D Congress under Reagan, they basically gave him what he wanted. Look at the R Congress under Clinton, except for a brief time from 1995-1996 when Newt was the honey badger, they just gave Clinton what he wanted. Look at the R Congress under Bush, they certainly agreed to everything he wanted. Even when the D's took back control of Congress in 2006, did they "end Bush's war" as they claimed? Umm, no, they didn't. They gave Bush what he wanted, even though he was supposedly some fascist Nazi jerk to them. And we know how Congress has acted ever since 2008.

The will just isn't there in Congress to stand up for a fight to the executive branch. There is no 1994 Newt on the horizon. Congress is going to accede to whatever the executive branch does.

Look, I'll be real honest. They are both destructive to the individual. Even the "Flight 93 Election" article author says as much, with regards to Trump, and he is one of Trump's biggest boosters. He claims we have "too much" individualism, and the reason to vote for Trump is for more "national unity", which is just a polite way of saying more collectivism.
http://www.claremont.org/crb/basicpage/restatement-on-flight-93/
Here is the relevant passage:

"Trump seems to grasp that the best way to do so in these times is to
promote more solidarity and unity. The "conservatives" by contrast think
it means more individualism. Neither of these, either, is an eternal
principle. Prudence calls for a balance. Few would want the maximized
(and forced) unity of ancient Sparta or modern North Korea. Only fool
libertarians seek the maximized individualism of Ayn Rand. No unity
means no nation. No individualism means no liberty. In an actual
republic, a balance must be maintained, which can require occasional course corrections.
In 1980, after a decade of stagnation, we needed an infusion of
individualism. In 2016, we are too fragmented and atomized - united for
the most part only by being equally under the thumb of the
administrative state - and desperately need more unity."
And I just disagree with that. We don't need more collectivism, we need LESS. He wants faux balance for balance's sake. I don't.
Neither one stands up for the individual. Neither one. Do you get that?

What power? Since 1797, the House has impeached exactly 16 federal officials, mostly federal judges, and the Senate has removed 7. A handful of other judges quit before being impeached but in 219 years, that is the summation of Congress' power.

The reality is the Executive has relentlessly been getting more powerful with intermittent stops since the get go. The Executive by definition is more single minded and depending on circumstances and popularity usually makes gains in power, sometimes more than others. And it never gives that power back.

Do you not remember the great liberal freakout of that idiot George Bush expanding the imperial presidency? If Trump wins, you will hear it coming from the left again.

421 381 I'd like to know what is the *real* impediment to Congress reasserting its power. It can't really be because Congress actually does go along with what the executive branch wants. I can't believe that e.g. both Nancy Pelosi's 2007-2008 Congress really did agree with Bush's agenda, and that Tip O'Neill's Congress really did agree with Reagan's agenda, and that 1997-1998 Newt Gingrich Congress really did agree with Clinton's agenda. All of that being simultaneously true simply doesn't pass the smell test with me.

I think the problem is structural in nature. Congress has just delegated too much power away, and now it can't claw it back anymore, for whatever reason.
I simply point out that the claim that a hostile Congress would hold President Trump in check is a common argument made in his favor around here, and I dispute that claim.

>>I'd like to know what is the *real* impediment to Congress reasserting its power

What power? Since 1797, the House has impeached exactly 16 federal
officials, mostly federal judges, and the Senate has removed 7. A
handful of other judges quit before being impeached but in 219 years,
that is the summation of Congress' power.

The reality is the Executive has relentlessly been getting more
powerful with intermittent stops since the get go. The Executive by
definition is more single minded and depending on circumstances and
popularity usually makes gains in power, sometimes more than others. And
it never gives that power back.

Do you not remember the great liberal freakout of that idiot George

That came to my mind a few days ago. Someone wrote that one reason why it was a good idea to impeach IRS goon, Koskinen, even though he will be out of office in 2 months, is that it would disqualify him from holding office in the future.

Is that true? Hastings is elected instead of appointed, so maybe that makes the difference. I was too lazy to research the point. But, if Koskinen would be constitutionally disqualified from holding federal office after impeachment, why not Hastings?

Which is what Democrats did in 2007-2008, and also from 1980-1992, vs. a Republican President.
Which suggests that the real problem really isn't specific to Republican lack of spine (although that is a problem too), the real problem is more fundamental than that about separations of powers in general. Which was my point all along.
Briefly, I don't think Congress has the functional ability to resist the executive branch in any substantive way, regardless of which party controls what.

484 Who has the authority to arrest Mr. Comey and this little putz?

We need to put arrest Comey and Lynch and others for obstruction and conspiracy and consider whether there was treason involved.

I am way beyond tired of this flagrant violation of the law.

It is time for the citizens to rein in the unconstitutional government and restore liberty.

You go with that. This is the first time we've ever seen crazy illegal shit in politics.

487 Let's see, Speaker Ryan orders the Sergeat-at-Arms to arrest me on some pretext, 'cause he got pissed at me for saying mean things about him.

The SatA gets some Capitol Police and them come and get me. I simply file a Habeas Corpus petition with a federal court.

Unless I was arrested under some lawful power of Congress, such as Inherent Contempt which I was going on about above, the federal judge will grant it and tell Speaker Ryan to release me, as he has no power to arrest me.

488 Reagan wanted 3 main things:
1. Cut tax rates
2. Increase military spending
3. Decrease domestic spending

Reagan and the Dems dickered. A compromise was reached. Reagan got his tax cuts and increased military spending. But, domestics spending, instead of being cut, continued to grow. They put the whole thing on the credit card.

That is the way it usually works when the opposition has enough power to stop the President. They horse trade and the opposition, while not carrying the day, will at least get something.

It no longer works that way. The GOP has refused to fight Obama. They have decided on a tactic of preemptive surrender. Their killer strategy is to let Obama win and then use his win against him in the next election.

Sellouts.

I would not have known Blair was a trannie if h/she had not said so. Perhaps in person it would be easier to spot - man hands are a giveaway. But you can't see the hands in that video.

490 You seem to have no recognition of the other candidates who are running for president, and fixate psychotically on Trump.

Perhaps more perspective and less visceral disgust for Trump would serve you well.....

If chemjeff understood that the Vichy Republicans in Congress hate Trump as much as he does then he would understand why there's little chance of Congress letting Trump get away with anything. This Congress (and likely the next) would love to impeach Trump, throw him out, criminally prosecute and banish him ... just because they hate his guts so much. And there's no doubt that chemjeff understands that motivation and feeling better than pretty much anyone.

Posted by: ThePrimordialOrderedPair at September 13, 2016 10:21 PM (zc3Db)

491 But, of course, chemjeff can't admit that he understands that the Vichy GOP hates Trumps guts and will do everything to stop Trump from doing anything ... because then jeff wouldn't have his "Trump is the END OF THE WORLD!!!" argument left.

492 Guys and gals. I know we just watched a video and we felt like, yeah man Chafee, get em!!

This is in all honesty super scary. Does everyone understand what we are witnessing?
We have the FBI who is privey to all types of information on every man and woman in that room drawing a line in the sand. It's criminal. It's not American.

I'm stunned by this. The FBI, hired bureaucrats, is refusing to turn over info to our elected representatives?

WTF is running the show here?

Did you not think that Nancy Pelosi and Harry Reid hated Bush in 2007-2008? If so, why didn't they cut off funding for the Iraq War and impeach him? Answer me that, and then you will the answer of why any Congress, Republican or Democrat, will not impeach a President Trump or even provide a meaningful check on his power.

499 But I love Jason Chaffetz!

Posted by: The guy who swears he's not gay or nothin' at September 14, 2016 02:27 AM (17Qy1)

500 That was impressive.

Posted by: Matt S. at September 14, 2016 05:27 AM (KguxY)

501 Jason Chaffetz just stood athwart history and said stop. If Congress exercises its Constitutional powers in this way going forward, the fiefdoms within Govt might easily come to their knees. Or this might be one shot over the bow... and nothing else.

Posted by: GoldenRoger at September 14, 2016 06:18 AM (WsMBD)

502 Although it was an interesting show, and may garner a few votes on November for Jason, it will no doubt result in absolutely nothing. We'll find the info was "inadvertently destroyed" or some such nonsense. The is the Obama regime, not some piddly junior varsity like the old USSR or even Little Kim's NORKS.

504 The entire government is corrupt, from the top to the bottom. Since our government has turned into a system of favors by force, it attracts the scum of the earth seeking the unearned in both treasure and prestige. The support Trump has is not because of Trump's ideas, it's the hope that he'll disrupt or change the system. However, only a consistent advocacy of individual rights will solve the problem, and Trump is ideologically clueless.

Posted by: Individual_Dude at September 14, 2016 08:22 AM (F8Vds)

505 While this is interesting viewing, it means nothing. Govt agencies will still do whatever the hell they want regardless of legal standing. Congress will wail about the unconstitutionality of agency actions, raise a fuss, and then nothing will change. This is TV fodder, nothing more.

And yes, Ivanka. Melania for that matter. Yes.
