When I think of things like the pedo scandal at the BBC and just exactly how long the incompetence of someone at the level of Dan Rather was covered up, it seems believable to me. The capacity for people in these positions to disregard all propriety to suck up to people of wealth and power seems limitless. As with most workplace issues, the truth is probably somewhere in the middle. Was there some inappropriate comments made? Probably. Was it as bad as she is portraying it? Probably not.

Scott Brown is the weirdest name on the list. He has 100% denied ever "touching her waist" or telling her that she'd "be fun to go to a nightclub with", two allegations made in the suit. Frankly, Brown's denial (Boston Herald) is a lot more convincing than Tantaros' claims. Ailes and O'Reilly, I buy it, but Brown? Doesn't pass the smell test.

IMO it was an enormous, unconstitutional mistake to outlaw "discrimination" --and even worse to federalize it.
The ambiguity of what is and isn't "discrimination" (or "disparate impact" or a "hostile workplace") violates any traditional concept of due process, let alone free speech and association. The answer to discrimination should be, as with other private interactions, making new friends, finding employers who appreciate you, go to another bake shop, etc etc. I get it if its a "company town" and the one employer around won't hire x, y or z. But other than for very large enterprises, and clearly defined acts (e.g. not hiring, or not renting a house) the current concepts of "discrimination" essentially turns all of us into presumptive criminals and has us all walking on eggshells, unless we can bureaucratically document all our "reasons" for liking employee A over B, never make a joke, etc etc. This is not how a free people is supposed to live. I've had two 'hostile work place' reports made to HR about me. Both from petty, vindictive female subordinates.
First was for alleged racial harrasment because I had said to another manager that Tiger Woods had sold his soul to the devil. Referring to how lucky he was in a number of tournaments. Off record, HR said they had to address it no matter how ridiculous the allegation was. They had to be able to document that they did their due diligence. The second was when I relayed to group of female and male co- workers what was on the Howard Stern show that morning. My description did not go beyond saying that they did a live bit on shaving and waxing private parts and how funny it was. No profanity or sexual innuendo at all. A worker who was not even in the conversation reported it as a hostile work incident. This one the put in my file as a warning. Like the others, Tantaros contract is subject to binding arbitration. Tantaros went along with arbitration but rejected a "seven figure settlement offer" and went public with a lawsuit. Don't know if she'll be successful in breaking required arbitration, but she's already played her best card (the threat of going public). If I were Fox I'd now fight to give her nothing.
She can't claim "blow me or you're fired" so she needs to prove a hostile work environment. Our workplace (Tatnuck Bookseller, R.I.P) was way too tight-knit/gossipy for me to keep my relationships separate from work. Lots of people in their Twenties, lots of bars nearby (not even counting the one in the restaurant), apartment-living, house parties every other weekend, it was quite the scene (if you were into books and booze and maybe a bit of wacky tabacky). We're definitely not the only co-employees to be married out of the place, 2 others that I can think of, not including a Lesbian "partnership ceremony" back before GM was legal. Not sure how the other couples are doing, but we're 15 years happily married.

I've handled about dozen sexual harassment claims and none of them really proved any damage but they were settled anyway to make them go away. Basically they were legal shakedowns. I'm not saying legitimate claims don't exist just that I've never handled one.

You have to be sure those people won't kill villagers at night because if they do you will be burned at the stake. There is a 10% chance any given person in that pool is a werewolf. You either have no way of knowing who, or are prohibited from using means that may narrow down the suspects because reasons. Do you hire from that pool? ...I'm not saying it's a great way of looking at it. I'm saying it illustrates the risks being forced on employers who can't adequately weed out "bad faith" applicants/employees and why some might be averse to recruiting from certain groups.
