Turnout can vary by cohort. It stands to reason that white non-college turnout will be higher than for Romney, and that black male turnout will be lower than for Obama. This. The court has taken a purely procedural power to try cases, and transmuted it into a plenary power to determine law. The court can determine if a law is constitutional in cases brought before them. When they strike down a law, they are saying that they will rule against the law in this case and in all similar cases that they hear. It a shot-across-the-bow kind of power. The issue is that they cannot hear all cases, and even if they did, the composition and opinions of the court can change while they are doing it. Their current opinion is not holy writ.
