25 Just because the jury instructions may or may not have been "too broad" does not mean the jury necessarily and thereby convicted him based on that broadness. The presumption is that the allegedly poor instructions by the judge resulted in the conviction here.

So, apparently, they can be tried a second time for the same offense because the result didn't come out right.

It wasn't just the jury instructions... it was a blatant misinterpretation of the Law.

The Bribery law is written so that it has to be a quid pro quo and an Official Act must be involved.

The Government tried to say that a Governor setting up a meeting, just like any private citizen can do, was somehow an Official Act of his office.

The Supremes rejected the Governments definition....

There have been situations where it's a real question as to whether one of us SHOULD say something or not, because of how obvious it is. Do you say something and risk hurting the relationship, or keep quiet? I really don't know the answer.

That's my problem as well. The legal system of setting guilty people free for some infraction or error on the part of the court trial is infuriating to me. If they are guilty, they are guilty, it doesn't matter if someone screwed up in court.

This might be getting too complicated, so all I can say is I'm sure all of us have been in situations where two people were clearly a couple, and for whatever reason, they were keeping it a "secret" even though everyone in their social circle knows.

It could make a lot of difference. This won't have been the first time a case was remanded because of jury instructions. Sometimes, there's a discrepancy between jury instructions and statutory or constitutional requirements. Elonis v. United States, 575 US ___ (2015) is an example, actually. The jury instructions allowed jurors to convict on a negligence standard, but the Court found that the federal law in question required, at the very least, a recklessness standard.

I'm not sure what happened in this case, because I haven't read it.

There is another way to look at it, maybe she feels more shame in discussing it with you then just letting it lie? It is her call. All you can do is listen if she does decide to talk.

Is there something about her behavior that makes you concerned beyond her unwillingness to talk about it? Are you worried that she is depressed or on a downward path in some way?

If that is the case, then that is a cause for action, but it has nothing to do with her sexuality.

There was no basis other than the jury instructions to convict him since there was no "pro quo" for the "quid" he got (and even less to convict his wife because, although she was a harridan who is the one who actually asked for the loans... and clothing... and jewelry, nobody elected her for anything therefor she could not commit "official acts").

264 McDonnel is a decent man and I'm glad he's not going to prison (he really can't be convicted on the courts standard of officialacts unless the find some other scheme beyond a meeting or a luncheon.)

He's ruined in politics though and that's case closed, too.

Ironically I think it was essentially his decency that led to this sorry state of affairs. He did what he could to placate an unreasonably discontented wife, he probably did think if Williams as a friend instead of predator. It was hard of him to conceive of so much dishonor in his wife.
