Three Figures Pink And Gray
James Abbott McNeill Whistler

This guy's range was impressive. From soft, gauzy works like the above, to impressionistic landscapes to crisp and detailed realism (look for "Arrangement in Grey and Black No. 1"). He could do it all.

Well, he couldn't hit a curve ball, but that's beside the point.

31 Washington (CNN) In
a dramatic ruling, the Supreme Court on Monday threw out a Texas
abortion access law in a victory to supporters of abortion rights who
argued that if it had been allowed to go into effect it would have
shuttered all but a handful of clinics in the state. The
5-3 ruling is the most significant decision from the Supreme Court on
abortion in two decades and could serve to deter other states from
passing so-called "clinic shutdown" laws.

Justice Stephen Breyer wrote the majority opinion, which was joined in full by Justice Anthony Kennedy.

There
were two provisions of the law at issue. The first said that doctors
have to have local admitting privileges at nearby hospitals, the second
says that the clinics have to upgrade their facilities to hospital-like
standards. Critics say if the 2013
law, known as H.B. 2, is allowed to go into effect it could shutter all
but a handful of clinics in a state with 5.4 million women of
reproductive age.

The only way it is going away is either by constitutional amendment or by appointment of sufficient Supreme Court justices. They only way you get to either of those is by changing the culture of the land such that either of those is politically possible.

To change the culture of the land to support either the amendment or the appointment of certain justices you will need to change the academic and entertainment sectors. That is your target, that is where you need to develop influence. That is the headwaters.

73 I called it this morning

The fascinating thing about this ruling was the "reasoning" the progressive apparatchiks on the court come up with to say that states have no need or right to impose health standards on medical facilities.

Puppy mills have higher sanitary and medical standards than most abortion clinics.

And this finding that the regulations are medically unnecessary.

Apparently the SCOTUS gets to decide what is and isn't medically necessary and not peoples representatives and the medical community.

We are living in a post constitutional, post law, post representative era.

96 Why would a law enforcing basic standards of hygiene on abortion clinics be restricting access to their services? Has anyone asked why it seems impossible for abortion clinics to be run safely & cleanly? 97 //Since this is being run through the US Constitution it seems you will have to get outside of your safe spaces, like Texas, and influence the larger national culture. And no, I do not think that will be easy and yes, I think it will take a long time.//

The Right has to create it's own counter culture, cultivate it, then expand it.

That process is already happening with blogs like Mike Cernovich's Danger and Play, the online #GamerGate community, and with Milo Yiannopoulos' campus tours and podcast.

103 My hair stylist has been living a nightmare.

He was referred by his doctor to a plastic surgery center for surgery on his varicose veins.

Long story short, he had swelling in his legs, was told to go home and "rest," and woke up two nights later paralyzed from the neck down.

He underwent surgery on his spine (docs told his partner he had a 50/50 chance of surviving). They opened up his spine which had a huge infection, and flushed it out, and after nearly a month in the hospital, losing 30 lbs, he's home now, in a wheelchair. Docs told him he'll probably never have full use of his legs.

He told me he's determined to walk again, and is undergoing physical therapy, trying to stand, etc.

Meanwhile, he can't work, and may never be able to.

I asked him if he was considering getting a lawyer, and he said he's too focused on trying to learn to walk again.

I'd be suing the hell out of the plastic surgery center.

Oh, I don't think it would be accurate for many of us to say we
put ANY of our hopes in ANY law, or law generating body.
.
.
.
.Every time something like this happens it gives Dems free ammo to use in elections. The Republicans want to deny your right to an abortion, war on women, they want to take away your birth control, etc. And these laws never get upheld by SCOTUS.

It is high time for everyone to take a step back and let the abortion issue alone. Rightly or wrongly Roe vs. Wade set the right to an abortion into stone, and anything anyone does to try and make it safer or more rare is going to be attacked without mercy as trying to deny that right.

It is only hurting Conservatives at the polls. A clear majority of the Country is fine with killing their babies on demand and not having to suffer any consequences of that.

That equals more babies.

226 So, what will happen now to the four states that have laws passed on the books requiring that abortion clinics have the same standards as any other clinics. Michigan is one of them.

I guess now the abortion supporters will sue to have them struck down.

You know, I'm fine with this. I'm not fine with the decision, because states used to be left alone to regulate it's medical facilities, licensing of professionals, etc.

What I don't want to see is the Supreme Court coming back and edicting that all hospitals MUST perform abortions, including Catholic hospitals, etc.
So, I say, let every out of work car salesman take a weekend course on abortions, open his little shop, and then have at it. A bunch of women die, I really don't care anymore.

Until we have an article V convention and term limits, etc. on these assholes on the Supreme Court, this will continue. As the three conservative judges wrote, the court currently will do everything it can to protect abortion, twisting law into nonesense in order to maintain as many abortion clinics as possible.

If you really want to reduce the number of abortions, stop subsidizing it, and make sure women who get abortions are required to pay at least several hundred dollars, in cash (i.e., no welfare, Medicaid, etc.) for the procedures, no exceptions.

When abortions are no longer "free" to consumers, the demand for them will drop sharply, as females of child-bearing years will start using cheaper contraception methods to keep from taking the hit to their income.

239 As a younger man, especially after the Ken Burns (spit!) series on the Civil War (War of Northern Aggression for you purists), I often wondered how the nation could have come to the point of civil war. Was slavery really the only sticking point? Obviously no. A big one, not the only one. But what else could have driven so many states to say, Eff You, and cut themselves loose.

And now, after the intervening years have added age and some wisdom (what has stuck, anyway), and in particular the last seven years of the JEF, I now understand how things got to where they were in 1864. I obviously wasn't here then (Vic help me out here), but I can't help but believe this must have been what it felt like.

And I don't like it. But I don't know how to fix it.

Here are some ideas.

I was actually thinking more along the lines of influencing the culture by other means that eventually leads to proper laws.

Honestly, I'm shocked I have to explain this, but here goes.

Those laws we get passed get knocked down because judges. Those judges are there because other politicians. Those politicians are there because people, people who vote, people who care more about "getting theirs" and keeping up with the Kardashians than leading anything resembling a moral life that amounts to anything. They care about self-gratification and damn the future.

That is what has to change. No law will change it.

Harder to do...but much more powerful result.

You and a damn lot of other commenters on here are not adequately reading what the issue here is. In TX when this law was passed, as in most States, THERE ARE NO STANDARDS.
This law was meant to establish minimum clinical standards LIKE EVERY OTHER GD MEDICAL FACILITY HAS.
It was NOT written to prohibit abortions. Sure, some of those fly-by-night mills would have to shut down. But they NEED to shut down if they can't meet the same standards a damn dog pound has.

The problem with your whole premise is that the 'government' gets to set what 'they' want. What happened to individuals making private decisions (including what, if any, medical care to use). That is where the whole discussion breaks down -- accepting the premise that the government decides. Tomorrow, a law could be floated that 'ugly' people must have plastic surgery -- it is a 'right', after all to have plastic surgery and somehow, someway, 'government' must support it.

"Abortion, as regulated by the State before the enactment

common medical procedures not subject to such intense
regulation and scrutiny." 46 F. Supp. 3d, at 684; see, e.g.,
App. 223--224 (describing risks in colonoscopies), 254
(discussing risks in vasectomy and endometrial biopsy,
among others), 275--277 (discussing complication rate in
plastic surgery).

12. "Additionally, risks are not appreciably lowered for
patients who undergo abortions at ambulatory surgical
centers as compared to nonsurgical-center facilities." 46
F. Supp. 3d, at 684; App. 202--206, 257--259.

13. "[W]omen will not obtain better care or experience
more frequent positive outcomes at an ambulatory surgical center as compared to a previously licensed facility."

262 I agree AND disagree with the SC ruling on abortion.

I disagree that expecting clinics to have minimum health standards is too burdensome; I am curious if the SC left that door open to some kind of lesser standard.

I do agree with the court on the admitting privileges thingy; this rule is intended to make it impossible for clinics to operate at all. Don't believe me on this? Let me share this 1st paragraph from a 2013 Fox News article:

JACKSON, Miss. - Mississippi's only abortion clinic missed a Friday deadline to comply with a 2012 state law that requires each of its physicians to get hospital admitting privileges -- a law the governor said he signed with the hopes of shutting the clinic down.

And of course there was much pressure brought to bear (read that as we will take away that sweet sweet state money if you don't comply) to every Jackson area hospital to NOT extend admitting privileges to any abortion doc.

Look, we object vigorously to any attempt to lawfare away our 2nd Amendment rights...

How is this different?

Answer -- It's not. Abortions are legal too. Phil Bryant admitted that he was trying to lawfare the last MS clinic out of business.

Posted by: iforgot at June 27, 2016 11:09 AM (pC96u)

You realize that "existing laws" are being lawfared out for abortion clinics.

I think what the vast majority of Americans do not understand is exactly what happens in an abortion. They think that women walk into a clinic. are given a valium, put their feet up in stirrups and while Yanni music is playing in the background, someone in a white coat inserts a slender vacuum cleaner up their vagina and through an open easy access cervical opening, and slurp, five minutes later the contents of the uterus are in the drain, and that's it. One sanitary pad and a Rx for birth control pills and they are out the door.

Why? Because when people try to film what goes on in an abortion , they end up in jail. If an ultrasound is the law, it is struck down because it would 'undue influence" the woman to maybe not have an abortion.
So most people do not realize that performing an abortion requires sedation, anesthetic, drugs to open the cervix, removal with metal spoon like instruments of the contents of the uterus, including scraping the walls of the uterus,(that can't be seen, all this is done by "feel") and then the woman's body, which was pregnant an hour ago, now has been thrown into a non pregnant state.

We don't want to regulate or require minimum standards for these places though , because it might end up blocking someone unqualified from performing abortions.

297 Rightly or wrongly Roe vs. Wade set the right to an abortion into stone, and anything anyone does to try and make it safer or more rare is going to be attacked without mercy as trying to deny that right.

And yet despite Heller, the Left is driven to limit access to guns (and our second amendment) so that we can all be safer.

Because Leftism is a death cult. I'm not exaggerating for effect. At the end of every Leftist policy or goal, there is Death. I think it's demonic, but I think even a non-religious person can see that the way of the Left always ends in death. Always. They want you dead. It transcends that. It also speaks to the competence and engagement of the doctors involved. Would you chose to have a surgical procedure by someone who does not have admitting privilege at the local hospital(s)?

Posted by: Mike Hammer, etc., etc. at June 27, 2016 11:27 AM (9mTYi)

I have heard from more than one OB/GYN that the people who become FT abortionists are the lazy and most mediocre docs in the business.

Abortions are (generally speaking) not medically difficult procedures. If your conscience is dead, it's an easy way to make good money.

You don't have to develop ongoing relationships with your patients, the way a real OB/GYN does, nor do you have to go to the hospital at 2 am to deliver babies. You can keep banker's hours and the women you "care" for are no more real to you than the babies you chop up.

Women having an abortion are having a surgical procedure. Right now, 46 states do not require the person performing the abortions to have admitting privileges(meaning the asshole has a minimum standard of competency proven by board exams, history of complaints, etc. ) in order to assembly line abortions. So when abortionist perforates the uterus, or woman who has serious coke habit is seizuring from coke and anesthetic, all abortion clinic does is call 911. City ambulance, whatever comes, hauls patient to city hospital, and docs there are on their own.

Explain to me why someone performing abortions CANNOT gain admitting privileges to a hospital, therefore developing a relationship with that hospital, regular communication with it, etc.
The reason is because they are unqualified.

But let's let them do surgery all day long on women because after all, we wouldn't want to regulate or restrict a surgical procedure that the left adores.

Okay, if there's a city with a lousy prosecutor, keep her in place but write tons more laws. Apply that to everything. For instance: if the prosecutor fails to prosecute a guy who stole a t.v., require all t.v. stores to have 24-hour surveillance with armed guards, and require all t.v.s to have serial numbers registered with the FBI.

But first see #258. The laws were effective.

369 Last night, I read here about Nigel Farage, who fought against Britain's inclusion in the EU for 25 years and was called a whack job and loon and bigot during that time.

But he kept it up - for a quarter of a century. And he finally got a huge victory last week.

No, it's not the same as abortion, but it's still a bit of a contrast to conservatives here, who cave in out of fear of being uncool, which of course is the most important thing of all when you're talking about a nation of emotional and intellectual adolescents.

"Oh, noes, we must have been wrong about this because they're making fun of us on SNL!" That's the way many react to all sorts of issues, not just abortion.

That lying old Commie fraud Lillian Hellman was given hero status by the left when she said she wouldn't cut her conscience to fit this year's fashion - a great line, although Hellman really didn't have much in the way of a conscience. Unfortunately, many on the right are very willing to cut their consciences.

As soon as you able, woman I am willing
To make the break that we are on the brink of.

371 I am just trying to provide context. The law was written after Gosnell, and pointed at Karpen. The law was put forward by Gregg Abbott who is now the governor. The people wanted the law, that's why abortion Barbie went down in flames when she ran on it.

It is an apt comparison. We are winning at the ballot box, we then lose when court decides. If Brexit were up against a similar group of 9 (or people, it would lose too. We just have to keep fighting and pushing for it.

It was a big mistake for conservatives to get hitched up with the Religious Right.

What a colossal failure this has been for people obsessed with this one issue. Do you have a single victory to show?

Abortion is no closer to being outlawed and the conservative movement keeps losing female voters.

It's evil, but so are a lot of things, and if you want to stop abortion, better do more to convince people it's evil instead of hoping judges and politicians stop people from doing it.

No, I see them as a waste of money and Brussels is now a jihadist capital in europe. Maybe if the EU was less busy with buildings and stealing money, they would have addressed the snake pit in it's midst.

Actually, we have many victories. In fact, it wins again, and again, and again. And we are still fighting it all these years later.

If we had a party who was only dedicated to one thing, maybe we would have even more victories. I don't know that, but there is a history of a party devoted to one moral purpose of having success.

Is there a way to make sure the tags show? I think it is wonderful that you are not playing the thousands of dollars to showoff game (oldest is getting married in September and I am not happy with her 'splash' fantasies), but wasn't there a comedian on HeeHaw who always had a price tag dangling from her Sunday-go-to-meeting outfits. Minnie Pearl?
If I were attending, I would even make an effort to make sure my black 'dress' crocs were clean and my resale shop wardrobe was newer -- and maybe even ironed. Don't tell my daughter.
