Anthony Kennedy Sides With His Liberal Budies to Uphold University of Texas' Affirmative Action Scheme

It shook out 4-3 to uphold it. Kagan had recused herself for once, having briefed the case for the government earlier. (Note: She similarly worked on Obamacare, but refused to recuse herself there.)

Kennedy sided with the liberals -- let's face it, he is one.

Once again, all liberals vote in lockstep. This has nothing to do with the law; this is just another branch of the Democrat-Socialist Party in action.

he Supreme Court on Thursday upheld the race-conscious admissions program at the University of Texas, saying that the plan taking race into consideration as one factor of admission is constitutional.

The 4-3 ruling greenlights the limited use of affirmative action polices by schools.
"The Court's affirmance of the University's admissions policy today does not necessarily mean the University may rely on that same policy without refinement. It is the University's ongoing obligation to engage in constant deliberation and continued reflection regarding its admissions policies," Justice Anthony Kennedy wrote in the majority opinion.

"Something strange has happened since our prior decision in this case," Justice Samuel Alito wrote in the dissent. "This is nothing less than the plea for deference that we emphatically rejected in our prior decision. Today, however, the Court inexplicably grants that request."

25 While I find this decision appalling, it doesn't bother me as some others. At least in this case, the Court is not mandating something upon the states. Rather it is allowing a state actor to engage in something that should be impermissible. That can be more easily corrected by the state itself than an imposition on the state.

They would argue that it 'gives them the opportunity'. I would argue that it harms them more than anything. Telling people they are great when they suck does not favor to the person. It is not always their fault, they might just not have the intellectual infrastructure and habits to carry out the program.

Either way it means they get punched in the mouth, and since they were told they were great, they start blaming the system (which they should) as racist (which they also should, but not for the reasons they assume.)

You already can write down any race you ant in the check box. No need for a "law" to allow that. There's no way to verify what is claimed. What are they gonna do -- give "one drop rule" DNA tests to every student as a criteria for entering college, with "genetic blacks" getting let in, and "genetic whites" being excluded? Even that violates the leftie "truism" that race is a social construct, not something real.

By their own criteria, since race is not genetically determined, anyone can claim to be any race. And, often, they do.

Years ago I defended an employer against a racial discrimination claim brought by a black female who was represented by a black attorney. The attorney missed no opportunity to remind me that he was a graduate of Harvard Law School.

I don't know whether he was an affirmative action admit or not (I'd say yes), but I always had to resist the urge to respond, "if I was black I would have gone to Harvard too."

If I was a smart black person who had succeeded without the AA rope-lifting, I too would be angry that my accomplishment was cheapened by the assumption of nearly everyone I met that standards were lowered for me because of my skin color.

AA is utterly pernicious. It tells an entire racial or ethnic group that its members are assumed to be too stupid to meet the regular standards, while simultaneously tainting the accomplishments of those who were capable and qualified to succeed without it.

You can't have racial quotas, but you can have "diversity," which the Court has defined as having a "critical mass" of minorities on campus.

This genesis of this case was UT's change in admissions policies, because it's Top 10% plan (top 10% of every HS class in Texas gets automatic admission to UT) wasn't bringing in enough minorities.

So, basically, by making the change, UT was admitting that "critical mass" basically means "unspoken quota." If you're not quantitatively measuring the number of minorities, how can you tell if you don't have enough? And if there is a point of "enough" minorities, isn't that point a quota?

Boggles the mind.

But this is the same court that has said for 40 years that the Civil Rights Act, which expressly prohibits consideration of race in the extension of any benefit by any government actor, allows for this kind of racial classification in the first place by a state school.

But how much "black" does someone have to be in order to be black? President Obama is as much white as black, so how is he black? We're told people like Justice Thomas and Thomas Sowell aren't black but that President Clinton is. That seems like its a social construct; not actually genetic or physical at all.

And the schools won't tell you the mean GPA, but I can infer it's way inflated.

Of course, engineers are so much more brilliant than the rest of us peons, but I distinctly recall most of the engineering dudes I graduated with back in the early 90s got their work done in 4 years.

The Berkeley Unified School District, where Democratic/leftist candidates and ideas regularly get 80% of the vote, has far far far fewer white students than there are white children in the actual city itself.

38% of the students in the school district are white:

So -- what happened to half of the white kids in the city?

Their liberal rich parents send them to all-white private schools.

Meanwhile, to make up for lost enrollment, the school district intentionally encourages registration fraud, and advertises in minority communities in surrounding cities for parents to send their kids to Berkeley public schools

End result is that Berkeley Public Schools are now over 61% minority students, most of whom come from slums in Oakland and Richmond.

So the school rankings continue going lower and lower and the quality of education there decreases. Consequence? More liberal hypocrites send their kids to private white schools.

And the cycle just continues and continues.

Liberal hypocrisy in a microcosm.
