Yes, but it hasn't been since the Warren Court, and for the last 60 or so years our side keeps thinking that if we play nice, the other side will disarm themselves.

Almost every liberal victory has come through the Courts as a result.

And we keep nominating John Roberts type of judges to fight this.

The Supreme Court was usually the place where something like railroad disputes across state lines were decided and regardless of the President's ideology, they simply interpreted the law.

You will never have a Court, which is CHOSEN by the State, really limit the power OF the State, for any length of time.

It's one of the few places in the Constitution our Founders did not put in some check and balance... because they never thought the Court would be the final arbitrator of Constitutionality.

Hey, that gives me an idea.

FDR tried to "pack the court" by nominating up to 15 liberal justices, as a way of blackmailing Congress, who caved in to his demands, lest they fear he follow through with his threat.

(There is no set number of justices on the Supreme Court, for those who didn't know -- it can be as few as three or as many as you want. "Nine" is just a random number we settled on.)

But, you see, Trump is such a loose cannon, with absolutely nothing to lose reputation-wise, that he and he alone could have the cajones to just nominate 10 new constitutionalist judges to the Supreme Court.

It would take the Left several generation to recover from that setback.

Just dreaming here.

286 The courts have never been consistently great, because they are filled with fallible, sinful humans. But before around 1940 they were at least less driven by an agenda. There are exceptions of course, Dredd Scott for example, and Marbury v Madison for another. But for the most part they were driven by the constitution far more.

Define 'antique'. The AR-15 design is now 50 years old, and the AK dates back twenty before that, and there's a bunch of other military-origin rifles like the FAL in between those two.

A Browning M1897 can do a hell of a lot of damage in a theater, it's a weapon that an earlier generation of Germans developed a fair familiarity with.

Subject to the standing issue, this was an easy case to affirm in favor of the states and against Obama. For DAPA, Obama didn't issue an executive order or even an executive action. He had Jeh Johnson, the head of DHS, issue a memorandum that created an entire new regulatory regime including the issuance of work permits. Put aside that this new regime is in conflict with existing law. Jeh Johnson's creation didn't comply with the rule-making requirement of Administrative Procedure Act. It's clearly wrong.

As to standing, if 26 states don't have standing here then no one does, The states have established that Obama's "actions" cost them money, ergo standing.

The pity is that SCOTUS on its own initiative added the question of whether Obama has "taken care that the Laws be faithfully executed." This was a signal that if Scalia was still around there would have been a 5 to 4 Obama smack down.

The original comment was pointing out that the MFM routinely uses such terms (fake, homemade, or antique) to "explain" how someone in heavily-gun-controlled-Europe got "an assault weapon" (yes, I hate the term too).

My point was that even that was an admission (albeit unintentional) on the part of the MFM - I don't have to be terribly afraid of a "mass shooting" situation wherein the primary weapon is a musket or lever-action rifle - my Springfield XD can put more hurt on the bad guy much faster than he can fire. In Germany, that's not the case. Maybe not so much with a musket, but certainly with a lever-action rifle or even a revolver with speed-loaders, a bad guy can put a whole lot of hurt down in the amount of time it takes cops to respond.

Michigan tried that. We voted to include in our constitution that state schools(University of Michigan was the primary subject) could not use race in admission selections. U/M was being sued for admitting black students with lower scores over white students becausee "diversity".
The University and it's big money SJW donors took the people of the state of Michigan to court and get a ruling(just like today) that the university COULD use race among it's many selection criteria.
In other words, the constitutional amendment the people of Michigan voted in, to END racial discrimination, was overturned by Federal courts citing "diversity". Even though the 14th amendment claims you cannot discriminate based on race, gender, blah, blah.
Just like our constitutional amendment voted on several years ago defining marriage as between a man and woman. That one was overturned based on the 14th amendment that claims everyone must be treated the same regardless of race, gender, blah blah.

So if you all can figure out, good luck.
What all of these decisions point out is that the SC is no different than any other political body, it's members either rule according to the constitution or it rules according to it's members wishes and dreams and political ideals.

"When we have a full court that can render a full decision, then we'll take their decisions seriously".

I was born to a WASP lady who met a Spanish man (as in, from actual Spain) during his time here in college, and promptly given up for adoption, eventually to be adopted by some very, very white people. By the government's elastic standards I'm Hispanic, and by current standards the fact that I don't look or sound Hispanic wouldn't keep me from claiming any benefits. But I had a nice, lower-middle-class upbringing that taught me honesty and responsibility, and claiming an identity that wasn't mine didn't seem right.

For those not following the whole thing: understand that Leave beats Remain MASSIVELY among Tory voters. So the Tory government has been dependent on Labour, Green, and the rest to bring in the Remain vote.

If Cameron's Remain push fails, it costs Labour and the rest very little, but it costs Cameron everything.

It's been posited that Gove and Boris would urge Cameron to stay on in the event of a Leave victory...but it will be a hollow gesture as heir apparent Chancellor George Osborne so badly gut-shot himself during the referendum campaign that he cannot continue. So even if Dave hangs around for a while, the succession would have been hijacked by Leave.

Why does exit polling say this when the pre-election polling didn't?

Because this is a "change" election.

Traditional polling is an excellent indicator in normal elections. This is because it depends on formulas that extrapolate historical trends in the form of "weighting" which transforms the raw data into what pollsters believe will be the end results.

This works fine in normal years when a traditional incumbent faces a traditional opponent and the election is fought in the narrow band of swing or "undecided" voters, following historical turnout trends.

In a "change" election, all this shit goes out the window. When faced with the status quo or change, the public acts based on the perception of the how things are now.

If people are happy, employed, secure and optimistic about the future, the status quo candidate will win. This is rare and only happens when things are going extraordinarily well. Reagan to Bush was one of those times.

When things are not going well, change wins every time.

In Britain, people don't perceive things as being the best of times. Exiting the EU is the "change" candidate, so it follows that it would do well.
